HomeMy WebLinkAboutOrdinance_290_01/13/1981. ~~ • • ORDINANCE N0. 290 AN ORDINANCE OF THE VILLAGE OF TEQUESTA, FLORIDA, AMENDING THE OFFICIAL ZONING ORDINANCE OF THE VILLAGE SO AS TO PROVIDE A ZONING CHANGE FOR THE PROPERTY DESCRIBED HEREIN FROM R-l, SINGLE FAMILY DWELLING DISTRICT TO C-1 P.ETAIL COMMERCIAL DISTRICT AND FURTHER AMENDING THE ADOPTED COI•~PREHENSIVE PLAN OF THE VILLAGE OF TEQUESTA BY PROVIDING A LAND USE CLASSIFICATION CONSISTENT WITH THE C-1 RETAIL COMMERCIAL DISTPICT. WHEREAS, a petition has been filed with the Village of Tequesta, Florida, to rezone certain property described 'nerein from R-1 Single Family Dwelling District to C-1 Retail Commercial District and LJHEREAS, the zoning change set forth herein would also require an amendment to the Comprehensive Plan of the Village; and WHEREAS, the Village Council pursuant to Chapter 166.041 of the Florida Statutes and pursuant to Chapter 163.3187 of the Florida Statutes has considered the proposed amendment to the Zoning Ordinance and to the Land Use Plan of the Comprehensive Plan after duly advertising same and holding, public hearings pursuant to law; and WHEREAS, the Village Council deems it to be in the best interest of the general welfare of the citizens of the Village of Tequesta to adopt said amendments to the Zoning Ordinance and to the Comprehensive Plan of the Village of Tequesta; Pd0jn1 THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, as follows: Section 1. The Official Zoning Ordinance and zoning map of the Village of Tequesta, Florida, is hereby amended to provide that the following described property is hereby rezoned from R-1 Single Family Dwelling District to C-1 Retail Commercial District. Commencing at the south-east (SE) Conner of the north-east quarter (NEl/4) of the south-east quarter (SEl/4) of section 25, thence running north fifteen (15) feet, thence west eight hundred and five (805) feet, thence north one hundred and seventeen feet (117), thence west one hundred feet (100), thence south one hundred and seventeen feet (117), thence east one hundred feet (100) to place of beginning, all being in township 40 south and range 42 east and being a parcel of land 100 feet wide east and west and 117 feet north and south in the south-east quarter (SE1/4) of the said north- east quarter (NEl/4) of the south-east quarter (SE1/4) after streets have been established. ,t • • • Section 2. The Comprehensive Plan of the Village of Tequesta, Florida, is hereby amended by amending the Land Use element to provide that the property described hereinabove be changed from a land use of single family dwelling district, low density to retail commercial district, commercial land use. Section 3. This amendment shall have the same legal status as the original Zoning Ordinance of the Village and the original Comprehensive Plan. Section 4. Permission to codify this Ordinance is hereby granted. Section 5. This Ordinance shall take effect immediately upon its adoption and approval. THE FOREGOING ORDINANCE was offered by Councilmember Thomas J. Little who moved its adoption. The Ordinance was seconded by Councilmember Carlton D. Stoddard and upon being put to a vote, the vote was as follows: FOR ADOPTION AGAINST ADOPTION Leslie A. Cook Thomas J. Little W.H. Mapes, Jr. James H. Ryan Carlton D.
