• ORDINANCE NO. 219 • AN ORDINANCE OF THE VILLAGE OF TEQUESTA, FLORIDA, AMENDING ORDINANCE NO. 207 TO PROVIDE FOR THE ISSUANCE OF A LIMITED NUMBER OF WATER SERVICE CONNECTIONS ACCORDING TO CERTAIN PROCEDURES AND UNDER CERTAIN CONDITIONS. WHEREAS, the Village of Tequesta, Florida passed Ordinance No. 207 on the ,]c)r_h day of April 1973 suspending the issuance of new service connections to its sewer and water system after a certain point, except in certain instances as set forth therein, and providing for the suspension of the issuance of building permits until sewer and water could be provided, and WHEREAS, the developer of the Martin County Little Club, an area now being served by the Tequesta Water System has indicated a desire to remove said development from the Tequesta Water Systems, and WHEREAS, it is the opinion of the Village of Tequesta Water System Consulting Engineers that this removal would make available approximately 126 single family equivalent water service connections, and WHEREAS, it is the desire of the Village Council of the Village of Tequesta, Florida to modify Ordinance No. 207 to provide for the issuance of the above described water service connections in an orderly manner. NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA; SECTION 1. That the water waiting list as amended by red lining, attached hereto and made a part hereof as Exhibit "A", as it may be amended from time to time by additions and deletions is adopted as the official water waiting list of the Village of Tequesta, Florida. • • SECTION 2. That a single family residence with an estimated water usage of 15,750 gallons per month shall be considered as one water service connection for the purposes of this Ordinance. Such connections shall be defined as using a 5/8 inch water meter. For customers requesting larger meters, the following table should be utilized in determining the equivalent number of water service connections required. Meter Size (Inch 5/8 1-- 12 2 3 Equivalent Service Connections 1 3 5 13 20 and up. SECTION 3. That water service connections as defined herein shall be issued after the actual release of the water service con- nections now held by the developer of the Martin County Little Club according to the priority of the applicant on the official water waiting list of the Village of Tequesta according to the following procedure: a) The Village of Tequesta Water Department shall notify the number of applicants on the water waiting list for which it feels water service connections will be available that the applicant has an option to receive a water service connection. Such notice shall contain a plain and clear statement of the terms and conditions under-which such water service connections shall be issued in accordance with this ordinance. All notices by the Village Water Department shall be mailed certi- fied mail, return-receipt requested. b) Upon notification that the applicant does not wish to exercise his option or the end of the option period, whichever first occurs, the name of the applicant not exercising his option shall be moved to the end of the official water waiting list. -2- c) In the event that the applicant desires to exercise his option, he shall notify the Village Water Department in writing within sixty days (60) of his desire to exercise his option and the applicant shall deposit an amount with the Village Water Department equal to the estimated connection charge. The sixty days (60) described in this section shall commence running two days (2) after notice is mailed to the applicant. In the event that the option is never exercised, or in the event that the water service connection is for- feited for any reason, the deposit or water con- nection charge as the case may be shall not be refunded. d) In the event that the applicant posts the re- quired deposit and properly notified the Village Water Department of his intention to exercise his option, he shall have an additional ninety days (90) period, commencing at the end of the sixty day (60) period, to apply for and to receive a building permit from the proper governmental authorities. Water service connections shall only be issued after or in conjunction with a building permit. The applicant's option shall be null and void in the event that the water service connection is not issued because of the failure of the applicant to obtain a building permit and the applicant's name shall be moved to the end of the official water waiting list. e) If a water service connection is issued after or in connection with a building permit, and if the building permit should be revoked or expire for any -3- • reason, then the water service connection shall revert back to the Village Water Department. The connection charge and any monthly service charges paid shall not be refunded. SECTION 4. On non-residential water service connections, including Condominiums, the applicant shall furnish the Village Water Consulting Engineers with their plans and requirements. The Village Water Consulting Engineers will then certify the meter size required. Residential water service connections will be limited to a 