We are now Franchisees for the Games2U business in the local area. The van that you observed is a mobile game theater that travels to local events, birthday parties and other community events. The van lives in the Public Storage facility when not in use. It does not reside at our residence. Due to the nature of the business, we do drive it to the house from time to time for a multitude of reasons. Most of the time I am simply coming home for lunch while I am out in the van. Additionally, we have had several parties at our home allowing the local kids to come and play in the van. As for the trailer you observed, I have no idea which one you are referring to. We own a small trailer that is kept at the side of the house. You mentioned a large trailer which we do not own. The only thing I can think may have been here is the landscaping trailer which takes care of the yard. Additionally, our Games2U van was not at our home on the day you referred to. You may have seen it on another day. On another topic, I have a permit at the village office ready to pay for. It is for the fence and gate that you cited for no permit. Since the citation, I have combed through the village code for a reference to the requirement to permit. The section you referred to states the requirements for fence construction. (i.e. height, location, etc.) There is no mention (that I can find) an owner must apply for a permit in order to build one. In another section it states the penalty for not applying for a permit to be double the permit fee. Again, I cannot find reference to the specific requirement to apply for a permit to build a fence. I can only fmd how one must be constructed. Since I am being penalized for not applying for the permit I believe the proper code section and page should be on the violation. I believe you are simply responding to select neighbor complaints. While I believe in code compliance to enhance the neighborhood appearance, I feel I have been unfairly singled out by your office. I have one of the most attractive homes in the neighborhood and plan to keep it that way. I do not need a city code to motivate me. I do believe that certain people in the Country Club believe they live in a Home Owners Association and use your office as the HOA complaint department. These people need to be reminded that they reside on public property and not a HOA. There are many neighborhoods in the area they can reside in if they wish to live this way. As for our neighborhood, most of us bought in here specifically for the lack of HOA involvement. Please contact me with the proper code information so I can continue with my permit process. The Village Manager has asked me to provide a response. While the Village certainly empathizes with you regarding the recent auto accident which demolished your prior mailbox, that fact does not change the Village Code which prohibits structures from being placed in the right-of--way. The term "right-of--way" is defined in the Zoning Code and specifically states that title to such land remains with the public entity; thus, no building permit could be issued for anyone other than the Village to place a structure on this land. Simple mailboxes such as those of your next door neighbors are not deemed to be structures and are exempt from requiring a permit. The Village will not be installing a barrier in the area nor reimbursing you for your clean- up time; however; it is my understanding that the Village Code Compliance Officer has been quite helpful to the point of assisting you in correcting the problem.. Additionally, the Village has agreed to remove the existing concrete slab and sod the area left bare after *he re:::eval. Fairway E makes a hard left turn onto Fairway N when exiting the neighborhood. This is where an unknown vehicle overshot the turn. The mailbox they impacted was constructed of block concrete on a concrete foundation, covered with brick and mortar. The structure was tossed as far as 15 feet into my driveway, breaking into many pieces. The police did not estimate the speed of the vehicle but one can deduct that it was excessive. Had people been in the way, or the mailbox not slowed the vehicles progress, a much different outcome could have taken place. The vehicle fled the scene and has not been found. I cleaned up the mess and began the task of replacing the mailbox. I did not want to install a standard pole and box for two reasons. First, the standard mailbox on a pole, in my opinion, is the single most item that detracts from the appearance of our neighborhoods. Unfortunately, Tequesta is inundated with them. Secondly, I believe in this case, my previous mailbox prevented serious damage to my personal vehicle. If my family was outside it may have prevented their injury or even death by slowing the vehicle. I began building a replacement similar to the previous mailbox. This one would have matched the house colors as well as incorporating planters for esthetics. Enclosed is a drawing of what it would have looked like. After constructing the block, I received a visit from code enforcement instructing me that the mailbox would have to be torn down immediately. It seems the writers of city code are more concerned with the liability of someone wrapping their vehicle around my mailbox than they are concerned with the victims whose home and property they drive through. Additionally, giving homeowners the ability to beautify their neighborhoods is denied because of their fear of legal action. This seems ridiculous considering it would be brought on by someone who is either intoxicated, speeding, or for some other reason can't drive 20 mph without leaving the roadway. This is a fear that HOA's throughout Florida seem to accept since they have concrete mailboxes throughout their neighborhoods. Never the less, I