ORDINANCE N0. 350 • AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, COUNTY OF PALM BEACH, FLORIDA, PROVIDING FOR AN AMENDMENT TO SECTION 11-25 OF THE CODE OF ORDINANCES, TO PROVIDE THAT THE BUILDING OFFICIAL SHALL ASSUME THE ADMINISTRATIVE DUTIES OF VILLAGE TAX COLLECTOR IN REGARD TO THE SALE OF LICENSES; PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION; PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, as follows: Section 1. Section 11-25 of the Code of Ordinances • r of the Village of Tequesta is hereby amended to read as follows: "It shall be unlawful for any person to engage in any trade, business, profession, or occupation within the village without a license or upon a license issued upon false statements made by any person, or in his behalf. All licenses shall be sold by the village building official beginning September 1 of each year and shall be due and payable on October 1 of each year and shall expire on September 30 of the succeeding year. Licenses not renewed by October 1 shall be considered delinquent and shall be subject to a delinquency penalty of ten per cent (10%) for the month of October plus an additional five per cent (50) penalty for each month of the delinquency thereafter until paid; provided, however, that the total delinquency penalty shall not exceed twenty-five per cent (25%) of the occupational license fee for the delinquent establishment. Any person engaging in or managing any business, occupation or profession without first obtaining a local occupational license if required hereunder shall be subject to a penalty of twenty-five per cent (250) of the license determined to be due in addition to any other penalty provided by law or this Code." Section 2. If any provision of this Ordinance or the application thereof is held invalid, such invalidity shall not affect the other provisions or applications of this Ordinance which can be given effect without the invalid provisions or applications and to this end the provisions of this Ordinance are hereby declared severable. Section 3. This Ordinance shall be codified and made a part of the official Code of Ordinances of the Village of Tequesta. _ ~ • • • Section 4. This Ordinance shall take effect immediately upon its passage and approval, as provided by law. THE FOREGOING ORDINANCE was offered by Councilmember Ron Mackail who moved its adoption.
