Harding ,- Community Developmentt°D"rector CAH/mk Encl. __ NOTICE OF ZONING CHANGE_ The Village of Tequesta proposes to adopt the following Ordinance: Ordinance 12-09 AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, PROVIDING FOR THE REZONING OF CERTAIN REAL PROPERTY WITHIN THE CORPORATE LIMITS OF THE VILLAGE OF TEQUESTA, FLORIDA; WHICH PROPERTY CONSISTS OF EIGHT 8.0± ACRES, MORE OR LESS OF LAND RECENTLY ANNEXED INTO THE VILLAGE LOCATED AT 4534 AND 4546 COUNTY LINE ROAD, INFORMALLY KNOWN AS THE "A PORTION OF THE OLD ROOD LANDSCAPING SITE"; PROVIDING THAT THIS REAL PROPERTY WHICH IS MORE SPECIFICALLY DESCRIBED HEREIN SHALL BE ASSIGNED THE VILLAGE ZONING DESIGNATION OF "R2 -MULTIPLE FAMILY DWELLING DISTRICT"; PROVIDING THAT THE ZONING MAP OF THE VILLAGE OF TEQUESTA BE AMENDED TO REFLECT THE PROPER DESIGNATION FOR THIS REAL PROPERTY; PROVIDING A CONFLICTS CLAUSE AND A SEVERABILITY CLAUSE; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. A Public Hearing and Second and Final Reading of Ordinance 12-09 rezoning the properties referenced above will be held by the Village Council on Thursday, August 13, 2009 which is scheduled to commence at 7:00 p.m. or as soon thereafter as these items can be heard and continuing from time to time and place to place at the Village Council Chambers located at 345 Tequesta Drive, Tequesta, Florida. Copies of Ordinance 12-09 can be inspected and copied in the office of the Village Clerk in the Village Hall, Monday through Friday, from 8:30 a.m. to 5:00 p.m. If a person decides to appeal any decision made by the Village Council with respect to any matter considered at this meeting or hearing, he or she will need to insure that a verbatim record of the proceedings is made, which record should include the testimony and evidence from which the appeal is to be based. The Village of Tequesta does not provide such a record. The locations of the subject properties are shown on the maps below: (See Attached) PUBLISH: August 2, 2009 Advertisement must be two columns wide by 10" long in a standard size or tabloid size newspaper; headline in the advertisement shall be in type no smaller than 18 point. WHEREAS, after duly noticed public hearings, held pursuant to Florida Statutes, the Village Council does hereby find, determine and declare that the public health, safety and general welfare of the citizens of the Village of Tequesta are best served by assigning that real property described hereinbelow, located within the Village, the zoning designation of "R2 -Multiple Family Dwelling Dis#rict". NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, THAT: Section 1: That certain real property recently annexed into the corporate limits of the Village of Tequesta consisting of a total of two (2) parcels of property comprising a total of approximately 8.0`d acres, more or less, informally known as the Portion of the Old Rood Landscaping site, is hereby zoned "R2 -Multiple Family Dwelling District, and is legally described as follows: (See Exhibit 1 attached hereto for legal description- PCN # 60-42-40-25-00-000-1080 and 60-42-40-25-00-001-0030) Section 2: The Village Zoning Map is hereby amended to conform to this Ordinance, and the appropriate officials of the Village are instructed to make the necessary changes to the official Village Zoning Map. ection 3: Ail Ordinances or parts of Ordinances in conflict be and the same are hereby repealed. Section 4: Should any section or provision of this Ordinance or any portion thereof, any paragraph, sentence or word be declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder of this Ordinance.
