HomeMy WebLinkAboutOrdinance_356_10/20/1987• ORDINANCE NO. 356 • U AN ORDINANCE OF THE VILLAGE OF TEQUESTA, FLORIDA OPTING OUT OF THE "FAIR SHARE" ORDINANCE ADOPTED BY THE BOARD OF COUNTY COMMISSIONERS OF PALM BEACH COUNTY AS ORDINANCE 79-7 ON JUNE 19, 1979 AND AS AMENDED BY ORDINANCE 81-4 AND 85-3. BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, AS FOLLOWS: SECTION I The Village of Tequesta desiring its own "Fair Share Ordinance" for road improvements within the Village of Tequesta, hereby opts out of the Palm Beach County "Fair Share Ordinance" known as Ordinance 79-7 as amended by Ordinance 81- 4. It is the intention of this Ordinance that the Village shall be entitled to any all contributions to which it was entitled and for which it contributed up to date of the passage of this Ordinance but that all future contributions for road improvements for development within the Village of Tequesta shall be paid to the Village of Tequesta rather than Palm Beach • County. SECTION II If any provision of this Ordinance or the application thereof is held invalid, such invalidity shall not affect the other provisions or applications of this Ordinance which can be given effect without the invalid provisions or applications and to the end the provisions of this Ordinance are hereby declared severable. SECTION III Ordinance shall be codified and made a part of the official Code of Ordinances of the Village of Tequesta. SECTION IV This Ordinance shall take effect immediately upon its passage and approval, as provided by law. THE FOREGOING ORDINANCE was offered by Councilmember who moved its adoption. The Ordinance was seconded by Councilmember and upon being put to a vote, the vote was as follows: FOR ADOPTION AGAINST ADOPTION The Mayor thereupon declared the Ordinance duly passed and adopted this day of 1987.
