Weinand, Fire Chief /Community Develop Date: January 6, 2010 Re: Approval of Sign Change at Mad Hatter's (formerly Attached is a request for approval of a sign change at the old McCarthy's Restaurant and Pub located at 187 Tequesta Drive. This is scheduled for hearing at the Planning and Zoning Advisory Meeting on January 7, 2010 at 5:30 p.m.; I will provide a verbal update to their findings and recommendations. Mr. Frank Gillespie has made application for a name change on his existing monument sign to Mad Hatter's. Mr. Frank Gillespie remains partial owner and operator of this restaurant. This matter is before you because Section 22-53 (a) (2) of the village Code of Ordinances requires the Planning and Zoning Advisory Board to review and make recommendations to the ~Ilage Council regarding applications for signage requested and/or for modification in accordance with article XI of the Village zoning code. This restaurant was opened on Friday, December 18; with approval of temporary sign for a period of 30 days as permitted under section 78-742 (m). These temporary signs are required to be removed when the permanent sign is installed or no later than 30 days after installation of the temporary sign, whichever is sooner. This establishment is in the MU zoning district; and while reviewing Sec. 78-741 of the Village Code of Ordinances (Technical requirements), I noticed that the Code does not specifically address commercial areas of the a MU Zoning District. Therefore, the technical requirements of C-1, C-2 and C-3 have been reviewed and are as follows; Sec. 78-741 (b) (2) (e). Establishments not in shopping centers shall be allowed one freestanding sign under the conditions as follows: i. Establishments not in a shopping center and located within the C-1 neighborhood commercial district shall be allowed one sign per building apart from the building not to exceed 60 square feet in area and not exceeding 16 feet in height from finished grade and having a minimum setback of ten feet in accordance with section 78-739. Landscaping and irrigation at the base of any such signage may be required by the community development director, or may be recommended by the planning and zoning advisory board and required by the village council as part of the site plan review process as established in article IX, division 2 of this chapter whenever the landscaping and irrigation are considered desirable. The sign shall be located within the middle one-third of the property fronting on the public street. ii. Establishments not in a shopping center, located within the C-2 community commercial district or the C-3 general commercial district, shall be allowed one sign per building apart from the building not to exceed 60 square feet in area and not exceeding 20 feet in height from finished grade and having a minimum setback of ten feet in accordance with section 78-739. All commercial zoning districts allow one sign per building apart from the building not to exceed 60 square feet in area. According to Mr. Gillespie's application the sign is approximately 32 square feet. 2. Maximum height requirement within the C-1 shall not exceeding 16 feet in height from finished grade and the maximum height requirement within the C-2, C-3 commercial district shall not exceeding 20 feet in height from finished grade; This monument sign base is not being modified and has been approved by the Planning and Zoning Board and the Village Council. 3. All commercial zoning districts have a minimum setback of ten feet in accordance with section 78- 739. Again, this monument sign base is not being modified and has been approved by the Planning and Zoning Board and the Village Council. 4. My main concern with the applicants proposed sign is that I'm not sure it meets the intent of the Village Code of Ordinances Sec. 78-731. (b) which states that "It is further intended to protect property values, create a more attractive economic and business climate, enhance and protect the physical appearance of the community, preserve the scenic and natural beauty of the Village and provide a more enjoyable and pleasing community. Also, it is intended by this division to improve vehicular and • Page 2 pedestrian safety, provide more open space, curb the deterioration of natural beauty and the community environment, and reduce visual pollution." Most signs along Tequesta Drive have less than four colors and I could not find another sign in the Village with a cartoon type character on it. Below is a picture of adjoining properties signage which has four colors. The signage at Tequesta Municipal Center has the most colors but they are primarily from three-color pallets. The Planning & Zoning Board meets the first Thursday of every month at 5:30 P.M., as needed, at the Village of Tequesta Council Chambers, 345 Tequesta Drive, Tequesta. The applicant will be informed by letter of their scheduled meeting date. Due to administrative review, the meeting date the applicant is scheduled to attend, may not be the closest meeting to when the application is submitted. Attached to this form is a copy of the Village's Sign Regulations. This is not anall-inclusive documents, the regulations specific to the applicable zoning district should also be researched. Please be sure to check with the Community Development Department for any additional requirements that may apply. The applicant will submit to the Department with the following documents: 1) Twelve (12) sets of professional prepared site plans showing all existing and proposed structures, setbacks, (for structures and particularly for the proposed signs if it involves afree-standing or monument style sign), parking and loading layout, ingress and egress, sidewalks and walkways, exterior lighting layout, dimensions of street frontages and properly lines, and particularly the locations and description of all proposed and existing signs including those of any adjoining properties that may be within ten (10) feet of the property. 2) Twelve (12) sets of multi-dimensional color renderings and/or photographs are to be provided. The Planning & Zoning Board needs to see an exact rendering of what is to be placed on the site. Color photographs or prints as close to the actual colors to be used must be supplied. Since color printers often do not display the correct color, it is recommended that samples of the paint chips, as well as a sample of the support materials, i.e., canvas, wood, metal, etc., be provided. Sign Application, contd. 3) Landscaping is required at the base of a monument or free-standing sign. A landscape plan must be submitted. All commercial properties within the Village have an approved site plan with plantings ~/J noted. There are regulations regarding the percentage of native species, types of prohibited species, etc., that are found in the Village of Tequesta Code of Ordinances. The planting on a commercial structure may not be altered without approval. 4) Twelve (12) sets of professionally prepared drawings that outline the structural and electrical details, including side sectional views showing wiring and electrical components, constructions materials used, ©~~~"" attachments, support and footings are to be provided. If the sign is to be lighted, underground and interior electrical details should be outlined. The Village of Tequesta requires a one hundred fifty (150) mile hour wind load rating signed and sealed by an engineer. The dimensions of the sign(s) should be summarized, paying particular attention to its height, width, and total display area. 5) Written approval from the property owner, if other than the applicant. 6) Any other documents that may help clarify the position of the applicant. 7) FEES: $75.00 PLANNING & ZONING BOARD The Planning & Zoning Board consists of five (5) members and two (2) alternates, who are citizens of the Village of Tequesta. They have been appointed by the Village Council as an Advisory Board to the Council. The Planning & Zoning Board represents the Council in matters concerning site plans, appearance and aesthetic qualities of structures placed within the Village. If the documentation and presentation of your application provides the Board with a thorough knowledge base from which to make a decision, the process will go smoothly and quickly.
