HomeMy WebLinkAboutOrdinance_305_08/11/1981,, ~• ORDINANCE N0. 305 AN ORDINANCE OF THE VILLAGE OF TEQUESTA, FLORIDA AMENDING ARTICLE I, CHAPTER II, LICENSES, OF THE VILLAGE CODE, TO PROVIDE THAT LICENSE APPLICATIONS SHALL BE FILED WITH THE BUILDING OFFICIAL AND PROVIDING THAT UPON PAYMENT OF THE LICENSE TAX, THE VILLAGE SHALL ISSUE A LICENSE SIGNED BY THE VILLAGE BUILDING OFFICIAL OR VILLAGE MANAGER, BY AMENDING ARTICLE I, SECTION 11-17 AND ARTICLE I, SECTION 11-18 OF SAID CODE; PROVIDING FOR SEVER- ABILITY; PROVIDING FOR CODIFICATION; PROVIDING FOR AN EFFECTIVE DATE WHEREAS, all licensing procedures are presently entirely handled by the Village Building Department; and WHEREAS, when the Building Department moves into its new office on or about October 1, 1981 it will be more efficient and proper to consolidate all of the licensing processes within the Building Department; and WHEREAS, the Village Council deems it necessary and appropriate to consolidate such licensing processing within the Building Department; NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA: Section 1 - Article I, Section 11-17 of the Village Code shall be amended to read as follows: Before the Village shall issue a license for engaging in or carrying on any of the businesses, professions, or occupations specified and set forth in this Code, it shall be the duty of the applicant to file an application with the Building Official in the form provided by the Village Building Official. Section 2 - Article I, Section 11-18 of the Village Code shall be amended to read as follows: All licenses shall expire on September 30 of each year. No license sha11 be issued for more than one (1) year. For each license obtained between April 1 and September 30, one-half (1/2) of the fu11 year's tax for one (1) year shall be paid except as otherwise provided for. For each license obtained between January 1 and March 31, three-fourths (3/4) of the full year's tax for one (1) year shall be paid except as otherwise provided for. Upon payment of such tax, the Village shall issue to the person paying it, a license signed by the Building Official or the Village Manager in the absence of the Building Official, which license shall expire at the end of the period for which it is issued, as herein above specified. Every license shall be kept posted in a conspicuous place in the place of business for which it is procured. .~ . j . r Section 3 - In the event any section, subsection, clause, sentence or provision is held invalid, the remainder of this Ordinance shall not be affected by such invalidity. Section 4 - Permission to codify this Ordinance is hereby granted. Section 5 - This Ordinance shall take effect upon its passage and approval as provided by law.