have a safety problem with regard to the location of my property in relation to the intersection of Fairway E. and Fairway N. With the collision into my mailbox and your concern of future collisions with the new structure, I believe a barrier needs to be constructed to safeguard my family as well as your desire to safeguard the drunk who can't stay on the road. I attempted to achieve this with the new mailbox, but your department made me destroy it. If your legal counsel is concerned with the Liability of my mailbox, then they should be equally concerned with the liability of someone driving into my property and injuring a member of my family. I request that the Village of Tequesta, with the urgency they required of me with the removal of my mailbox, constrict a barrier that is esthetically pleasing and will provide protection to my properly and family should someone over- shoot the turn again. This would need to be accomplished as soon as possible as up to one hundred vehicles make this turn daily. Additionally, as you have made it clear, the first mailbox was on city property. It was not constructed by me and apparently was not permitted. Therefore, I don't believe the responsibility for cleaning up the area is mine. I request the reimbursement of my time to clean up the cities property. I spent about 5 hours cleaning up as well as the cost of sod. I will replace the mailbox with the one pictured. This obviously meets the less than stellar standards of the Village. I look forward to a timely response to these requests. On July 2"d the Games2U vehicles were on our property for a summertime party for some of the kids in our area. While Games2U is our company, we also hire Games2U for our personal entertainment for our kids and as well as our kids friends. The business that Games2U is a service business that delivers entertainment directly to the customer. (such the name "Games2U") The van is a self contained theater that the participants play video games inside of. The trailer contains laser tag equipment that is set up at the resident's property. The violations that were quoted (78-642) (78-745 e) have specific allowances for the completion of business by commercial operators. Below is what was left out of the articles you quoted: 78-642 (d) This restriction shall not apply to routine deliveries by tradesmen or the use of trucks in making service calls, providing that such time period is actually in the course of business deliveries or servicing, as the case may be. 78-745 (e) Signs on vehicles. Signs attached to or placed on a vehicle (including trailers) that are parked on public or private property shall be prohibited. This provision is not to be construed as prahibiting the identification of a firm or its principal products on a commercial vehicle operating during the ^ormal hours of business; provided, however, that no such vehicle shall be parked on public or private property with signs attached or placed on such vehicle primarily for the purpose of advertising a business or firm or calling attention to the location of a business or firm. As I communicated to you on past correspondence, we do not keep our commercial equipment at our residence. The van and the trailer are kept at a storage facility. Because we own the company, it is only fitting that we would take advantage of the opportunity to entertain at a reduced price. We have had Games2U parties before and most likely will have more in the future. Parking of certain commercial vehicles prohibited in residential areas. (a) No commercial vehicles or trucks over three-quarters ton rated capacity maybe parked on any property orright-of--way within a residential area. (b) For purposes of this division, residential areas include all areas within the village other than C-l, C-2, C-3, and R/OP. (c) This restriction shall not apply to the temporary parking of such vehicles on private property in residential districts whereon construction is underway for which a current and valid building permit has been issued by the village and such permit is properly displayed on the premises. (d) This restriction shall not apply to routine deliveries by tradesmen or the use of trucks in making service calls, providing that such time period is actually in the course of business deliveries or servicing, as the case may be. (e) This restriction shall not apply to the parking of emergency vehicles, provided that the time parked is actually necessary for the emergency. Further, the restriction shall not apply to volunteer emergency vehicles driven by residents of the village and parked on their property. (f) This restriction shall not apply to a situation where such vehicle becomes disabled and, as a result of such emergency, is required to be parked within a residential district for longer than the time allowed in this section, However, any such vehicle shall be removed from the residential district within 24 hours by wrecker towing, if necessary, regardless of the nature of the emergency, and the cost of such towing shall be at the expense of the owner of the vehicle. (Code 1977, app. A, § X(L)(1)) Sec. 78-745. Prohibitions in all zoning categories. (a) Blinking or reflective signs. No blinking, flashing, intermittent, animated or reflective type signs shall be permitted. Each light must be constant in intensity of illumination with a soft and muted effect. (b) Signs extending above roof height. No sign shall extend above the roof height unless backed by a parapet wall extending the entire length of the building and with the same or greater height than the sign. (c) Outline lighting. No neon tubing or other lineal use of lighting in outlining either the sign or the building or structure shall be permitted. (d) Painted wall signs. No painted wall signs shall be permitted. Lettering