(Applicant) PROPERTY LOCATION: 28l U.S. Highway #1, Tequesta, Florida 33469 LEGAL DESCRIPTION: WATERWAY VILLAGE LOT A PARCEL CONTROL NUMBER: 60-43-40-30-OS-000-0901 ORDER APPROVING APPLICATION ~~i~.~D: Village of Tequesta date: °~' I U -10 This cause came on to be heard upon the above application and the Tequesta Village Council having considered the evidence presented by the applicant and other interested persons at a hearing called and properly noticed, and the Tequesta Village Council, being otherwise duly advised, THEREUPON, THE TEQUESTA VILLAGE COUNCIL FINDS AS FOLLOWS: 1. The subject property is located in the C-2 Zoning District in the Village of Tequesta. 2. The applicant has submitted all documents required by the Village's Code of Ordinances. 3. The application and all supporting documentation and presentation materials as reviewed by the Village Council at its February 11, 2010 meeting, and as kept on file by the Village, are made a part hereof and are hereby incorporated by reference. 4. According to Section 78-331, site plan approval is required prior to issuance of a building permit since the proposed project is not located in an R-1 or R-1 A zoning district. 5. The applicants have applied for a site plan modification to construct a 2,671 sq. ft. addition onto the rear of an existing retail sales bay and to increase the overal l height of the sales bay to 23 feet, reconfigure the existing parking, loading and dumpster spaces to the rear of the building and to add five palm trees and foundation plantings to the approved landscape plan. 6. Under the provisions ofthe Village Code of Ordinances, the Village Council has the right, power and authority to act upon the request herein made. IT IS THEREUPON CONSIDERED, ORDERED AND ADJUDGED BY THE VILLAGE COUNCIL Page 1 OF THE VILLAGE OF TEQUESTA, FLORIDA, AS FOLLOWS: The application for Site Plan Modification, Case No. SPM ] 0-1 with reference to the above described property within the Village of Tequesta, Palm Beach County, Florida, to permit the following: construction of a 2,671 sq. ft. addition onto the rear of an existing retail sales bay and to increase the overall height of the sales bay to 23 feet, reconfigure the existing parking, loading and dumpster spaces to the rear of the building and to add five palm trees and foundation plantings to the approved landscape plan is hereby APPROVED since the Village Council hereby finds that the applicants have met the standards set forth in Section 78-331 of the Tequesta Zoning Code for site plan modification, with the following special conditions: The Applicant has agreed to grant the Village an easement for the placement, use and maintenance of a water main for the purpose of installing fire hydrants. Such easement, in a form acceptable to the Village Attorney, Fire Chief and Utilities Director shall be granted to the Village prior to the issuance by the Village of any Certificate of Occupancy or its equivalent. 2. The Applicant shall be allowed up to 12 months from the rendering of this Order to complete construction of the dumpster enclosure(s). The term Aapplicant(s)@ as used herein shall include all successors and assigns. The applicant's= site plan modification approval shall expire in twelve (12) months unless a building permit has been obtained in accordance with ' 78-334(h). Ifthe building permit expires or is voided, the site plan approval also expires or becomes void.
