AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF
TEQUESTA, FLORIDA, AMENDING SECTION IV OF THE OFFICIAL
ZONING ORDINANCE OF THE VILLAGE RELATING TO DEFINITIONS,
TO INCLUDE DEFINITIONS OF "MANUFACTURED HOME", "MEAN SEA
LEVEL" AND "START OF CONSTRUCTION"; BY P.EVISING THE
DEFINITION "MOBILE HOME"; BY AMENDING SECTION X, SUPPLE-
MENTAL REGULATIONS, REVISING SUBSECTION (A) ITEM N0. (12)
AND ADDING NEW SUBSECTION (A) ITEM N0. (13); BY AMENDING
SECTION XV, FLOOD HAZARD AREAS, TO INCLUDE THE FEDERAL
EMERGENCY MANAGEMENT AGENCY OCTOBER 1, 1986 REVISIONS TO
THE NATIONAL FLOOD INSURANCE PROGRAM; PROVIDING FOR
SEVERABILITY; PROVIDING FOR CODIFICATION; PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA,

~~ FLORIDA, AS FOLLOWS:
Section IV of the Official Zoning Ordinance of the Village is here-
by amended as follows:
Section 1. Section IV - Definitions - is hereby amended by adding
and/or revising and including the following:
A. Manufactured Home. A structure, transportable in one or more
sections, which is built on a permanent chassis and is designed for use with
or without a permanent foundation when connected to the required utilities.
For flood hazard area management purposes the term also includes park trailers,
travel trailers, and other similar vehicles placed on a site for greater than
180 consecutive days.
B. Mean Sea Level (MSL). The National Geodetic Verticle Datum
(NGVD) of 1929 or other datum, to which base flood elevations shown on the

D. Start of Construction. Date the building permit was issued.

Includes new construction and substantial improvements. Actual construction
must occur within 180 days of permit date. With regard to flood hazard area
regulations, actual start of construction is the first placement of permanent
construction of a structure on a site, such as pouring a slab or footings,
installation of piles, construction of columns or work beyond the excavation
stage, permanent construction does not include land preparation (clearing,
grading, filling) or construction of streets, sidewalks, bike paths or walk-
ways.

by amended as follows:

Section 2. Section X, Supplemental Regulations, is hereby amended
r, `s by adding and/or revising and including the following:
~~ A. Section X(A)(12). Revise to read as follows:
(12) Except as may be permitted as temporary facilities,
manufactured homes are prohibited throughout all zoning districts of the
Village.
B. Section X(A)(13). Add new section (A)(13) to read as follows:
(13) Minimum finish first floor elevation above mean sea level
(MSL) for all new construction, additions and substantial improvements to
~~ existing structures shall be 8.5' (feet)(MSL), 18" (inches) above the crown

Section 3. Section XV, Flood Hazard Areas, is hereby amended by
adding, deleting and/or revising and including the following:
A. Section XV (C)(1)(c). Revise to read as follows:
(c) All new construction and substantial improvements to existing
structures shall be constructed and placed on the building site subject to

including the effects of buoyancy, which may result in damage or

6. Fully enclosed areas below the lowest floor that are subject
to flooding shall be designed to automatically equalize
hydrostatic f]_ood forces on exterior walls by allowing for
the entry and exit of flood waters. Designs for meeting this
requirement must be certified by a Florida Registered Profess-
Tonal Engineer or Architect.

referenced in this Ordinance and the regulations governing are as required
by the Federal Emergency Management Agency National Flood Insurance Program.
The coastal construction zone (entire barrier island within the corporate
limits of the Village of Tequesta) is as referenced in Ordinance No. 347
and the regulations governing are as provided for in the Coastal Construction
Code as required by the State of Florida. In the event of a conflict between
these sections, ordinances or codes and any other sections, ordinances or
codes, as adopted by the Village of Tequesta, the more restrictive require-

(a) All new construction and substantial improvements shall be
located landward of the coastal construction control line.
(b) All new construction and substantial improvements shall be
elevated on pilings or columns so that the bottom of the
lowest horizontal structural member of the lowest floor is
at or above the base flood level.
(c) All new construction and substantial improvements shall be
securely anchored on pilings and/or columns.
(d) Pilings and/or columns used as structural support shall be
designed and anchored to withstand flotation, collapse and
lateral movement due to the effects of wind and water loads
acting simultaneously on all building components.
(e) Compliance with provisions contained in this section shall
be certified to by a professional engineer or architect that
the design and methods of construction are in accordance
with accepted standards for meeting the provisions.
(f) There shall be no fill used as structural support.
(g) There shall be no alteration of sand dunes or mangrove stands
which would increase potential flood damage.
(h) Breakaway walls or frangible walls may be used to enclose the
area below the lowest floor subject to the requirements of
the "Coastal Construction Code". (See Ord. No. 347)
(i) Non-supporting open wood lattice-work, and/or insect screen-
ing intended to collapse under wind and water loads without
causing collapse, displacement, or other structural damage
to the elevated structure or supporting foundation system
may be used to enclose the area below the lowest floor.
(j) Lattice-work and/or insect screening material shall consist
of wood or mesh screening only.
(k) If breakaway walls, frangible walls, lattice-work or insect
screening are utilized, such enclosed space shall not be used
for human habitation.
(1) Prior to construction, plans for any structure that will have
breakaway walls, frangible walls, lattice work or insect
screening shall be submitted to the building official for
approval.

(m) Any alteration, repair, reconstruction or improvement to a
structure shall not enclose the space below the lowest floor
except as provided for in (h) and (i) above.
G, Section XV (K). Add new subsection (K) to read as follows:
(K) Use of available flood data.
(1) The building official shall obtain, review and reasonably
utilize any base flood elevation and floodway data avail-
able from a Federal, State, County, or other source, as
criteria for requiring that new construction, substantial
improvements, or other development in Zone A meet the
requirements as put forth in this Ordinance.
H. Section XV (L). Add new subsection (L) to read as follows:
(L) Elevation certification required.
(1) Tie-in survey and lowest floor elevation (above MSL) are
required of all new construction and substantial improve-
ments to existing structures, prior to erecting walls,
within Zones A, B and C.
(2) Tie-in survey and bottom of lowest structural member of the
lowest floor (above MSL) are required of all new construction
and substantial improvements to existing structures, prior
to erecting walls, within Zones V and V1-30.
Section 4. It is hereby declared to be the intention of the Village
of Tequesta that the sections, paragraphs, sentences, clauses and phrases of
this Ordinance are severable, and if any phrase, clause, sentence, paragraph
or section of this Ordinance shall be declared unconstitutional or otherwise
invalid by the valid judgement or decree of a court of competent jurisdiction,
such unconstitutionality or invalidity shall not affect any of the remaining
phrases, clauses, sentences, paragraphs and sections of this Ordinance.
Section 5. Permission to codify this Ordinance is hereby granted.
Section 6.