on walls must be of raised design. (e) Signs on vehicles. Signs attached to or placed. on a vehicle {including trailers) that are parked on public or private property shall be prohibited. This provision is not to be construed as prohibiting the identification of a firm or its principal products on a commercial vehicle operating during the normal hours of business; provided, however, that no such vehicle shall be parked on public or private property with signs attached or placed on such vehicle primarily for the purpose of advertising a business or firm or calling attention to the location of a business or firm. (f) Political signs. Political signs are regulated as follows: (1) No temporary political sign shall exceed six square feet per sign face in area; (2) No temporary political sign shall be placed in any public right-of--way or on any public property; (3) No temporary political signs shall be placed in a location, as determined by the village manager or his designee, in such a manner as to constitute a safety hazard, or hindrance to pedestrian or vehicular traffic; (4) Temporary political signs shall not be erected more than 30 days prior to the date of the election, referendum or matter to which the sign is directed; (5) All temporary political signs shall be removed within seven days after the date of the election, referendum or matter to which the sign is directed. If the signs are not timely removed, the village may enter upon the property where the sign is located and remove the sign at the property owner's expense; provided that, prior to the removal by the village, the village shall, within the seven-day period, send by hand delivery or certified mail, return receipt requested, to the addresses of the owner of each property on which the temporary political sign is located and to the owner as listed on the current tax rolls of the county, a notice of noncompliance stating that the village shall remove the sign at the property owner's expense if the sign is not removed within the seven-day period following the election, referendum or matter to which the sign is directed. Each sign not removed prior to expiration of the seven-day period shall constitute an abandoned sign not requiring a hearing prior to its removal by the village. The cost of removal by the village shall be as set by resolution of the village council and kept on file in the village clerk's office, which cost shall be assessed against the property owner and may be levied upon the property upon which the violating sign was located. However, no cost of removal shall be assessed against the property or property owner if the property owner can conclusively prove to the village manager, or his designee, that he was not responsible for the temporary political sign and had no knowledge of the temporary sign being placed or maintained on his property. (g) Signs on windows or doors. Signs on shop windows, display windows, or doors or other windows shall be subject to the following: Permanent signs shall be pen~itted to be erected or painted upon any window or door as provided for in this article. Any such sign permitted shall be part of the overall sign area permitted and shall not exceed 30 percent of the window or door area. (h) Outdoor merchandising displays. No outdoor merchandising display of banners or other merchandising material shall be permitted except for temporary special community-wide events or new business openings, and then only by special permission of the village manager upon a determination that the proposed display will be in the best interests of the health, safety and welfare of the citizens of the village. (i) Reserved parking space signs. No signs identifying or designating parking spaces as reserved for individual tenants, businesses and/or property owners shall be allowed. Signs identifying handicapped parking spaces per state, county and municipal requirements are exempt from this article; (j) Off-premises or billboard signs. No off-premises or billboard signs shall be permitted except as set forth at subsection 78-740{a). (k) Signs placed on public property. No signs placed, attached, posted, or located, on or to any tree, utility pole, street light, sidewalk, curb, fire hydrant, bridge or any other public property, shall be permitted; except that public utility, convenience, and warning signs are permitted if approved and erected by governmental agencies having jurisdiction over the applicable property; (1) Moving signs. No signs in motion, including swinging, rotating or revolving signs shall be permitted; (m) Official signs. No signs which copy or imitate official signs or which purport to have official status shall be permitted; (n) Signs with illegal messages. No signs which display any obscene or illegal written or graphic message shall be pen~nitted; (o) Signs interfering with buildings. No signs which obstruct or interfere with any door, fire exit, stairway, ladder or opening intended to provide light, air, ingress or egress for any building shall be permitted; (p) Signs creating traffic safety or fare hazards. No signs which constitute a traffic safety or fire hazard, by reason of size, location, coloring or method of illumination, which obstruct the vision of motorists or pedestrians; or which obstruct or detract from any official traffic control devices or utilize the words "stop", "look", "danger", or any other word or phrase, symbol or character in such a manner as to interfere with, mislead or confuse traffic shall be permitted; (q) Cube signs. No cube sign or advertising structure comprised of four faces, with copy on three or more faces shall be permitted; (r) Aircraft search lights. No aircraft search lights promoting, advertising, or bringing attention to a business, enterprise, or event shall be permitted; (Ord.
