ROBERT MILLER, Respondent. Case No. 2008-00019 Re: Violation of Chapter 10 Article I Section 10-8, of the Code of Ordinances of the Village of Tequesta. Address: 80 WILLOW ROAD • Tequesta, Florida 33469 Legal Description: RIDGEWOOD HOMES SEC 2, LOT 76 The Special Magistrate appointed by the Village of Tequesta to hear code enforcement cases for the Village of Tequesta, in accordance with Chapter 162, Florida Statutes, has heard testimony at the Code Enforcement Hearing held on the 21St day of February, 2008, and based on the evidence and testimony presented, the following FINDINGS OF FACT, CONCLUSIONS OF LAW, and ORDER are hereby entered: FINDINGS OF FACT 1. The Respondent, ROBERT MILLER, was present at the hearing and there a finding of proper notice. 2. The Tequesta Code Enforcement Officer testified to the repeat violation. The Officer testified that the property was not in compliance on January 16, 2008, and February 3, 2008. February 17, 2008 and February 18, 2008. 3. Laurel Maginsky, 331 Tequesta Drive, testified to the repeat violation that occurred on February 17, 2008. 4. Patricia Caslin, 331 Tequesta Drive, testified to the repeat violation that occurred on • February 17 and February 18, 2008. • CONCLUSIONS OF LAW Respondent, ROBERT MILLER, is in repeat violation of Chapter 10 Article I Section 10-8, of the Code of Ordinances of the Village of Tequesta. ORDER It is the Order of the Code Enforcement Special Magistrate that Respondent, ROBERT MILLER, shall continue to comply with Chapter 10 Article I Section 10-8, of the Code of Ordinances of the Village of Tequesta. A fine of one-hundred-fifty-dollars ($150.00) per day is hereby assessed for the repeat violation that has existed. The fine ofone-hundred-fifty-dollars ($150.00) per day is imposed for the four (4) days the violation existed, for a total fine ofsix-hundred-dollars ($600.00). The Respondent shall be assessed four-hundred-forty-five-dollars and twenty-one-cents ($445.21) for administrative costs to be paid immediately. A certified copy of this Order may be recorded in the Public Records of Palm Beach County, Florida, and, once recorded, shall constitute a lien against the property of the original amount upon which the violation existed and upon any other real or personal property owned by • the Respondent, pursuant to Chapter 162, Florida Statutes for the original amount. Upon complying, it is the responsibility of the Respondent to notify the Village of Tequesta Code Enforcement Clerk at (561) 575-3826 to request a reinspection of the property.
