ORDINANCE NO. 201
An Ordinance of the Village of Tequesta,
Florida, repealing Ordinance Number 112
and levying an occupational license tax
upon each and every business, profession
and occupation engaged in or carried on,
wholly or in part, within the corporate
limits of the Village pursuant to the
laws of the State of Florida; providing
regulations for the collection of such
license tax including penalties; and for
other purposes.
BE IT ORDAINED BY THE VILLAGE CO UNCIL OF THE VILLAGE OF TEQUESTA,
FLORIDA AS FOLLOWS:
SECTION 1. A tax is hereby imposed by the Village upon each and
every business, profession and occupation engaged in or carried on, either
wholly or in part, within the corporate limits of the Village in the re-
spective amounts hereinafter set forth; and every person engaging in,
carrying on, managing or practicing any business, profession, or occupation,
either wholly or in part, within the corporate limits of the Village is
hereby required to pay to the Village a tax in the amount designated. The
amount of such tax specified shall be on the basis of one year.
SECTION 2. Before the Village shall be required to issue a license
for engaging in or carrying on any of the businesses, professions or occu-
pations specified and set forth herein, it shall be the duty of the appli-
cant to file an application with the Village Clerk, such application to
be in the form provided by the Village Clerk.
SECTION 3, All licenses shall expire on the 31st day of September
of each year. No license shall be issued for more than one year. For
each license obtained between April 1 and September 30, one-half of the
full year's tax for one year shall be paid except as otherwise provided
for. For each license obtained between December 31 and February 28, three-
fourths of the full year's tax for one year shall be paid except as other-
wise provided for. Holders of occupational licenses for the year that
commenced January 1, 197 and was to originally expire December 31, 1972,

shall receive a credit of one-fourth of such fee towards the occupaitonal
license fee which shall be applied for commencing October 1, 1972 and ex-
Airing September 30, 197; such credit shall be granted only to current
occupational license holders who shall renew such license during the month
of September, 1972. Upon payment of such tax, the Village shall issue to
the person paying the same a license signed by an official of the Village,
which license shall expire at the end of the period for which such li-
cense is issued, as hereinabove specified. Every license must be kept
posted in a conspicious place in the place of business for which it was
procured.
SECTION ~. Whenever the amount of the license applied for de-
pends upon the amount of stock in trade carried by the applicant or the
number of rooms in a hotel or rooming house, or the number of employees,
or on any other facts not within the personal knowledge of the Village
Clerk, no license shall be issued until the applicant therefor has made
and filed with the Village Clerk an affidavit; duly authenticated, setting
forth the amount of his stock in trade, number of rooms in his hotel or
rooming house, or other facts upon which the amount of such license de-
pends.
SECTION 5. All licenses may be transferred to a new owner
when there is a bona fide sale of the business upon payment of a trans-
fer fee of $3.00 and presentation of evidence of the sale and the origi-

cense, any license may be transferred from one location to another lo-
cation in the Village upon payment of a transfer fee of $3.00.
SECTION 6. No license issued under the provisions of this Ordi-
Hance shall protect any person from prosecution for transacting any busi=
Hess, trade or profession not covered by such license, or shall protect
any merchant doing business with a greater stock in trade than covered
by such license, or any hotel keeper or rooming house keeper having a
greater number of rooms than is covered by such license. Any license
issued upon any false statement made under oath shall be considered as

void ab initio and shall not protect the holder thereof from prosecution
for transacting business without a license.
SECTION 7. Where the principal, master or employer has complied
with the provisions of this ordinance, it shall be unnecessary for his
agent, servant or employee to comply herewith, unless otherwise expressly
provided for herein; provided, however, that in the event such principal;
master or employer shall not have complied with this ordinance, each of
his agents, servants or employees shall be subject to prosecution, and
upon conviction, to fine or imprisonment to the same extent as his princi-
pal, master or employer.
SECTION 8. Any license hereafter issued by the Village may be
temporarily suspended or absolutely revoked or cancelled by a majority
vote. of the Village Council, when such Council shall have ascertained and
determined, in the exercise of its sound discretion, that such action will
promote the public peace health, safety, welfare, harmony or good order of
the neighborhood in which the licensee's place of business is located; pro-
vided, however, that in the case of the revocation and cancellation of such
license, the Village shall refund to such licensee the pro rata unearned or
unused portion of his license, provided, further, that no refund shall be made
where the license is temporarily suspended.
SECTION 9. Disabled veterans of World War I, World War II, Spanish
war and the Korean War, all confirmed cripples, deaf and dumb persons and
invalids physically incapable of manual labor, widows with minor dependents
and persons sixty-five years of age, or older, shall be allowed the same
exceptions as such persons are now or shall hereafter be entitiled to by
law in connection with state and county licenses.
SECTION 10. It shall be unlawful for any person to engage in any
trade, business, profession, or occupation within the Village without a
license or upon a license issued upon false statements made by any person,
or in his behalf. All licenses shall be sold by the Village tax collector
beginning September 1st of each year and shall be due and payable on Octo-

