HomeMy WebLinkAboutOrdinance_308_09/22/1981 • T • ORDINANCE NO. 30$ AN ORDINANCE OF THE VILLAGE OF TEQUESTA, FLORIDA, PROVIDING FOR A CHANGE IN ZONING CLASSIFICATION OF VARIOUS PARCELS OF LAND WITHIN THE VILLAGE OWNED BY THE FLORIDA EAST COAST RAILWAY AND AMENDING THE OFFICIAL VILLAGE ZONING MAP TO CONFORM TO THE AMENDMENTS HEREIN PdADE. WHEREAS, pursuant to Section 163.3167, Florida Statutes, the Village Council adopted a Comprehensive Development Plan, including a Land Use Plan, on July 24, 1979; and WHEREAS, pursuant to Section 163.3201, Florida Statutes, it is necessary for various parcels of land within the Village of Tequesta to be rezoned to conform to the adopted Land Use Plan; NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, as follows: Section 1. That the following described parcels of lane be rezoned from C-2 Wholesale, Commercial and Light Industrial District to C-1 Retail, Commercial District: (a) A parcel of land in Section 30, Township 40 South, Range 43 East, Palm Beach County, Florida, being the southerly 360 feet of that part of the Florida East Coast Railway right- of-way lying north of Tequesta Drive. (b) A parcel of land in Section 30, Township 40 South, Range 43 East, Palm Beach County, Florida, being the north 100 feet of that part of the Florida East Coast Railway right- of-way lying west of the center line of the railroad right-of-way and south of Tequesta Drive. (c) A parcel of land in Section 30, Township 4.0 South, Range 43 East, Palm Beach County, Florida, being the north 350 feet of that part of the Florida East Coast Railway right- of-way lying east of the center line of the railroad right-of-way and south of Tequesta Drive. Section 2. That the following described parcel of land be rezoned from C-2 Wholesale, Commercial and Light Industrial District to R-2 Multiple-family Dwelling District: (a) A parcel of land in Section 30, Township 40 South, Range 43 East, Palm Beach County, Florida, being that part of the Florida East Coast Railway right-of-way lying west of the center line of the railroad right-of-way and .J commencing at a point 360 feet north of the right-of-way of Tequesta Drive northwesterly, east of Cypress Drive, for a distance of approximately 1,510 feet. Section 3. That the following described parcel of land be rezoned from C-2 Wholesale, Commercial and Light Industrial District to R-1 Single-family Dwelling District: (a) A parcel of land in Section 30, Township 40 South, Range 43 East, Palm Beach County, Florida, being that part of the Florida East Coast Railway right-of-way lying west of the center line of the railroad right-of-way commencing at a point 1,870 feet north of the right-of-way of Tequesta Drive northwesterly for a distance of approximately 1,370 feet. Section 4. The Official Zoning Map of the Village of Tequesta, Florida, is hereby amended to incorporate the changes herein made. Section 5. The Code of Ordinances of the Village of Tequesta, Florida, shall be amended to the extent necessary to include the provisions of this Ordinance. Section 6. This Ordinance shall take effect immediately upon its adoption and after public hearing and notice as required by law. THE FOREGOING ORDINANCE was offered by Councilmember Carlton D. Stoddard, who moved its adoption. The Ordinance was seconded by Councilmember Leslie A. Cook and upon being put to a vote, the vote was as follows: FOR ADOPTION Leslie A. Cook AGAINST ADOPTION Thomas J. Little W.H. Mapes, Jr. Carlton D. Stoddard The Mayor thereupon declared the Ordinance duly passed and adopted this 22 day of September , 1981.
