HomeMy WebLinkAboutOrdinance_287_11/25/1980~" ORDINANCE NO . 2 $'] r AN ORDINANCE OF THE VILLAGE OF TEQUESTA, FLORIDA, AMENDING ORDINANCE N0. 246 RELATING TO THE PROHIBITION OF TRUCK TRAFFIC FROM TRAVELING ON TEQUESTA DRIVE AND COUNTRY CLUB DRIVE WITHIN THE VILLAGE OF TEQUESTA; PROVIDING CERTAIN OTHER RESTRICTIONS ON SAID TRUCK TRAFFIC; PROVIDING FOR EXCEPTIONS; PROVIDING FOR r CODIFICATION; PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, as follows: Section 1. Ordinance No. 246 of the Village of Tequesta is hereby amended at Section 3(a) to read as follows: "Section 3. This Ordinance shall not prohibit: (a) The operation of trucks upon Tequesta-Drive or Country Club Drive where necessary to the conduct of business at a destination point within the Village of Tequesta, provided streets upon which such traffic is permitted are used until reaching the intersection nearest the destination point." Section 2. Section 3 of Ordinance No.-246 is hereby amended by adding an additional paragraph (d) to read as follows: "(d) The operation of trucks providing essential services associated and compatible with the residential nature of the Village of Tequesta including but not limited to trucks engaged in refuse collection, mail and parcel post delivery and pick-up, gas and fuel oil trucks related to residential use, and trucks engaged in routine household deliveries and providing of essential services.- This exemption does not in- clude trucks engaged in activities associated with building construction or land development, said trucks being subject to the terms and prohibitions of this Ordinance. Section 3. Ordinance No. 246 shall remain intact and in full force and effect other than for the amendments herein made. Section 4. That-all ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. Section 5. This amendment shall become a part of the official Code of Ordinances of the Village of Tequesta and is hereby authorized by the Village Council to be codified. Section 6. This Ordinance shall take effect upon. its passage and approval as provided by law. i ~~ TiiE FOREGOING ORDINANCE was offered by Councilmember James H. Ryan who moved its adoption. The Ordinance was seconded by Councilmember Leslie A. Cook and upon being put to a vote, the vote was as follows; .FOR ADOPTIOPd AGAINST ADOPTION Leslie A. Cook W.H. Mapes, Jr. James H.
