ORDINANCE NO. 345
AN ORDINANCE OF THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, PALM BEACH COUNTY,
FLORIDA, PROVIDING THAT IT SHALL BE UNLAWFUL
FOR ANY PERSON TO DISCHARGE ANY FIREARM
WITHIN THE VILLAGE UNLESS SPECIAL PERMISSION
THEREFOR IS FIRST OBTAINED FROM THE CHIEF
OF POLICE; PROVIDING FOR AN EXEMPTION TO
LAW ENFORCEMENT OFFICERS IN THE DISCHARGE
OF THEIR DUTIES; PROVIDING FOR SEVERABILITY;
PROVIDING FOR CODIFICATION; PROVIDING FOR
AN EFFECTIVE DATE.
BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE
OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, as follows:
Section 1. Except in the lawful defense of person
or property, it shall be unlawful for any person to discharge
any firearm or any weapon or device which discharges as a projectile
within the Village, unless special permission therefor is first
obtained from the Chief of Police. This section shall not apply
to law enforcement officers in the discharge of their duties.
Section 2. If any provision of this Ordinance or
the application thereof is held invalid, such invalidity shall
not affect the other provisions or applications of this Ordinance
which can be given effect without the invalid provisions or
applications and to this end the provisions of this Ordinance
are hereby declared severable.
Section 3. This Ordinance shall be codified and made
a part of the official Code of Ordinances of the Village of
Tequesta.
Section 4. This Ordinance shall take effect immediately
upon its passage and approval, as provided by law.
THE FOREGOING ORDINANCE was offered by Councilmember
Edwin J. Nelson who moved its adoption. The Ordinance

being put to a vote, the vote was as follows:

The Mayor thereupon declared the Ordinance duly passed
and adopted this 24th day of March 1987.
