DATE: February 5, 2010 RE: SPM 10-1, West Marine At your request, I have prepared the following summary of the action taken by the Planning and Zoning Advisory Board (PZAB) relative to the above referenced application at its February 4, 2010 meeting. 1. As you are aware, the applicant is proposing to expand the retail bay currently occupied by "Nautical but Nice" in the Village Square Shopping Center, in order to facilitate occupancy of this space by a new retailer, West Marine. The expansion would "square off 'the rear of the bay, making it flush with existing rear walls on both sides, and would thereby increase the square footage of the bay by 2,671 square feet. Additionally, the applicant proposes to increase the overall height of the bay to 23 feet in order to allow for a higher interior ceiling and greater inventory storage. Finally, the applicant proposes the addition of landscaping to the front of the bay and a re-configuration of parking, loading zone and dumpster location to the rear of the building. 2. The proposed site plan modification does not change the existing use on the site. All applicable height, setback and lot coverage requirements have been met. Although the site's landscaping is not in compliance with current code requirements, numerous landscape waivers were approved by the Village Council in 1997. The status of the landscaping along the rear of the site was a topic of discussion by the PZAB. Specifically, it was noted that while there currently exists a 4' buffer area along the rear of the site, there is little to no landscape materiaUvegetation existing therein. A review of the minutes from the March 6, 1997 Village Council meeting clearly reveals that among the landscape waivers previously approved for this site was awaiver/requirement that a rear hedge of Eugenia at 30" be installed adjacent to the six foot chain link fence at the rear of the site. In as much as the requirement for a hedge along the rear of the site was previously imposed as part of the landscape waiver approval process, any current deficiency would be an enforcement issue. Naturally, both the applicant and Village Code Enforcement should be made aware of the situation so that it may be corrected. 3. There was lengthy discussion by the PZAB regarding the proposed placement of dumpsters and loading zones at the rear of the site. Ultimately, the applicant agreed to modify this part of its plan in order to more evenly distribute the dumpster areas along the entire building for all tenants. The modified plan will be presented to the Village Council in accordance with the PZAB recommendations. 4. An additional PZAB recommendation to be implemented by the applicant involves the covered walkway at the front of the building. Specifically, the applicant has agreed to utilize pervious materials to connect the covered walkway adjacent to the building south of the proposed West Marine bay with the landscaped area/sidewalk in front of the West Marine bay. This revision should also appear on the modified plan to be presented to the Village Council. 5. The issue of stormwater drainage has always existed on this site. As you are aware, the construction of the Village Square Shopping Center pre-dates the Village's Zoning Codes, and the Village itself. As such, the site does not and never has, complied with current drainage requirements. However, the present application does not negatively impact the existing drainage situation since the proposed expansion will occur on what is already impervious drive/parking area. No additional demands will be placed on either the Village's or the applicant's drainage infrastructure. Therefore, this application does not trigger a requirement for additional drainage mitigation. Nevertheless, the applicant has met with representatives of Waterway Village, located to the east of the site, to discuss stormwater drainage mitigation. The result of this meeting was that the applicant has agreed to assist Waterway Village with current improvements being made to the Waterway Village stormwater drainage system. The applicant will provide more particular information regarding this agreement to the Village Council. 6. Finally, the issue of compliance with the fire safety codes was raised by Chief Weinand. In response, the applicant has agreed to utilize "four hour rated walls" in the expansion of the site and construction of the West Marine facility. This will, according to the Chief, bring the West Marine facility into compliance with applicable fire codes. Beyond this, the Village is reviewing its own infrastructure to determine what deficiencies may exist proximate to the Village Square Shopping Center, and what remediation (installation of additional fire hydrants on Village property) would be appropriate and feasible. After meeting with the property owners of the Village Square, and the Waterway Village HOA on February 4, 2010, the drainage issues are being resolved between the two parties. They have scheduled a meeting and are working out a feasible drainage arrangement that will help both properties deal with the stormwater runoff that is affecting them. I feel that all of the drainage issues will be rectified and this is a non-issue for the approval of the West Marine permit. I recommend approval at the February 11, 2010 Village Council meeting. We understand the Planning and Zoning Advisory Board recommended approval of the site plan amendment request with the issues below to be considered. We would ask the Village Council to consider the request to add 2,671 SF to the rear of the center accommodating the relocation of West Marine retail tacHity to the Village Square Shopper. The V~lage Square Shopper was approved by the Village of Tequesta and constructed ~ 1954. As we all know at that time there were different development oodes in the Village arxi South Florida Management DisMct (SFWMD) was not even an agency. tt was created by the Fkxida Legislature in 1972, over twenty years later. Both agencies have substantially modified ttmir respective codes and regulations over the years. in n~gards to drainage, it would be krtpracdcal and cost prohibitive to bring the shopping center into compliance with current regulations, in fact SFWMD's regulations stipulate that historic drainage patterns are essentially grandfathered and in the