ORDER APPROVING APPLICATION
This cause came on to be heard upon the above application and the Tequesta Village Council
having considered the evidence presented by the applicant and other interested persons at a hearing
called and properly noticed, and the Tequesta Village Council, being otherwise duly advised,
THEREUPON, THE TEQUESTA VILLAGE COUNCIL FINDS AS FOLLOWS:
1. The subject property is located in the MLJ Zoning District in the Village of Tequesta.
2. The applicant has submitted all documents required by the Village's Code of
Ordinances.
3. The application and all supporting documentation and presentation materials as
reviewed by the Village Council at its October 15, 2009 meeting, and as kept on file
by the Village, are made a part hereof and are hereby incorporated by reference.
4. According to Section 78-331, site plan approval is required.
5. The applicants have applied for a site plan review to allow development of a passive
park.
6. Under the provisions of the Village Code of Ordinances, the Village Council has the
right, power and authority to act upon the request herein made.
IT IS THEREUPON CONSIDERED, ORDERED AND ADJUDGED BY THE VILLAGE
COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, AS FOLLOWS:
The application for Site Plan Review, Case No. 3-09 with reference to the above described

property within the Village of Tequesta, Palm Beach County, Florida, to permit the following:
Development of a passive park, in accordance with the site plan and
application attached hereto as Exhibit "A"
is hereby APPROVED since the Village Council hereby finds that the applicants have met the
standards set forth in Section 78-331 of the Tequesta Zoning Code for site plan review.
* The term Aapplicant(s)@ as used herein shall include all successors and assigns.
* The applicant's= site plan approval shall expire in twelve (12) months unless a building permit
has been obtained in accordance with ' 78-334(9). If the building permit expires or is voided,
the site plan approval also expires or becomes void.
DONE AND ORDERED THIS 15th DAY OF OCTOBER, 2009.

Subject: Passive Park on Main Street
Planning & Zoning Advisory Meeting; August 20, 2009
The application for the Passive Park on Main Street resulted from a 5-year lease that the
Village took with JMZ Properties, the owner.
Over the years, there have been zoning violations, maintenance issues and illegal parking
that were not resolved. In the lease agreement, the property owner agreed to lease the
property for One Dollar ($1.00) a year in exchange for a closure of the zoning issues.
The Village or the owner JMZ Properties can break the lease at any time or the Village
can make an offer for purchase.
The Village desires to create a centrally located passive park until such time as the lease
is terminated or the property is purchased by the Village.
The plans that were drawn-up represent the minimum required to create a safe and
accessible parking lot and grassed area for public use. The cross parking agreements
with surrounding properties were preserved and the handicap requirement were met for
access to and on the property. This is a core plan which ensures public safety that can at
a later date be fully developed.
The sidewalks are on the public right-of--way and remain in the ownership of the Village.
The completion of the sidewalk on Bridge Road will create a walking path around the
entire block for public access to shopping, dining and exercise.
