HomeMy WebLinkAboutOrdinance_291_05/24/1981• • ORDINANCE N0. 291 AN ORDINANCE OF THE VILLAGE OF TEQUESTA, FLORIDA, AMENDING THE OFFICIAL ZONING ORDINANCE OF THE VILLAGE SO AS TO PROVIDE A ZONING CHANGE FOR THE PROPERTY DESCRIBED HEREIN FROM R-2, MULTIPLE FAMILY DWELLING DISTRICT TO C-1, RETAIL COMMERCIAL DISTRICT AND FURTHER AMENDING THE ADOPTED COMPREHENSIVE PLAN OF THE VILLAGE OF TEQUESTA BY PROVIDING A LAND USE CLASSIFICATION CONSISTE~JT WITH THE C-1 RETAIL COMMERCIAL DISTRICT. l~1HEREAS, a petition has been filed with the Village of Tequesta, Florida, to rezone certain property described herein from R-2 Multiple Family Dwelling District; and WHEREAS, the zoning change set forth herein would also require an amendment to the Comprehensive Plan of the Village; and WHEREAS, the Village Council pursuant to Chapter 166.041 of the Florida Statutes and pursuant to Chapter 163.3187 of the Florida Statutes has considered the proposed amendment~to the Zoning Ordinance and to the Land Use Plan of the Comprehensive Plan after duly advertising same and holding public hearings pursuant to law; and. UJHEREAS, the Village Council deems it to be in the best interest of the general welfare of the citizens of the Village of Tequesta to adopt said amendments to the Zoning Ordinance and to the Comprehensive Plan of the Village of Tequesta; NOW THEREFORE, BE IT ORDAIPJED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, AS FOLLOWS: Section 1. The Official Zoning Ordinance and Zoning Map of the Village of Tequesta, Florida, is hereby amended to provide that the following described property is hereby rezoned from R-2 Multiple Family Dwelling District to C-1 Retail Commercial District: Lot 22, Block 2, Jupiter in the Pines, Section "C", according to the plat thereof recorded in Plat Book 26, Page 19, Public Records of Palm Beach County. Section 2. The Comprehensive Plan of the Village of Tequesta, Florida is hereby amended by amending the land use element to provide that the property described herein above be changed from land use of a Multiple Family Dwelling District, medium density, to Retail Commercial District, commercial land use. Section 3. This amendment shall have the same legal status as the original Zoning Ordinance of the Village and the original Comprehensive Plan. Section 4. Permission to codify this ordinance is hereby granted. Section 5. This Ordinance shall take effect immediately upon its adoption and approval. THE FOP.EGOING ORDINANCE was offered by Councilmember Carlton D. Stoddard who moved its adoption. The Ordinance was seconded by Councilmember Leslie A .
