HomeMy WebLinkAboutOrdinance_229_09/09/1975• • ORDINANCE NO. 229 AN ORDINANCE OF THE VILLAGE OF TEQUE5TA, FLORIDA, AMENDING ORDINANCE NO. 211, THE OFFICIAL ZONING ORDINANCE OF THE VILLAGE OF TEQUESTA, BY AMENDING ARTICLE XIII, SECTION 13.3, TO INCLUDE PUBLIC UTILITY STRUCTURES AND BUILDINGS SUCH AS SEW- AGE DISPOSAL WORKS, WATER PUMPING PLANTS, WATER TREATMENT PLANTS, SEWAGE PLANT LIFT STATIONS, ELECTRIC SUBSTATIONS, POLICE AND FIRE STATIONS, AND ANY OTHER USE NORMALLY APPURTENANT THERETO, AS SPECIAL EXCEPTION USES: AND, BY AMENDING AR- TICLE XIV, SECTION 14.3, BY ADDING PARAGRAPH 3 THERETO, TO INCLUDE PUBLIC UTILITY STRUCTURES AND BUILDINGS SUCH AS SEWAGE DISPOSAL WORKS, WATER TREATMENT PLANTS, SEWAGE PLANT LIFT STATIONS, ELECTRIC SUBSTATIONS, POLICE AND FIRE STATIONS AND ANY OTHER USE NORMALLY APPURTENANT THERETO, AS SPECIAL EXCEP- TION USES; PROVIDING FOR REPEALING OF ORDINANCES IN CONFLICT HEREWITH AND PROVIDING FOR AN EFFECTIVE DATE . WHEREAS, the Village of Tequesta, Florida, adopted Ordinance 211, the Official Zoning Ordinance of the Village of Tequesta, Florida, on May 28, 1973; and WHEREAS, said Zoning Ordinance provides that the Village Council may from time to time on its own motion or on petition amend or modify said Ordinance after public hearing and WHEREAS, the Village Council of the Village of Tequesta, Florida, held a Public Hearing on July 22, 1975, to determine if Article XIII, Section 13.3, needed to be revised to provide as special exception uses for public utility structures and buildings, such as, sewage disposal works, water pumping plants, water treatment plants, sewage plant lift stations, electric substations and police and fire stations, and, to determine if Article XIV, Section 14.3, needed to be revised to provide as special exception uses for public utility structures and buildings, such as sewage disposal works, water pumping plants, water treatment plants, sewage plant lift stations, electric substations and police and fire stations, and WHEREAS, the Village Council, after Public Hearing, JOHNSTON SASSER & RANDOLPH 1115 HARVEY BUILDING WEST PALM BEACH, FLA. 33402 has determined that the health, safety and welfare of the resi- dents of the Village of Tequesta, requires that Ordinance No. 211 be amended as set forth herein. NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, AS FOLLOWS: SECTION 1. That Ordinance No. 211, the Official Zoning Ordinance of the Village of Tequesta, Florida, be amended as follows: (a) Article XIII, Section 13.3, shall be amended to read as follows: "Section 13.3. Special Exception Uses: When, after review of the application and public hear- ing thereon, the Village Council finds as a fact that the proposed use or uses are in the public interest, after considering the stand- ards set forth in Article XVI, Section 16.7 of this Ordinance, the Village Council may permit: 1. Structures which exceed three (3) stories or foray (40) feet in height. 2. public utility structures and buildings such as sewage disposal works, water pumping plants, water treatment plants, sewage plant lift stations, electric substations, and police and fire stations, and any other use normally ap- purtenant thereto. (b) There shall be added at Article XIV, Section 14.3 a subparagraph 3 which shall read as follows: "3. SECTION 2. That all Ordinances or parts of Ordinances in conflict herewith, be, and the same are hereby repealed. SECTION 3.
