ORDINANCE N0. 312
AN ORDINANCE OF THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, FLORIDA, AMENDING
CHAPTER 25 OF THE OFFICIAL ZONING ORDINANCE
OF THE VILLAGE RELATING TO FLOOD HAZARD
AREAS BY AMENDING SECTION 25.2 TO INCLUDE
DEFINITIONS OF "FLOOR" AND "COASTAL HIGH
HAZARD AREA"; BY AMENDING SECTION 25.3 SO AS

AGENCY SCIENTIFIC AND ENGINEERING REPORT
ENTITLED "FLOOD INSURANCE STUDY - WAVE HEIGHT
ANALYSIS - VILLAGE OF TEQUESTA, FLORIDA";

FOR CONSTRUCTION IN THE "COASTAL HIGH HAZARD
AREA (V-ZONES)"; PROVIDING FOR SEVERABILITY;
PROVIDING FOR CODIFICATION; PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF
TEQUESTA, FLORIDA, as follows:
Chapter 25 of the Official Zoning Ordinance of the
Village is hereby amended as follows:
Section 1. Section 25.2 - Definitions - is hereby amen
ed by adding and including the following:

"A. FLOOR - The top surface of an enclosed
area in a building (including basement) i.e.,
top of slab in concrete construction or top
of wood flooring in wood frame construction.
The term does not include the floor of a
garage used solely for parking vehicles.
B. COASTAL HIGH HAZARD AREA - The area subject
to high velocity waters caused by, but not
limited to, hurricanes, wave wash or tsunamis.
The area is designated on a FIRM as Zone V 1-30."
Section 2. Section 25.3 is hereby amended to read as
"Section 25.3 - FLOOD HAZARD AREAS CREATED -
There are hereby created within the Village
of Tequesta, Florida, Flood Hazard Areas as
shown on Maps No. 120228 0001 C, revised
September 30, 1982 provided by the Federal
Emergency Management Agency and said Maps
are incorporated herein by reference as if
set out here in full and copies thereof
may be viewed in the office of the Village
Manager of this Village."

Section 3. Anew section is hereby provided in Chapter
25 so as to include provisions for COASTAL HIGH HAZARD AREAS (V-
ZONES), to read as follows:
"Section 25.11 - COASTAL HIGH HAZARD AREAS (V-
ZONES) - Located within the areas of special
flood hazard established in Section 25.3
are areas designated as Coastal High Hazard
Areas. These areas have special flood hazards
associated with wave wash, therefore, the
following provisions shall apply:
(a) All buildings or structures shall
be located ~--------~~t~ landward
of the reach of the mean high tide.
(b) All buildings or structures shall
be elevated so that the lowest
supporting member is located no
lower than f ---------f-~et-a3~vv~ the
base flood elevation level, with
all space below the lowest support-
ing member open so as not to impede
the flow of water. Open lattice
work or decorative screening may be
permitted for aesthetic purposes
only and must be designed to wash
away in the event of abnormal wave
action and in accordance with Article
5, Section B(5) (b) .
(c) All buildings or structures shall be
securely anchored on pilings or
columns.
(d) Pilings or columns used as structural
support shall be designed and anchored
so as to withstand all applied loads
of the base flood flow.
(e) Compliance with provisions contained
in paragraph B. C. 8; D. of this section
shall be certified to by a
professional engineer or architect.
(f) There shall be no fill used as
structural support.
(g) There shall be no alteration of
sand dunes or mangrove stands
which would increase potential
flood damage.
(h) Lattice work or decorative screen-
ing shall be allowed below the base
flood elevation provided they are
not part of the structural support
of the building and are designed
so as to breakaway, under abnormally
high tides or wave action, without
damage to the structural integrity
of the building on which they are
to be used and provided the following
design specifications are met:

(1) No solid walls shall be allowed.
(2) Material shall consist of wood or
mesh screening only.
(i) If aesthetic lattice works or screening are
utilized, such enclosed space shall not be
used for human habitation.
(j) Prior to construction, plans for any
structure that will have lattice work or
decorative screening must be submitted to the
Building Official for approval.
(k) Prohibit the placement of mobile homes,
except in an existing mobile home park or
existing mobile home subdivision.
(1) Any alteration, repair, reconstruction or
improvement to a structure shall not
enclose the space below the lowest
floor except for lattice work or decorative
screening, as provided for in paragraph
H and I of this section.
Section 4 Severability - If any section, part of a
section, paragraph, sentence, clause, phrase or word of this
Ordiance is for any reason held or declared to be unconstitutiona]
inoperative or void, such holdings of invalidity shall not affect
the remaining portions of this Ordinance, and it shall be construE
to have been the legislative intent to pass this Ordinance without
such unconstitutional, invalid or inoperative part therein, and tY
remainder of this Ordinance, after the exclusion of such part or
parts, shall be deemed to be held valid as if such part or parts
had not been included therein, or if this Ordinance or any of the
provisions thereof shall be held inapplicable to any person, groin
of persons, property, kind of property, circumstances or set of
circumstances, such holdings shall not affect the applicability
thereof to any other person, property or circumstances.
Section 5. Codification - This Ordinance shall be
codified and made a part of the official Code of Ordinances of
the Village of Tequesta, Florida.
Section 6. Effective Date - This Ordinance shall take
effect immediately upon its passage and approval.

THE FOREGOING ORDINAl`dCE was offered by Councilmember
Thomas J. Little who moved its adoption. The
Ordinance was seconded by Councilmember Lee M. Brown
and upon being put to a vote, the vote was as follows:

The Mayor thereupon declared the Ordinance duly passed