case of Village Square Shopper, we are operating in the same manner as it was when the district was created so it complies wfth their current requirements. The expansion requested is also being constructed on existing pavement area behind the existing building. We are not increasing or changing the current drainage or drainage pattern ao the center is exempt from further permitting from that agency. We are aware, howeaver, that there does exist an impact ~ the residential properties b the east of the shopping center. While this impact existed before many of the homes were, boat and the conatniction on some of the homes ~ that area have ktdact increased the knpact of exiatMg drainage patterns out-falling into the Intracoastal waterway, our Client wants to help. The outstanding items included in Mr. Weinand's results letter of the Planning and Zoning Advisory Commission included: 1. Consider making the dumpster area in the center of the Shopping Center larger. Response: We have move one parking space to the loading aroa to the north providing an additiona120' on length to the dumpster an®a in the center of the alley way. 2. Consider tying the walkway between West Marine and the rest of the Shopping Center with another walkway, possibly with pervious pavers. Response: After review of this area, existing landscaping w~l minimize this possible walk way to less than 4' wide. Our Client feels that the walk would not be as beneficial than the landscape in this area, particularly with the wall of West Marine adjacent to this planter. 3, Consider improving the exlsting landscape strip behind the shopping center. Response: After further review of the landscape conditions in the rear ~ the center, it was noted that the required landscape hedge and some of the trees were located on the east side of the wood perimeter fence to provide the neighbors to the east with the benefit of the handscape instead of the wood fence. It is our understanding this relocation was recommended when the landscape was stalled by the Village. Other comments Responses: in a previous letter to the Village Fire Chief we have agreed to provide the V~lage with a 10' easement for the installation of a new water main along US. Hwy. One and the West Marine will provide 4 hour rated fire walls on the north and south walls to mitigate life safety concerns. A security~re alarm system will be installed in the West Marine space and a key access box will be also installed. The plan was also revised to insure the correct number of parking spaces per the Village's code will be provided. We have also marked to the best of our ability loading zones in the alley way. It was also agreed at the meeting that the display boat would not be placed in the front of the center, this has also been removed from the plan. The last item that was discussed at the meeting was enclosure of the dumpsters in the rear of the project. As indicated in our plans we are ganging the dumpsters in specified areas and not in parking spaces as they exist. Proposed project to include: • A 3,574 sq. ft. addition at the rear of space 285 U.S. One So. (currently occupied by Nautical But Nice) • New storefront windows • Increasing the overall height of the building to 23' • Reconfiguring parking at the rear of the shopping center to meet code • Revised Landscaping / Paver Walkways These plans were reviewed by staff and a summary of their comments are listed below. Community Development review: • Parking regulations have been met by reconfigured at the rear of the center to add the additional parking spaces required. • Off Street Parking & Loading: Were this shopping center to be built today, the Code would require four (4) off-street loading or unloading spaces, min. 12' X 50', screened from the street or public way, exclusive of all driveways, aisles or drives provided for other off-street parking areas. There is no way to fully provide for this, but an area at the rear of the center should be marked as a loading or unloading zone. • Location and screening of dumpsters: Code requires all dumpsters to be screened from public view, from public streets, and from abutting properties; screening on three sides of the dumpster shall be erected with access to the dumpster on the fourth side being obtained by an approved opening. The dumpster areas at the rear of the property are being reconfigured and need to meet this section of the Code. • Sheet LP-1 shows a small boat displayed in front of the store, which is typical at most West Marine's. This could be for illustrative purposes only, however, the Village Code prohibits outdoor merchandising displays, and this should be pointed out to the applicant. 1 of 2 Utilities Department review • Shared water meter with the unit to the north needs to be severed and metered separately. • Require that the owner of the Village Square shopping center bring the property up to current drainage standards. The property does not have adequate draining for all of the impervious area. Public Services Manager, Russel White recommends a letter of understanding between the property owner and the Village, setting a time line for compliance. Fire Rescue review: • In the rear of the shopping center must be clearly marked as "no parking" and/or "loading zone only" to provide adequate access for fire apparatus and firefighting operations. • Fire protection water supply for this shopping center is not adequate. Improvements in the water system are required and any additional water mains must be looped. The fire protection water supply must be modeled and capable of providing the required fire flow as indicated below; o The minimum required fire flow shall be in accordance with the Florida Fire Prevention Code, Section 1, Table H.5., which indicates buildings between 70,601 and 77,000 square feet, with construction type of Class III (200) shall have 5, 750 gallons per minute @ 20 psi and a have a duration of at least four hours. o The minimum number of fire hydrants required to accomplish this 5,750 gallons per minute fire flow is six (6) with spacing no more than 250 feet apart. This in accordance with the Florida Fire Prevention Code, Section 1, Table I.3. o In accordance with the Florida Fire Prevention Code, Section 1, H.5.2.1, the required fire flow can be reduced by 75o if the property is protected