' ORDINANCE NO 322
AN ORDINANCE OF THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, PALM BEACH COUNTY,
FLORIDA, AMENDING ORDINANCE NO. 319, THE
COMPREHENSIVE ZONING ORDINANCE OF THE
VILLAGE, AT SECTION XVI, UNIFORM WATERWAY
CONTROL, PROVIDING FOR AMENDMENTS AS TO THE
REQUIRED LENGTH AND SQUARE FOOTAGE OF DOCKS
AND PIERS AND FURTHER PROVIDING AN EXEMPTION
FROM THE TERMS OF THE ORDINANCE FOR MOORING
DEVISES SUCH AS BOAT LIFTS, DAVITS AND WHIPS;
PROVIDING FOR SEVERABILITY; PROVIDING FOR
CODIFICATION; PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF
TEQUESTA, FLORIDA, as follows:
Section 1. Section XVI, Uniform Waterway Control, of
Ordinance No. 319, the Comprehensive Zoning Ordinance of the
Village, is hereby amended as follows:
a). Paragraph B, DOCK AND PIER LENGTH, WIDTH AND
CONFIGURATION, is amended to provide that item 1 (a) be amended
from "fifty (50) feet" to "seventy-five (75) feet".
b). Paragraph B, DOCK AND PIER LENGTH, WIDTH AND
CONFIGURATION, is further amended at paragraph 7 thereunder to
read as follows:
"7. The total area of all docks and piers
located on any riparian parcel shall not
exceed Five Hundred (500) square feet for
each One Hundred (100) linear feet of that
parcel shore line."
Section 2. Section XVI of Ordinance No. 319 is further
amended by adding to item B, DOCK AND PIER LENGTH, WIDTH AND
CONFIGURATION, an item 8 to read as follows:
"Mooring devises such as boat lifts, davits
and whips, shall not be considered in
computing the required length, width and
configuration of docks or piers regulated by
this ordinance. Neither shall the
reconstruction, alteration or new
construction of mooring devises such as boat
lifts, davits and whips be considered as
structural alterations for purposes of
determining whether or not said
reconstruction, alterations or new
construction is an extension of a
non-conforming use. However, this exemption
shall not apply to structural alterations
which effect the length, width and
configuration of a dock or pier, exclusive of
the alteration of any mooring devise affixed
or accessory thereto."
Section 3. In the event that any section, subsection,

clause, sentence or provision is held invalid, the remainder of
this Ordinance shall not be affected by such invalidity.
Section 4. Permission to codify this Ordinance is
hereby granted.
Section 5. This Ordinance shall take effect upon
passage and approval as provided by law.
THE FOREGOING ORDINANCE was offered by Councilmember
Thomas J. Little , who moved its adoption. The
Ordinance was seconded by Councilmember Lee M. Brown
and upon being put to a vote, the vote was as follows:

The Mayor thereupon declared the Ordinance duly passed
