Walls and Fences. to allow construction of an entry feature for the Casa Del Sol Development. ORDER APPROVING APPLICATION This cause came on to be heard upon the above application and the Tequesta Village Council having considered the evidence presented by the applicant and other interested persons at a hearing called and properly noticed, and the Tequesta Village Council, being otherwise duly advised, THEREUPON, TIC TEQUESTA VILLAGE COUNCIL FINDS AS FOLLOWS: 1. The subject property is located in the C-2 Zoning District in the Village of Tequesta. 2. The applicant has submitted all documents required by the Village's Code of Ordinances for variance review. 3. The application and all supporting documentation and presentation materials as reviewed by the Village Council at its October 15, 2009 meeting, and as kept on file by the Village, are made a part hereof and are hereby incorporated by reference. 4. According to Sections 78-284 and 78-61, variance approval by the Village Council is required. 5. The applicants have applied for a variance to allow construction of entry features to the PCD development. 6. Under the provisions of the Village Code of Ordinances, the Village Council has the Page 1 right, power and authority to act upon the request herein made. IT IS THEREUPON CONSIDERED, ORDERED AND ADJUDGED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, AS FOLLOWS: The application for Variance, Case No. VAR-1-09 with reference to the above described property within the Village of Tequesta, Palm Beach County, Florida, to permit the following: Construction of entry features for the Casa Del Sol Development, in accordance with the variance application attached hereto as Exhibit «A„ is hereby APPROVED since the Village Council hereby finds that the applicants have met the standards set forth in Section 78-65 of the Tequesta Zoning Code for variance approval. The following conditions of approval shall apply hereto: 1. The Applicant shall provide the Village (Law Enforcement, Fire Rescue and Administration) with access codes and keys for access through the security gates. Final inspection/approval by the Building Department shall be dependent on compliance with this condition. 2. The Applicant shall adjust the placement of the gates, to the satisfaction of the Building Official, such that they will not interfere with entering, exiting or turning around traffic. 3. The Applicant shall work with the Building Official to determine whether it is feasible to relocate the curb adjacent to County Line Road, and shall do so to the extent feasible. * The term Aapplicant(s)@ as used herein shall include all successors and assigns. * The applicant's= site plan approval shall expire in twelve (12) months unless a building permit has been obtained in accordance with ' 78-334(9). If the building permit expires or is voided, the site plan approval also expires or becomes void. ASLA Emily O'Mahoney, ASLA On October 5. 2003 the Casa Del Sol project was approved 5-0 by the Village Council as a Planned Commercial Development (PCD) with 10.000 SF of Office and 4l condominiums units. The approved development plan identified controlled entry to the residential portion of the project. off of County Line Road. The intent was to provide added security for the future residents. The Village has historically discouraged entry gates to projects located on `'publicly dedicated°` streets, however. per the recorded Casa Del Sol Development Plat (Book l OS .Page 92) the internal streets are dedicated to the Casa Del Spl Home Owner's Association (HOA) "for private ingress and egress with public access". Thus, pursuant to current .policy the developer must request a variance to allow entry gates at the access point to the Casa Del Sol Condominiums. Proposed Variance: VARIANCE STANDARDS The variance request to add Entry Gates at the entrance to the .Casa Del Sol Condominiums. As provided in Chapter 166, .Florida Statues, to authorize any variance from the provisions of this Chapter, the application must be determined by the review authority that the application be consistent with the criteria for granting variances listed below according to Section 78-65(2) of the Village of Tequesta Zoning and Land Development Regulations. A. The special conditions and circumstances exist which are peculiar to the land, structure or building involving and which are not applicable to other lands, structures or building in the same zoning district. Unlike other developments 4 within the Villagethat have streets/roads that are dedicated to the "public" the proposed variance to allow entry dates at the access point to the Casa Del Sol Condominiums would be controlling access to dedicated pnvate streets/roads. This is a ~ecial circumstance based on the plats dedication of streets to the HOA and not thepublic. B.. The special conditions and circumstances necessitating the variance do not result from the action of the applicant. The Villa;~e of Tee~uesta did not accept the liability and maintenance of the internal- roadway network of the Casa Del Sol development at time of approval Therefore the streets/roads were dedicated to the 1~~7~GH~~:,ar~d~l~ppce became~rivate streets. The proposed entry gates will further the-goal of this policy. C. The granting of a variance requested will not confer on the applicant any special - privilege that is denied to other lands. building or structures in the same zoning district- It is not uncommon. to allow entry gates to private .residential communities. As stated it was the intent to control access which is why the guard house was originally shown on the site plan during the approval process- D. The literal interpretation of the provisions of the regulations would deprive the applicant of rights commonly enjoyed by other properties in the same zoning district and would work unnecessary and undue hardship on the applicant. The literal 'interpretation prevents the ability to control access and promote additional security to the community as was intended. The right to protect property is afforded to other property owners within the Village as provided by Article IV Section 3(4) of the Village's Subdivision Regulations., which discourages through traffic on minor streets. E. The variance granted is the minimum variance that will make possible the "reasonable use of the land, building or structure. The requested variance is the minimum variance that will make possible the reasonable use of the land as intended. The addition of entry >?ates will create a deterrent ~to criminal activity, provide an added measure of security for the residents and is consistent with other Village policies. F. The variance will not be injurious to the area involved or otherwise detrimental to the public welfare. The intent of the requested variarce to permit entry dates is to provide a deterrent to criminal activity and provided added security for the residents of the community. The entry >;ates will control access along a private street and will not be incurious to the surrounding community. The entry gates will not. impede through traffic on a public roadway and will have zero impact on the surrounding community.
