AN ORDINANCE OF THE VILLAGE OF TEQUESTA, FIARIDA AMENDING
ORDINANCE N0. 211, THE OFFICIAL ZONING ORDINANCE OF THE
VILLAGE OF TEQUESTA, TO AMEND ARTICLE XIII, SECTION 13.4
(1) AND ARTICLE XIV, SECTION 14,4 (1) TO PROVIDE AN
EXCEPTION FOR CHARITABLE ORGANIZATIONS AND NON-PROFIT
CORPORATIONS FROM THE REQUIRE[~iT THAT ALL BUSINESSES
AND SERVICING SHALL BE CONDUCTED SOLELY WITHIN A COMPLETELY
ENCLOSED BUILDING.
WHEREAS, the Village of Tequesta, Florida, adopted
Ordinance 211, the Official Zoning Ordinance of the Village of Tequesta,
Florida on May 28, 1973; and
WHEREAS, it came to the attention of the Village Council
of the Village of Tequesta, Florida, that certain provisions of the
Ordinance might be in need of revision; and
WHEREAS, the Village Council of the Village of Tequesta,
Florida, held a public hearing on Thursday, January 3, 1974, to determine
if Article XIII, Section 13.4 (1) and Article XIV, Section 14.4 (1)
needed to be revised to provide an exception to charitable organizations
or non-profit corporations from the provision that all businesses and
servicing should be conducted wholly within a completely enclosed
building; and
WHEREAS, the Village Council after public hearing has
determined that the best interest of the Village of Tequesta regaire
certain provisions in Ordinance Number 211 to be amended.
NOW, THEREFORE, i~ IT ORDAINED BY THE VILLAGE COUNCIL OF
TME VILLAGE OF TEQUESTA, FLORIDA, as follows:
SECTION 1. That Ordinance Nwgber 211, the Official Ztfning
Ordinance of the Village of Tequesta, Florida, be amended ~s follows:.,
(a) There shall be added to the end of they e~isti~g
Arti~~e XIII, Section 13.4 (1) the ~~~ ~ ~ ~~lan~~~.

corporation may upon application to tie ~:ln ~;~er
be granted a permit to conduct tempor~:ry business outd+bmrs.
Any organization or corporation seeking such a permit shall
first submit to the Village Manager a sworn statement
showing:

(1) The name of the organization or corporation sponsoring
the business.
(2) What purpose the proceeds of said business are to be
used for.
(3) The amount of commission, if any, that shall be paid
by such organization or corporation to the person
conducting said business.
(4) Length of time which the business shall extend.
(5) The names of persons directing the business.
The Village Manager may thereupon at his discretion grant
or reject said application; withhold action on any appli-
cation pending investigation; or sulynit the application
to the Village Council for its approval".
(b) There .shall be added to the end of the exi.sti.ng
Article ZIV, Section 14.4 (1) the following language.
"However, a charitable organization or a non profit
corporation may upon application to the Village Manager be
granted a permit to donduct temporary business outdoors.
Any organization or corporation seeking such a permit shall
first submit to the Village Manager a sworn statement
showing
(1) The name of the organization or corporation sponsoring
the business.
(2) What purpose the proceeds of said business are to be
used for.
(3) The amount of commission, if any, that shall be paid
by such organization or corporation to the person
conducting said business.
(4) Length of time which the business shall extend.
(5) The names of persons directing the business.
The Village Manager may thereupon .at his discretion grant
or reject said application; withhold action on any app]i-
cation pending investigation; or submit the application
to the Village Council for its approval".
SECTION 2. That all ordinances of parts of ordinances in
conflict be, and the same are hereby repealed.
SECTION 3. That this Ordinance shall take effect upon its
passage and approval as provided by law.
