HomeMy WebLinkAboutOrdinance_279_03/18/1980r • • ORDINANCE NO. ~~ AN ORDINANCE OF THE VILLAGE OF TEQUESTA, FLORIDA, AMENDING ORDINANCE NO. 134 OF THE VILLAGE, WHICH ORDINANCE ESTABLISHED A SCHEDULE OF WATER RATES FOR THE OPERATION OF THE WATER DISTRIBUTION SYSTEM OF THE VILLAGE, BY PROVIDING THEREFORE AN AMENDMENT TO INCLUDE AN ADDITIONAL CAPITAL IMPROVEMENT CHARGE IN THE AMOUNT OF $855.00 FOR EACH NEW CONNECTION TO THE VILLAGE OF TEQUESTA WATER SYSTEM GN THE AREA WITHIN SAID SYSTEM KNOWN AS JUPITER ISLAND. WHEREAS, the Village of Tequesta, Florida, now owns, operates and maintains a water system and has operated said system since March 1, 1968; and WHEREAS, because of continued and projected growth within the geographic area of the System known as Jupiter Island, it has been determined by the consulting engineers for the water department of the Village of Tequesta that improvements are necessary in the water distribution system to protect and provide for the health, safety and welfare of present and future customers of the water system located on Jupiter Island; and WHEREAS, in order to assist in the financing of the necessary improvements, it is necessary to revise the Capital Improvement Charge of Ordinance 134 as amended by Ordinance 240, to provide that new connections on Jupiter Island pay a propor- tionate share of the amount reasonably necessary to finance the improvements; and WHEREAS, it is the intention of the Village Council that the funds realized by the Village of Tequesta Water Department be designated and earmarked specifically for the purpose of the improve- ments to the water system made for the benefit of the users of the System on Jupiter Island. NOW THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, AS FOLLOWS: • Section 1. Section 2 of Ordinance No. 134, as amended, be amended at Paragraph F (as amended by Ordinances 240 and 252) to include additional language to read as follows: In addition to the capital improvement charge set forth herein, each new connection to the water system located on that geographic area within the System known as Jupiter Island, shall pay a capital improvement charge of $855.00 for each dwelling unit, at the time of the application for a new connection. Such payments shall go into a capital improvement fund, which shall be a separate fund to be used for capital improvements to the water system related to the improvements for the users on Jupiter Island. Section 2. The remaining provisions of said Ordinance No. 134, as amended, shall remain in full force and effect and are hereby ratified and confirmed. Section 3. All Ordinances and Sections thereof in conflict herewith, are hereby repealed. Section 4. This Ordinance shall take effect upon passage and approval as provided by law. The foregoing Ordinance was offered by Council Member James H, Ryan who moved its adoption. The motion was seconded by Council Member Carlton D, Stoddard and upon being put to a vote, the vote was as follows: FOR ADOPTION AGAINST ADOPTION Leslie A, Cook Thomas J.
