Jensen The Law Offices of Perry & Jensen, LLC DATE: November 2009 RE: State Law Updates BONNI SPATARA JENSEN bsjensen@perryjensenlaw.com Effective October 1, 2009, the Legislature amended §119.071 of the Florida Statutes, regarding the use of social security numbers. The changes include repeal of the requirement to report annually to the Governor, President of the Senate and the Speaker of the House whether a pension board has provided social security numbers to any commercial entity during the year. The law continues to recognize that social security numbers are generally confidential and exempt from §119.071, Florida Statutes. New language was added to clarify the conditions under which social security numbers held by an agency may be disclosed. The new language specifically states social security numbers may be disclosed for the purpose of the administration of a pension fund administered for the agency employee's retirement fund, deferred compensation plan, or a defined benefit plan. The law also requires that the collection of social security number policy be amended to refer to the specific law permitting the collection of the numbers. In the case of the Pension Fund, the citation is Florida Statutes §119.071(5)(a)6g. If you have any questions or if you would like a copy of the enrolled bill, please contact my office.
