ORDINANCE N0. 216
AN ORDINANCE OF THE VILLAGE OF TEQUESTA,
FLORIDA, ANNEXING A CERTAIN PARCEL OF
LAND TO THE TERRITORIAL LIl~TS OF THE
VILLAGE OF TEQUESTA AND ZONING IT R-2
Ak'TER PUBLIC HEARING.
tJHEREAS, Sub-section 29 of Section 4.02 of Article IV of
the Charter of the Village of Tequesta grants the Village Council the
power to annex any lands adjoining or within three (3) miles of the
territorial boundaries of said municipality upon petition of the owner
or owners thereof; and
~JfU±REAS, Article VI, Section 4 of the Official Zoning
Ordinance of the Village of Tequesta, Florida, provides that land will
be annexed as R-lA, single family dwelling district, unless, after
public hearing, the Village Council should otherwise provide; and
jJHEREAS, Karl A. Kandell Associates, Inc., the owner of a
certain parcel of land situate in Palm Beach County, Florida, has filed
a petition dated August 13, 1973, with the Village Council requesting that
the land described therein be annexed to the territorial limits of the
Village of Tequesta, Florida; under the R-2 zoning classification; and
SAS, the Village Council held a public hearing on said
petition at 7:30 P.M., Friday, November 30, 1973, after having duly
published notice of the hearing.
NOW, THEREFORE BE IT ORDAINED BY THE VILLAGE COUNCIL OF
~ ~ THE VILLAGE OF TEQUESTA, FLORIDA:
SECTION 1: That the parcel of land hereinabove mentioned
and more particularly described as follows:
A Parcel of land in the Southwest one quarter of the
Northeast one quarter (SW~,NE ~) of Section 2S, Township
40 South, Range 42 East, Palm Beach County, Florida,
being more particularly described as follows:
Begin at the Southeast corner of said Southwest one quarter
of the Northeast one quarter (StJ4iNE 4); thence South
89°4646" West, a distance of 514.15 feet to the POINT OF
BEGINNING; thence South 89°4646" West, a distance of
88.85 feet to the Easterly right of way of Riverside Drive;
thence North 6°09'20" East along said Easterly right of way,
a distance of 119.74 feet; thence North 89°4646" East, a
distance of 75.17 feet; thence South, a distance of 119.00
feet to the POINT OF BEGINNING,

That part of the South 147.60 feet of the Southwest quarter
of the Northeast quarter of Section 25, Township 40 South,
Range 42 East, lying West of Riverside Drive; less the
West 30 feet thereof;
Together with the following described parcel:
From the point of intersection of the Westerly right of
way line of Riverside Drive with the South line of the
Southwest quarter of the Northeast quarter of Section 25,
Township 40 South, Range 43 East, Palm Beach County,
Florida, run Northeasterly, along the said Westerly right
of way line, a distance of 148.58 feet to the POINT OF
BEGINNING; thence continue Northeasterly, along said
Westerly right of way line a distance of 115.75 feet; thence
Westerly turning an angle of 83°24'50" as measured from
South to West from the preceding course, along a line that
is 262.59 feet Northerly of and parallel to the-South line
of the said Southwest quarter of the Northeast quarter a
distance of 436.65 feet; thence Southerly turning an angle
of 89°52'06" feet; as measured from East;to South from the
preceding course, a distance of 114.99 feet to a point of
intersection with a line that is 147.6 feet Northerly of
and parallel to the South Iine of the said Southwest quarter
of the Northeast quarter; thence, Easterly along said
parallel line a distance of 423.11 feet to the POINT OF
BEGINNING.
Containing 1 acre, more or less.
Together also with the following described parcel:
From the point of intersection of the Westerly right of way
line of Riverside Drive with the South line of the Southwest
quarter of the Northeast quarter of Section 25, Township 40
South, Range 43 East, Palm Beach County, Florida, i°txn
Northeasterly along said Westerly right of way line a
distance of 264.33 feet to the POINT OF BEGINNING; thence,
North 89°55'30" West, along a line that is 262.59 feet
Northerly of and parallel to the .South line of the said
Southwest quarter of the Northeast quarter, a distance of
436.65 feet to a point; thence Northerly, turning an angle
of 90°07'54" as measured from East to North from the preced-
ing course, a distance of 114.99 feet, thence Easterly, at
right angles to the preceding course, a distance of 447.81
feet to a point in the Westerly right of i,-ay line of said
Riverside Drive; thence Southerly, along said Westerly
right of way line, being a curve concave to the West, having
a radius of 363.33 feet a distance of 42.60 feet to the
Point of Tangency; thence continue Southerly, along said
Westerly right of way line, a distance of 74.0 feet to the
POINT OF BEGINNING.
Containing 1 acre, more or less.
is hereby annexed and incorporated into the Village of Tequesta, with
the same force and effect as though the same had originally been
incorporated into the territorial boundaries thereof.
SECTION 2: That the land described in Section 1 of this
Ordinance is hereby zoned R-2, multiple family dwelling district, and
the Zoning Ordinance of the Village of Tequesta, being Ordinance
Number 211, and the zoning map thereunder, be, and the same are hereby
amended with regard. to the above described property.

SECTION 3: That all ordinances or parts of ordinances in
conflict be, and the same are hereby, repealed.
SECTION 4: That this Ordinance shall take effect upon its
passage and approval, as provided by law.
