AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE
OF TEQUESTA, FLORIDA, AMENDING THE VILLAGE CODE OF
ORDINANCES AT CHAPTER 22. COMMUNITY DEVELOPMENT.
ARTICLE 11. COMMUNITY APPEARANCE. DIVISION 2.
PLANNING AND ZONING ADVISORY BOARD. BY AMENDING
SECTION 22-52. TO PROVIDE THAT THE PLANNING AND
ZONING BOARD SHALL SELECT ITS CHAIR AND VICE-CHAIR
ANNUALLY AT THE FIRST MEETING OF THE BOARD AFTER
THE MAY MEETING OF THE VILLAGE COUNCIL; PROVIDING
THAT EACH AND EVERY OTHER SECTION AND SUBSECTION
OF CHAPTER 22. SHALL REMAIN IN FULL FORCE AND
EFFECT AS PREVIOUSLY ADOPTED; PROVIDING A
CONFLICTS CLAUSE, A SEVERABILITY CLAUSE AND
AUTHORITY TO CODIFY; PROVIDING AN EFFECTIVE DATE;
AND FOR OTHER PURPOSES.
WHEREAS, Section 2-1 of Article I of Chapter 2. Administration. Of the
Village of Tequesta Code of Ordinances provides that the Village Council shall
appoint the members and officers to the various Boards, Committees and
Commissions at the regular Village Council meeting to be held in May; and
WHEREAS, the Village Council desires to amend Sec. 22-52 in order that
the selection of the chair and vice-chair by the Planning and Zoning Advisory
Board will be consistent with Section 2-1 of Article I of Chapter 2. Administration.
of the Village of Tequesta Code of Ordinances ;and
WHEREAS, the Village Council believes that this revision to the Code of
Ordinances is in the best interests of the Village of Tequesta, and will promote
the public health, safety and welfare.
NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF
THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS
FOLLOWS:
Section 1: Chapter 22. Community Development. of the Code of
Ordinances of the Village of Tequesta is hereby amended at Article II.

Community Appearance. at Division 2. Planning and Zoning Advisory Board. at
Section 22-52; providing that Sec. 22-52 shall hereafter read as follows:

Sec. 22-52. Organization, qualification of members.
The board shall select its own chair and vice-chair annually at the first
meeting of the sa'°^~'°~ ••°°~ board held after the Mav meetina of the Villaae
ouncil at which time members are aaaointed. The director of the department of
community development or his designated representative shall serve as clerk to
the board. All members of the planning and zoning advisory board shall be
qualified electors of the village.
Section 2: Each and every other section and subsection of Chapter 2.
Administration. shall remain in full force and effect as previously enacted.
Section 3: All Ordinances or parts of Ordinances in conflict herewith be
and the same are hereby repealed.
Section 4: Should any Section or provision of this Ordinance or any
portion thereof, any paragraph, sentence or word be declared by a Court of
competent jurisdiction to be invalid, such decision shall not affect the validity of
the remainder of this Ordinance.
Section 5: Specific authority is hereby granted to codify this Ordinance.
Section 6: This Ordinance shall become effective immediately upon
passage.

Upon Second Reading this 14th day of January 2010, the foregoing Ordinance was
offered by Council Member Humpage who moved its adoption. The motion was
seconded by Council Member Turnquest and upon being put to a vote, the vote was as
follows:

The Mayor thereupon declared the Ordinance duly passed and adopted this 14T" day of
