• • ORDINANCE NO. 20? AN ORDINANCE OF THE VILLAGE OF' TEQUESTA, FLORIDA, SUSPENDING THE ISSUANCE OF NEW SERVICE CONNECTIONS TO ITS SEWER AND WATER PLANT AFTER A CERTAIN POINT, EXCEPT IN CERTAIN INSTANCES AS HEREINAFTER SET FORTH; AND PROVIDING FOR THE SUSPENSION OF THE ISSUANCE OF BUILDING PERMITS UNTIL SEWER AND WATER CAN BE PROVIDED. WHEREAS, the Village of Tequesta, Florida, has experienced a perit~d of rapid growth, and WHEREAS, the water and sewage systems servicing the Village of Tequesta and in some cases, the surrounding areas are ouvned by said Village, and WHEREAS, the demands placed upon the Village of Tequesta's water system have increased greatly over a short period of time; for example, in 196;9 the system pumped 327, 000, 000 gallons of water, and in 1972 the system was pumping; 605, 000, 00 gallons of water, and WHEREAS, the Village's water department consulting engineers havd receomended that there be no further new service connections in the area served by the Tequesta water system until additional capacity is provided because the system's capacity has been or is rapidly being reached, and WHEREAS, the demands placed upon the Village's sewer system have grown rapidly in a short period of time; for example, based upon the advice of the Village of Tequesta's sewer department consultant engineer and Mr. William Becker of the Palm Beach County Health Department, the Village Council deter- mined on August 22, 1972 that approxirra tety 40, 000 gallons per day plant capacity remained over and above existing commitments, and WHEREAS, the Village of Tequesta's sewer consulting engineer now advises that only 41. 5 sewer connections remain over and above existing com- mitments. l~'C7W, THEREFORE, THE VILLAGE C4U~CIL OF ~~f VILLAa~! ~F TEQUESTA, FLORIDA, ORDAINS AS FOLLOWS: • • SECTION 1. Effective April !%C%`, 1973, the Village of Tequesta water system shall. allow no further new service connections except that this Ordinance shall not apply to structures or additions to existing structures erected by any ~• governmental body for police, fire and health purposes, public and private hos- pital buildings, public schools and churches, additions and accessory buiddings necessary and incidental. thereto. SECTION 2. That after the remaining 41.5 sewer connections have been granted, that no further new service connections be permitted except as follows: a) For structures or additions ,to existing structures erected by any governmental body far police, fire and health purposes, public and private hospital bui`l'dings, public schools and churches, additions and accessory buildings necessary and incidental thereto. ' b} This Ordinance shall not apply to new sewer cdn-. nections approved prior to the date of its passage. c) This Ordinance shall not apply to the 41. 5 new sewer connections remaining upon the passing of this Ordinance. SECTION 3. The building official of the Village of Tequesta, F'loriaa, shall cease to issue any building permits for the construction of any building or structure which would require a new service connection to either the Village's• sewer or water system unless the new service connections are available pursuant to exceptions listed above. This Section shall not apply to the construction of additions to existing building structures where such additions are not designed so as to increase the demand on either the Village's sewer or water system. SECTION 4. The Village Council finds that an emergency condition !. exists necessitating the immediate passage of this Ordinance. If any section, subsection, sentence, clause or phrase of this Ordinance is held invalid by any court of competent jurisdiction, such section, subsection, sentence, clause or phrase shall be deemed severable from the remaining protions of this Ordinance and such remaining portions shall hot be invalid or otherwise effected thereby. SECTION 6. All ordinances and sections thereof in conflict herewith are hereby repealed. SECTION 7.
