ORDINANCE N0. 320
AN ORDINANCE OF THE VILLAGE COUNCILL OF THE VILLAGE
OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AMENDING
SECTION 10-40 OF THE CODE OF ORDINANCES OF THE
VILLAGE; PROVIDING FOR THE CONTROL OF LITTER
WITHIN THE VILLAGE; PROVIDING FOR THE PROHIBITION
OF LITTERING WITHIN THE VILLAGE; ADOPTING THE
FLORIDA LITTER LAW AS PART OF THE MUNICIPAL CODE
OF THE VILLAGE; PROVIDING FOR SEVERABILITY;
PROVIDING FOR CODIFICATION; PROVIDING AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA
FLORIDA:
Section 1. Article III of the Code of Ordinances of the Village
relating to trash on public streets is hereby amended to read as
follows:
Article III. _Littering Prohibited.
Section 10.40. Prohibition.
It shall be unlawful for any person to dump or
cause to be dumped or place or cause to be
placed any litter of any kind whatsoever upon
the public streets within the Village or along
the right-of-way of the public streets within
the Village or upon any public easements or
other public property.
Section 10,41. Florida Litter Law Adopted
The Village of Tequesta hereby adopts the provision
of Section 403.413 of the Florida Statutes which
is known as the Florida Litter Law, including but
not limited to the penalties provided and contained
therein.
Section 2. It is hereby declared to be the intention of the
Village of Tequesta that the sections, paragraphs, sentences,
clauses and phrases of this Ordinance are severable, and if any
phrase, clause, sentence, paragraph or section of this Ordinance
shall be declared unconstitutional or otherwise invalid by the
valid judgment or decree of a court of competent jurisdiction, such
unconstitutionality or invalidity shall not affect any of the .
remaining phrases, clauses, sentences, paragraphs and sections of
this Ordinance.
Section 3. Permission to codify this Ordinance is hereby
granted.
Section 4. This Ordinance shall take effect immediately upon
its adoption..
The foregoing Ordinance was offered by Councilmember Thomas J. Beddow
who moved its adoption. The motion was seconded by Councilmember
Carlton D. Stoddard and upon being put to a vote, the vote was as follow:
