HomeMy WebLinkAboutOrdinance_339_10/14/1986r ~ .. • • ORDINANCE NO. 33g AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, PROHIBITING THE PARKING OF ANY MOTOR VEHICLE, BOAT, TRAILER OR MACHINERY UPON THE SWALE AREAS ADJACENT TO TEQUESTA DRIVE WITHIN THE CORPORATE LIMITS OF THE VILLAGE OF TEQUESTA; PROVIDING A PEPdALTY; PROVIDING FOR CODIFICA- TION; PROVIDING FOR SEVERABILITY; PROVIDING AN EFFECTIVE DATE. WHEREAS, studies have been conducted by the Village of Tequesta Police Department as to potential dangers which occur when vehicles are parked in Swale areas adjacent to heavily traveled roads; and WHEREAS, the public safety would be best served by keeping • the swale areas along Tequesta Drive free and clear of parked vehicles so as to avoid additional roadway hazards; NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL r OF THE VILLAGE OF TEQUESTA, FLORIDA, as follows: Section 1. It shall be unlawful to stand, stop or park any motor vehicle, boat, trailer, or machinery upon the Swale areas adjacent to Tequesta Drive within the corporate limits of the Village of Tequesta, Florida. Section 2. The owner of any such vehicle found guilty of violating the provisions of this ordinance shall be subject to the general penalty provision of the Village Code of Ordinances. Section 3. This ordinance shall be codified and made a part of the official Code of Ordinances of the Village of Tequesta, Florida. Section 4. If any provision of this ordinance or the application thereof is held invalid, such invalidity shall not affect the other provisions or applications of this ordinance which can be given effect without the invalid provisions or applica- tions and to this end the provisions of this ordinance are hereby declared severable. Section 5. This ordinance shall take effect immediate-~ • ly upon its passage and approval, as provided by law. THE FOREGOING ORDINANCE was offered by Councilmember Ron Mackail who moved its adoption. The ordinance ~. ' • was seconded by Councilmember Jill K. Gemino being put to a vote, the vote was as follows: FOR ADOPTION Jill K. Gemino and upon AGAINST ADOPTION Edward C. Howell Ron T. Mackail Edwin J. Nelson Carlton D.
