HomeMy WebLinkAboutResolution_30-04/05_01/13/2005• RESOLUTION N0.30-04/05 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, CALLING A GENERAL MUNICIPAL ELECTION TO BE HELD TUESDAY, MARCH 8, 2005, AND IF NECESSARY THE MUNICIPAL RUN-OFF ELECTION TO BE HELD TUESDAY, MARCH 22, 2005, FOR THE PURPOSE OF ELECTING COUNCIL SEATS 2 AND 4; WAIVING THE REQUIREMENT OF SECTION 2-251 THAT INSPECTORS OF ELECTION SHALL BE QUALIFIED VOTERS IN THE VILLAGE BY ALLOWING THE INSPECTORS OF ELECTION TO BE QUALIFIED VOTERS IN PALM BEACH COUNTY FOR THE MARCH 2005 ELECTIONS; DESIGNATING POLLING LOCATIONS, ELECTION OFFICIALS AND INSPECTORS OF ELECTION; ESTABLISHING ELECTION PROCEDURES; PROVIDING AN EFFECTIVE DATE. WHEREAS, the Village adopted the uniform filing and election dates as preceded by the Legislature of the State of Florida House Bill 742, designating the second Tuesday in Mazch as the uniform election date for municipal office; and designating a filing period for such office from noon on the last Tuesday in January • through and not later than noon on the second Tuesday in February of the calendaz year; and WHEREAS, Section 2.01 of the Village Charter provides that Councilmembers shall be elected at lazge to Seats 2 and 4 in the odd years; and WHEREAS, Section 2-251 of the Village Code of Ordinances provides that Council may designate by Resolution polling locations, election officials, and inspectors of election, election procedures, and other incidentals required to conduct elections in the Village; and WHEREAS, the Village Council of the Village of Tequesta desires to designate polling locations, election officials, and inspectors of election, and establish election procedures for the General Municipal Election on Mazch 8, 2005; and if necessary a Municipal Run-off Election on Mazch 22, 2005. WHEREAS, the Village Council of the Village of Tequesta has chosen to waive the requirement of Section 2-251 that the inspectors of election shall be qualified voters in the Village by allowing the inspectors of election to be qualified voters in Palm Beach County for the March 2005 Elections. • • NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS: Section 1. Notice is hereby given that a General Municipal Election is scheduled to be held on Tuesday, March 8, 2005; and if necessary, a Municipal Run-off Election on Tuesday, March 22, 2005. The polling locations will be: Precincts 1072 and 1076 Tequesta Recreation Center 399 Seabrook Road ~~ Tequesta, Florida 33469 Precinct 1077 First Baptist Church of Tequesta 423 Tequesta Drive Tequesta, Florida 33469 The polls will be open from 7:00 a.m. to 7:00 p.m. Section 2. In accordance with the provisions of Section 2-251 Village of Tequesta Code of Ordinances, the Village Clerk shall be the Clerk of Elections and shall • supervise the conduct of the General Municipal Election in accordance with the State of Florida Election Laws and the Village of Tequesta Code of Ordinances. Section 3. The Village Clerk shall authorize payment of the Inspectors of Election per the rates in effect by the Palm Beach County Supervisor of Elections for poll workers, inspectors, clerks, and deputies. Section 4. The Palm Beach County Supervisor of Elections shall be an appointed member of the Village of Tequesta's Canvassing Board for the purpose of conducting the General Municipal Election. Section 5. The provisions of the Florida Elections Code relating to absentee ballots shall apply to the General Municipal Election, and the Palm Beach County Supervisor of Elections shall administer the absentee balloting. Section 6. The Palm Beach County Supervisor of Elections is designated to tabulate the ballots cast at the General Municipal Election. Section 7. The Village Clerk is hereby directed to post this Resolution in the Village Administrative Offices and Tequesta Recreation Center immediately after passage, and provide a certified copy to the Palm Beach County Supervisor of Elections. 2 • THE FOREGOING RESOLUTION was offered by Council Member Humpage, who moved its adoption. The Resolution was seconded by Council Member von Frank, and upon being put to vote, the vote was as follows: FOR AGAINST Pat Watkins Geraldine A. Genco Edward D.