5/8 inch meter unless the applicant furnishes sufficient proof to the Village Water Consulting Engineers that a larger meter is required. The watering of lawns will not be a consideration in determining the size of the meter required. SECTION 5. There shall be no new connections of outdoor sprinkler systems to the Village's Water System. Pools will be allowed provided they do not require a larger size water meter. SECTION 6. If the applicant on the Village's water waiting list has transferred his lot, or if the applicant wishes to transfer his lot, he must furnish the Village with proof of the transfer or con- templated transfer and with written authorization to substitute the buyer's name for his name on the water waiting list. No transfers shall be allowed commencing thirty days (30) after the notification that he has an option for a water service connection. No transfers will be allowed from lot to another. SECTION 7. When, and if, it becomes obvious that the applicants notified will not use the entire 126 water service connections available, additional applicants will be notified using the procedure described herein until no further water service connections are available. SECTION 8. If, at any time, the remaining water service con- nections are not sufficient to supply the needs of the next applicant on the official water waiting list, the applicant shall be given an option to obtain the remaining service connections; however, in the event that he does not exercise his option, he shall retain his -4- • priority on the water waiting list. SECTION 9. • The Village Council finds as a matter of fact that an emergency exists necessitating the immediate passage of this Ordinanc The emergency existing is the immediate need of the citizens in the Village of Tequesta, and its water service area, for new water service connections. The Village Council finds that such connections are in the best interest of the health and welfare of all of the citizens of the Village. SECTION 10. If any section, sub-section, sentence, clause or phrase of this Ordinance is held invalid by any Court of Competent Jurisdiction, such section, sub-section, sentence, clause or phrase shall be deemed severable from the remaining portions of this Ordinance and such remaining portions shall not be invalid or otherwise affected thereby. SECTION 11. Ordinance No. 207 and all other Ordinances of the Village of Tequesta, Florida pertaining to the issuance of the water service connections or building permits shall remain in full force and effect except as specifically repealed or modified by this Ordinance. SECTION 12. Any person, firm, partnership, or corporation vio- lating any provisions of this ordinance shall be deemed guilty of a misdemeanor, and shall upon conviction be punished by a fine of not more than five hundred ($500.00) dollars or sixty (60) days in jail or both such fine and imprisonment. Each day of continuing violation shalt be considered a separate offense. SECTION 13. This Ordinance shall take effect immediately upon its passage and approval as provided by law. WHEREAS, on April 10, 1973, the Village of Tequesta passed an emergency ordinance, No. 207, which ordinance suspended the issuance of new service connections to its sewer and water plant after a certain point, except in certain instances, and which provided for the suspension of the issuance of building perm until sewer and water could be provided, and WHEREAS, on February 26, 1974, the Village Council of the Village of Tequesta passed Ordinance No. 219 which amended Ordinance No. 20? to provide for the issuance of a limited number of water service connections according to certain procedures and under certain conditions, and WHEREAS, Ordinance No. 207 was passed because of the increased demand on both the water and sewer system of the Village and the inability of the Village to keep up with said demand, and WIiEREAS, the Village of Tequesta no longer has control or jurisdiction over the sewer system referred to therein, and WHEREAS, it is contemplated that an adequate supply of water shall be available for all persons within the Village of Tequesta water system by July 15, 1977; and WHEREAS, it is the desire of the Village Council of the Village of Tequesta, Florida, to repeal Ordinance No. 207 and Ordinance No. 219. NOW, THEREFORE, BE .IT ORDAINED BY THE VILLAGE COUNCIL OF THL VILLAGE OF' TEQUESTA, FLORIDA: Section 1. Section 2. Ordinance No. 219 of the Village of Tequesta, Florida, entitled, "An Ordinance of the Village of Tequesta, Florida, amending Ordinance No. 207 to provide for the issuance of a limited number of water service connections according to certain procedures and under certain conditions," is hereby repealed. Section 3. All Ordinances and Sections thereof in conflict herewith are hereby repealed. Section 4. This Ordinance shall take effect upon the date certification is received from the Water Department consulting engineer that water service is established between the Village of Tequesta and Tri-Southern Utilities, Inc. The foregoing Ordinance was offered by Council Member Manes who moved its adoption.
