ORDINANCE NO. 343
• AN ORDINANCE OF THE VILLAGE COUNCIL OF
THE VILLAGE OF TEQUESTA, FLORIDA, PROVIDING
THAT IT SHALL BE UNLAWFUL FOR PERSONS
ii TO SETTLE OR TRESPASS UPON THE PRIVATE
PROPERTY OF ANOTHER AND PARTICULARLY
UPON PUBLIC LANDS WITHIN THE VILLAGE
OF TEQUESTA WITHOUT LEGAL AUTHORITY;
PROVIDING THAT IT SHALL BE UNLAWFUL
FOR ANY PERSON TO SLEEP UPON THE PRIVATE
~ PROPERTY OF ANOTHER PERSON WITHOUT
THE CONSENT OF THE OWNER OF SUCH PROPERTY
AND FURTHER PROVIDING THAT IT SHALL
BE UNLAWFUL FOR ANY PERSON TO SLEEP
ON ANY OF THE STREETS, PUBLIC RIGHTS-OF-
i WAY OR PUBLIC PARKS LOCATED IN THE
VILLAGE OF TEQUESTA; PROVIDING A PENALTY;
~ PROVIDING FOR SEVERABILITY; PROVIDING
FOR CODIFICATION; PROVIDING AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF
TEQUESTA, FLORIDA, as follows:
Section 1. It shall be unlawful for any person to
settle or trespass upon the private property of another and
particularly upon public lands within the Village of Tequesta
without legal authority to do so.
Section 2. It shall be unlawful for any person to

sleep upon the private property of another person located within
the Village of Tequesta, without the consent of the owner of
such property; and being found asleep on such property shall
be prima facie evidence of the want of such consent.
Section 3. It shall be unlawful for any person to
sleep on any of the streets, public rights-of-way, public parks
or any other public properties located within the Village.
Section 4. Any person found guilty of violating the
provisions of this ordinance shall be subject to the general
penalty provision of this Code of Ordinances.
Section 5. If any provision of this ordinance or

the application thereof is held invalid, such invalidity shall
not affect the other provisions or applications of this ordinance
which can be given effect without the invalid provisions or
applications and to this end the provisions of this ordinance
are hereby declared severable.
Section 6. This ordinance shall be codified and made
a part of the official Code of Ordinances of the Village of
Tequesta, Florida.

Section 7. This ordinance shall take effect immediately
upon its passage and approval, as provided by law.
THE FOREGOING ORDINANCE was offered by Councilmember
Ron Mackail who moved its adoption. The ordina~
was seconded by Councilmember Edwin J. Nelson , and
upon being put to a vote, the vote was as follows:

The Mayor thereupon declared the ordinance duly passed
and adopted this 24th day of February 1987.
