HomeMy WebLinkAboutOrdinance_230_10/28/1975 • ORDINANCE NO. 230 AN ORDINANCE OF THE VILLAGE OF TEQUESTA, FLORIDA, PROHIBITING THE DRINKING OF INTOXICATING LIQUORS IN PUBLIC PLACES WITHIN THE VILLAGE OF TEQUESTA; DEFINING PUBLIC WAY; PROVIDING FOR PERMITTTN3 PROCEDURES; PROVIDING A PENALTY FOR VIOLATION OF THE ORDINANCE; PROVIDING FOR THE REPEALING OF ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE VILLAGE COUNCIL OF TEQUESTA, FLORIDA, as follows: Section 1. No person shall drink any spiritous, vinous, malt or other intoxicating liquors or drugs in or upon any street, avenue, alley, park, municipally owned or operated parking lot, or other public way in the Village. Section 2. Public way shall include but not be limited to parking areas or drives of retail and wholesale establishments within the Village which are commonly open to the general public for the purpose of parking and/or driving. Section 3. Any legitimately chartered organization or club wishing to carry on any activity within or on areas described in Section 1 of this Ordinance, which activities would include the consumption of intoxicating liquors, may make application in writing with the Village Manager for a permit allowing same. Said application shall be signed by an officer of the organization or club and shall be filed in the office of the Village Clerk at least seven days prior to the proposed • • activity along with a Resolution of the organization or club giving authorization for the application for said permit. Upon receipt of the application the Village Manager shall, upon a determination being made that the above requirements have been met and that the applicant is a legitimate organization or club, issue a permit authorizing the proposed activity, designa• the place of same, and the time. Said permit shall be valid only for a specified time within a period not to exceed forty- eight hours in succession. Section 4. Any person violating any of the terms and provisions of this Ordinance, shall, upon trial and conviction thereof, be fined not more than Five Hundred Dollars ($500.00) or imprisoned in the Village jail for a period not to exceed ninety (90) days, or by both such fine and imprisonment. Section 5. All Ordinances and sections thereof in conflict herewith are hereby repealed. Section 6. This Ordinance shall take effect immediately upon its passage and approval as provided by law.
