ON ZOTdING HELD BY THE COUNCILMEN
OF THE VILLAGE OF TE~UESTA, FLORIDA

• A Public Hearing was held by the Councilmen of the Village of
Tequesta at 8:00 P.M. at the Church of the Goed Shepherd. Counci lnen
present were: riessrs. Yalier, Turnbull, Bowden, Cornelius and Sylvester.
Also present were Village Attorney William Lord and Village Clerk Robert
Harp.
Mayor Valier advised the Hearing that the purpose of the Hearing
~,ras to adopt Zoning Classifications according to the Village •f Tequesta
Zoning Ordinance No. 43 for various parcels of land recently annexed
to the territorial limits of the Village.
Mayor Valier advised that the first parcel of land t• be considered
was that commonly known as the Stradley, et al property located on the
northwest corner of Seabrook Road and Beacon Street (Item I en Public
Notice). The Clerk located the property on the zoning map, pointing
out that it was surrounded by Village properties zenedc2-1 Single
Family Dwelling Classification and that there presently were five (5)
houses oe the nix (6) tracts. of land in this parcel. Mr. Rudling and
Mr. Stiles, owners of tracts in this parcel wanted to know what the
R-1 Classification was and the Clerk read the blassificatian from the
Zoning Ordinance. Bowden moved, seconded by Turnbull that this parcel
of land be zoned R-1 Single Family Dwelling Classification under terms
of the Village of Tequesta Zoning Ordinance. All Councilmen voted in
favor of the motion and it was duly passed and adopted.
The next parcel considered was that consisCing of four tracts
. owned by Kostitch, Schmitter, Ellis and Demshok located West of the
~1est Right-of-Way line of U.S. Highway No. 1 and North of St. Judea
Catholic Ohurch property. (Item No. 3 on Public Notice). A small
plat showing this parcel of land with 'its zoning classification under
the Palm Beach County Zoning Regulations and surrounding Village Zoning
Classifications was given to each Councilman and expla.iaed. The Clerk
advised that Mr. kostich had tailed from St. Louis, Missouri requesting
Commercial Zoning for his entire piece of property (approximately 200
feet on U.S. Highway No. 1 by 370 feet west of the Right-of-4~ay of
U.S. No. 1.) Mr. Paul Schmutter had also verbally requested Commercia 1
Zoning for his property. Cornelius moved, seconded by Bowden that this
parcel of land be zoned C-1 Retail Commercial District Classification
under the terms of the Village of Tequesta Zoning Ordinance. All
Councilmen voted in favor of the motion and it was duly passed and
adopted.
The next parcel considered was that owned by Bates and t+lhite and
located to the west of the present Daly heal Estate office on V.S.
Highway No. 1. The Pa]m Eeach County Zoning on this parcel was also
explained from the plat and Council was advised that no requests for
zoning had been re4eived from the owners. Turnbull moved, seconded by
Eowden that this parcel of land be zoned C-1 Retail Commercial District
Cla.asification from the west might-of-Way line of U.S. Highway No. 1
westward the sae~e distance as Palm Beach County Zones C-1 (approximately
2?0 feet) and the balance of the parcel of land to the ,rest be zoned
• R-2 Multiple Family Dwelling District under the terms of the Village
of Tequesta Zoning Ordinance. .All Councilmen voted in favor of the motion
and it was duly passed and adopted.
The next parcel considered was the John Ziegler Estate property
located east of U.S. Highway No. 1 north of Village Square Shopping
Center running eastward to the Intracoastal Waterway. The Clerk read
a letter from Jennie Ziegler, Executrix of the Estate of John Ziegler,
requesting that this parcel of land be zoned in the same manner as the
lead directly to the north (the Franklin Property which is zoned C-1
Retail Commercial 33istrict). The Clerk also read a letter from Meadows,
Inc. owner of the Sinclair Service Station at the Corner of U.S. Highway
P1o. 1 and Tequesta Drive which stated they believed the zoning of the
parcel of land should be firs class commercial.
• Mr. L. H. Gillespie stated he was Vice-President of the Waterway
Viha.ge Property,Owner~s Association and was attending in the absence
of the Associations President,, Robert tlelker.
Harry Johnston, Jr., Attorney for the Association, spoke in their
behalf urging the Council to give great consideration to the adverse
e'`'lect Commercial Zoning of this parcel of land could have on the properties
e'~ r~:;fdents of l~~-aterway Village by impairing property values, etc.

Nir. Craig advised Council that the Association owned the south one-half
(30 feet) of T:taterway Road and had a perpetual easement over the north
one half (30 feet) and questioned the zoning of the right of way.,
Attorney Lord stated he did not believe zoning would affect the easement
since it could only be used for ingress and egress as long as it was
an easement. Mr. Craig raised further questions concerning, the possible
construction of a rr~arina on the waterway at the east end of the property
~~rith possible construction of a fish house and other parts of a marina
which could tend to cause offensive odors for the entire area.
Mr. John Duffield stated his property is on t:'ateri,-ay Road and
faces the property in question. He said he chect~ed the zoning of the
property in question prior to purchasing his o~m property and was
satisfied when he found out the County had it zoned R-lAA. He asked
that the Council give proper consideration to requests that the parcel
in question not be zoned C-1.
Mrs. ~'Jaterbury, who also lives on ~~7atenvay Road, also asked that
the parcel not be zoned commercial.
In all the discussion, there eras no objection to the 25G feet east
of the east right of way of U.S. Highway P1o. 1 being zoned C~1 Cla,ssi-
• fication.
There being no further discussion, the Mayor asked if there was
a motion concerning the zoning of this ;arcel. Turnbull moved that the
Ziegler estate property be zoned R-2. N:r. Turnbull was reminded that
the first 250 feet from the east right of ,ray line of U.S. Highway No. 1
was zoned C-1 by Palm Deach County and should also be so zoned by the
Village. Mr. Turnbull amended his motion to say that he moved that the
IJest 250 feet, measured from the east right of way line of U.S. Highway
No, 1, eastward, be zoned C~-I Retail Conuuerical District under the teams
of the Village of Tequesta Zoning Ordinance and the rest of the parcel
eastward be zoned R-2 multiple family dwelling district under the terms
of the Village of Tequesta Zoning Ordinance. The motion was seconded
by Bowden. All Counci Lnen voted in favor of the motion and it was duly
passed and adopted.