throughout with an approved automatic fire sprinkler system. • Fire alarm systems shall be provided in accordance with NFPA 101 and NFPA 72. • Key access box needs to be provided. The existing bay was previously occupied by a retailer known as Nautical but Nice and will be replaced by a national retailer ° West Marine. The existing shopping center comprises approximately 5.55 acres and is located at 281 US Highway 1 (southeast comer of US-1 and Waterway Road.) The expansion to this bay is needed to accommodate West Marine's requirements for inventory and retail space: Project History: The Village Square Shopping Center was originally constructed in 1957. Additional square footage vas added to the plaza in 1960 and again in 1980. The total square footage that has been developed on the site over the past 53 years is approximately 72,000 SF. On March 6, 1997 the Village Council granted multiple waiver requests consistent with Section 78- 394(b) and 78-645 (identified as Ordinances No. 355 Section VII F.l.r and No. 377(H)(2)(C)1, 3, 10, and 11, on Cotleur Hearing Landscape Plan dated 12/12/96) which permits relief to the Village's Parking and Landscape Requirements. Sections 78-394(b) and 78-645 encourage waivers for existing development that would otherwise be negatively impacted by having to meet current parking and landscape regulations. Three additional landscape islands were constructed within the parking area per the Staffs direction. Over the years this particular ba~~ has been used by multiple restaurants, multiple retailers, a dress maker, and is currently occupied by Nautical but Nice, a local retail chain. Nautical but Nice is in the process of relocating to another bay within the plaza and, West Marine is moving into the bay as they need additional space to accommodate their current demand and inventory. West Marine has requested to square off the rear of the bay (east side) to create a slightly larger space for their inventory. The request is to add only 3,574 SF to the rear of the existing center. West Marine, Inc., is the leading distributor of marine supplies to recreational boaters, and the largest and most profitable boat supply chain uz the nation. Marine supplies ,for sailboats and powerboats--including recreational boating supplies, sporting goods, and sophisticated navigational equipment are sold through three divisions: Store.. (retail and wholesale, 74 percent), Catalog (retail, 15 percent) and Port Supply (wholesale, 11 percent). As stated above West Marine relies heavily on -its retail stores. Consistency with Land Use and Zoi]iirig: The site has not significantl}' changed in_ over 5.3 years. The surrounding development rose_up at around ,the same time or shortly after the development of the existing shopping center. Compatibility with the surrounding community has not been an issue in the 53 year history of the site. The subject site has a Future and Existing Land Use designation of Commercial and is zoned C- 2Community Conunercial. The existing shopping center is consistent with the intent of the C-2 district which is intended to locate a miY og goods and services that will service the community at large within proximity to US-1. The request is simply. an expansion of an existing bay to accommodate a new national tenant. The expansion will not project into the setback and will have little impact on the existing site or surrounding area. In addition, a coordination letter has been sent to the Florida Department of Transportation (FDOT) for their review and -comment. At the time this narrative was written, no response from FDOT has been received. As this is a non-residential project, no added impact to local schools or the Village's Park/Recreation inventory is projected. - Drainage: As required, a drainage statement was prepared by Jeff H. Iravani, P.E. and has been included with this submittal. The expansion area will simply be enclosing an`impervious area along the, rear of the existing building. Water/Sewer: , The water and sewer demand will remain constant, as no additional acreage will be added to the proposed project site area. -The expansion area will primarily house stock or inventory shelves, a small office, and the existing bathrooms will be relocated within the proposed expansion area: Please see the attached floor plan for additional detail. Landscape: - As mentioned in the project history of this narrative, waivers to the landscape section of the code were previously approved by the Village Council for this project. Additional green area, where feasible, has been added to the site since that time to address some of the existing deficiencies and to visually enhance the site. The proposed Landscape. Plan is incorporating S additional palms and 2 small leaf clusias along the foundation/frontage of the pro~iosed West Marine storefront. The walls will have a stucco finish and the frontage will contain a standing metal seamed awning replacing the existing roof overhang. The storefront windows-will be replaced with newer windows and the overall height of the building will be increased to a maximum of 23 feet. Parking: - Per the previously approved site plan, there were a total of 299 parking spaces existing/proposed for the 72,000 SF shopping center. A .total of 302 parking spaces are required for the 75,574 SF Shopping Center which includes the proposed 3,574 SF addition. As depicted on the site plan, several parallel parking spaces along the eastern boundary of the site are to be re-striped to create the additional parking needed to accommodate the addition. Please refer to the site plan for those ' details. Signage: All signs will be submitted for approval under separate cover.. A typical tenant sign has been depicted on the proposed architectural elevation for illustration purposes only: It is anticipated that West Marine will submit a Master Sign program to Village, Tequesta at a later date. - Conclusion: Based on the information provided, the 3,574 SF addition to the Village Square Shopping Center for the proposed West Marine is consistent with the pattern of development in this area. The addition will not require any substantial increase or impacts on the existing infrastructure.. Per the previous waivers granted to the site, the proposed addition/expansion will remain consistent with that approval.
