ORDINANCE NO. 344
AN ORDINANCE OF THE VILLAGE OF TEQUESTA,
AMENDING SECTION 13-13 OF THE CODE OF ORDINANCES
OF THE VILLAGE RELATING TO SOUNDING OF TRAIN
HORNS SO AS TO REFLECT CHANGE IN THE ENABLING
STATUTE; PROVIDING FOR SEVERABILITY; PROVIDING
FOR CODIFICATION; PROVIDING FOR AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE
~OF TEQUESTA, as follows:
Section 1. Section 13-13 of the Code of Ordinances
relating to sounding of train horns is hereby amended to read
has follows:
"Section 13-13. Sounding of train horns,
whistles prohibited, when.
•
It shall be unlawful for a railroad train,
approaching a rail/highway crossing having
train-activated automatic traffic-control
devices, including flashing lights, bells
and crossing gates, to emit an audible warning
signal in advance of said intersection between
the hours of 10:00 p.m. and 6:00 a.m. This
prohibition shall not apply to any such
intersection where the village has failed
to erect traffic signs in accordance with
state law announcing to motorists that railroad
train horns and whistles will not be sounded
during said hours."
Section 2. If any provision of this Ordinance or
the application thereof is held invalid, such invalidity shall
not affect the other provisions or applications of this Ordinance
which can be given effect without the invalid provisions or
applications and to this end the provisions of this Ordinance
,are hereby declared severable.
Section 3. This Ordinance shall be codified and made
a part of the official Code of Ordinances of the Village of
Tequesta.
Section 4. This Ordinance shall take effect immediately
upon its passage and approval, as provided by law.

seconded by Councilmember Edward C. Howell and upon being
put to a vote, the vote was as follows:

The Mayor thereupon declared the Ordinance duly passed