ber 1st of each year and shall expire on September 30th of the succeeding
year. Licenses not renewed by October 1st shall be considered delinquent
and shall be subject to a delinquency penalty of ten per cent for the
month of October plus an additional five per cent penalty for each month
of the delinquency thereafter until paid; provided, however, that the
total delinquency penalty shall not exceed twenty-five per cent of the
occupational license fee for the delinquent establishment. Any person
engaging in or managing any business, occupation or profession without
first obtaining a local occupational license if required hereunder shall
be subject to a penalty of twenty-five per cent of the license determined
to be due in addition to any other penalty provided by law or ordinance.
SECTION 11. The occupational license taxes set forth in this
Ordinance shall be levied only on the following:
(A) Any person who maintains a permanent
business location or branch office within
said Municipality for the privilege of en-
gaging in or managing;bny business within
its jurisdiction; and
(B) Any person who maintains a permanent
business location or branch office within
said Municipality for the privilege of en-
gaging in or managing any profession or
occupation within its jurisdiction; and
(C) Any person who does not qualify under
the provisions of (A) or (B) above and who
transacts any business or engages in any
occupation or profession in interstate com-
merce where such license tax is not prohibi-
ted by Section 8 of Article 1 of the United
States Constitution.
The fact that any person represents himself as being engaged in
any business, occupation or profession for which a license is required for
the transaction of business or the practice of such profession, shall be
evidence of the liability of such person to pay a license tax, regardless
of whether such person actually transacted any business or practices a
profession. The burden shall be on the person representing himself as
being engaged in any business, occupation or profession within the Village
for which an occupational license is required, to rebut the presumption

that he is required to hav a an occupational license issued by the Village
of Tequesta. Displaying a sign or advertisement indicating the conduct
of a business or profession within the Village of Tequesta in the classi-
fied section of the telephone directory or city directory or other media
shall be evidence that such person is holding himself out to the public
as being engaged in a business or profession requiring a license under
this ordinance.
For the purpose of this section, any person shall be deemed to
be in business or engaging in nonprofit enterprise, and thus be subject
to the requirements of this ordinance when he does one act of:
(A) Selling any goods or service.
(B) Soliciti~sg business or offering goods or
services for sale or for hire.
The agents or other representative of nonresidents who are
doing business in this Village shall be personally responsible for the
compliance of their principals and of the business they represent with
this ordinance.
Vehicles used by any person licensed under State law for the
sale and delivery of tangible personal property at either wholesale or
retail from his place of business at which a license is paid shall not
be construed to be separate places of business and no license may be
levied on such vehicles or the operators thereof as salesmen or otherwise,
anything else in this ordinance notwithstanding.
SECTION 12. The amount which shall be paid by the several firms,
persons or associations engaging in or managing businesses, professions
or occupations for which a license is required are hereby fixed as follows:

Every person selling, leasing, renting, distributing, operating or
placing for operation any machine as described below:
Amusement machines (hereby defined as machines
or devices, not gambling devices, which are
playedz or operated for amusement or score
and not for vending merchandise or rendering
service, and whether or not a charge is made
for play. Example: Marble Boards.)

hereunder:
(A) Machines vending cigarettes, postage
stamps, drinking cups, or unadulterated
Florida produced citrus juice; and
(B) Parcel checking lockers and toilet locks
used in hotels and restaurants.
(2) No license shall be required for any of the
machines listed above,. where the entire proceeds
of such machine is used for recognized charitable
or benevolent purposes.
(3) Coin operated machines for amusement or trade or
service purposes not herein specifically classified
shall pay such tax as shall be determined from time
to time by the Tax Collector, on a basis compara-
tive with other coin operated or vending machines.

ORDINANCE NO. 214
An Ordinance of the Village of Tequesta, Florida, amending
Ordinance Number 201 to provide a penalty for its violation.
WHEREAS, Ordinance Number 201 of the Village of Tequesta, Florida,
levying an occuptional license tax upon each and every business, profession and
occupation engaged in or carried on, wholly or in part, within the corporate limits
of the Village pursuant to the laws of the State of Florida does not contain a pro-
vision for the penalty in the event of its violation; and
WHEREAS, the Village Council of the Village of Tequesta desires that
such a penalty provision be included.
NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF
THE VILLAGE OF TEQUESTA, FLORIDA, as follows:
SECTION 1. A Section 15 shall be added to Ordinance Number 201 and
shall provide "that any person, firm, partnership, or corporation violating any ,
provisions of this ordinance shalt be deemed guilty of a misdemeanor, and shall
upon conviction be punished by a fine of not more than five hundred ($500. 00) dollars
or sixty (60) days in jail or both such fine and impri sonment. Each day of continuing
violation shall be considered a separate offense.
SECTION 2. That this Ordinance shall take effect upon its passage and
approval as provided by law.
