ORDINANCE NO. 337
AN ORDINANCE OF THE VILLAGE OF TEQUESTA,
FLORIDA, ANNEXING A CERTAIN PARCEL OF LAND
TO THE TERRITORIAL LIMITS OF THE VILLAGE
OF TEQUESTA.
WHEREAS, pursuant to Subsection 29 of Section 4.02 of
Article IV of the Charter of the Village of Tequesta and Chapter
171, Florida Statutes, the Village Council may annex any lands
adjoining the territorial boundaries of said municipality and
lying with the "natural boundaries" of said municipality upon
the petition of the owner or owners thereof; and

WHEREAS, Kings Surf, Ltd., the owner of a certain
parcel of land situated in Palm Beach County, Florida, through
its attorney, Wade R. Byrd, has filed a petition with the Village
Council requesting that the land described therein be annexed

to the territorial limits of the Village of Tequesta, Florida;
NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL
OF THE VILLAGE OF TEQUESTA, FLORIDA, as follows:
Section 1. That the parcel of land owned by Kings Surf,
Ltd. and more particularly described as follows:
Government Lot 3, less the South 540 feet
and the North 200 feet thereof, Section 30,
Township 40 South, Range 43 East, Palm
Beach County, Florida, lying East of the
easterly right-of-way line of State Road
No. 5 (U.S. Highway 1), and bounded on
the East by the Intracoastal Waterway;
is hereby annexed and incorporated into the Village of Tequesta,
Florida with the same force and effect as though same had origin-
ally been incorporated into the territorial boundaries thereof.
Said property shall be zoned as follows:
PARCEL ONE

Being a portion of Government Lot 3, less the
South 540 feet and the North 200 feet thereof,
Section 30, Township 40 South, Range 43
East, Palm Beach County, Florida lying East
of the easterly right-of-way line of State Road
No. 5 (U.S. Highway 1), and bounded on the
East by the Intracoastal Waterway, being
more particularly described as follows;
beginning at a point on the easterly right-of-
way line of State Road No. 5 (U.S. Highway No. 1)
and a line 540 feet North of and parallel
to the South line of Government Lot 3, thence
North 3°58'33" East along said right-of-way
line a distance of 25.47 feet to a point
of curvature of a curve concave to the West;

thence Northeasterly, Northerly and Northwesterly
along the arc of said curve, through a central
angle of 15°54'41", having a radius of 1970.08
feet a distance of 547.10 feet; thence South
89°43'05" East on a line 200 feet South
of and parallel to the North line of Government
Lot 3 a distance of 255.12 feet to a point
on the arc of a curve concave to the West,
thence Southeasterly, Southerly and Southwesterly
along the arc of said curve through a central
angle of 14°31'05", having a radius of 2220.08
feet a distance of 562.54 feet to the point
of tangency; thence South 3°58'33" West
a distance of 8.41 feet; thence North 89°55'42"
West along a line 540 feet North of and
parallel to the South line of Government
Lot 3 a distance of 250.58 feet to the point
of beginning.
Containing 3.28 acres more or less.
This parcel which is hereby annexed into the Village

shall be annexed with a zoning classification of C-2, General
Commercial District, with a land use pursuant to the Village
Comprehensive Plan of "commercial".
PARCEL TWO
Government Lot 3, less the South 540 feet and
the North 200 feet thereof, Section 30,
Township 40 South, Range 43 East, Palm Beach
County, Florida lying East of the easterly
right-of-way line of State Road No. 5 (U.S.
Highway 1), and bounded on the East by the
Intracoastal Waterway, less the following
described parcel. Beginning at a point
on the easterly right-of-way line of State
Road No. 5 (U.S. Highway No. 1) and a line
540 feet North of and parallel to the South
line of Government Lot 3, thence North 3°58'33"
East along said right-of-way line a distance
of 25.47 feet to a point of curvature of
a curve concave to the West; thence Northeasterly,
Northerly and Northwesterly along the arc
of said curve, through a central angle of

a distance of 547.10 feet; thence South

Containing 8.00 acres more or less.
This parcel is hereby annexed into the Village of Tequesta
with a zoning classification of R-2, Multiple Family Dwelling

District, with a land use pursuant to the Village Comprehensive
Plan of "medium density (5.5 to 12 Dwelling Units per acre)".
Section 2. The parcels of land herein described
shall be subject to all of the ordinances, regulations and
codes of the Village of Tequesta.

~~ Section 3. That this ordinance shall take effect
upon its approval and passage as provided by law.
~ THE FOREGOING ORDINANCE was offered by Councilmember
~ EDWIN J. NELSON , who moved its adoption. The Ordinance
was seconded by Councilmember RON MACKAIL , and
I' upon being put to a vote, the vote was as follows:
