The Special Magistrate appointed by the Village of Tequesta to hear code enforcement
cases for the Village of Tequesta, in accordance with Chapter 162, Florida Statutes, has heard
testimony at the Code Enforcement Hearing held on the 6th day of December, 2007, and based on
the evidence and testimony presented, the following FINDINGS OF FACT, CONCLUSIONS
OF LAW, and ORDER are hereby entered:
FINDINGS OF FACT
1. The Respondent, DELBERT OGDEN, was present and represented at the hearing, by
Attorney James Merola.
2. There was a finding of proper notice.
3. The Tequesta Code Enforcement Officer testified to the initial violation and subsequent
complaints to the Police Department.
4. There was no evidence that the violation existed past the time set to comply.
CONCLUSIONS OF LAW
Respondent, DELBERT OGDEN, is not in violation of Chapter 30 Article X Section 30-
361, of the Code of Ordinances of the Village of Tequesta.
• ORDER
It is the Order of the Code Enforcement Special Magistrate that Respondent, DELBERT
OGDEN, shall continue to comply with Chapter 30 Article X Section 30-361, of the Code of
Ordinances of the Village of Tequesta.
DONE AND ORDERED this 6t'' day of December, 2007.
