Jones Pasrrur Thanksgiving 2009 Director of'Mitsic Dear family and friends of the Chapel household of faith, Seen and heard across the community banks, grocery stores, retail shops, schools, and through the multiple media markets are the phrases "Give Thanks" or "Return Thanks" or "Share the Joy of Gratitude." As fine as these are reminders and while certainly appreciating any prompting, the communal call to give thanks none -the -less sounds hollow without any direct object attached to it. Grammatically correct, yet, incomplete. We're left to wonder, thanks to whom, and for what? Most notably the Psalmist and other Biblical authors when writing about this act of thanks -giving were clear to attach both the direct object as well as the objective of one's giving -thanks. Give thanks to the Lord, for God is good. Gods steadfast love endures forever. - Psalm 118:1, and in II Timothy 1:3, the Apostle Paul writes; I am grateful to God, when I rememberyou constantly in my prayers. Or, from pen of the Apostle Peter, Thanks be to the God and Father of our Lord Jesus Christ! By his great mercy he has given us a new birth into a living hope through the resurrection of Jesus Christ from the dead and into an inheritance that is imperishable, undefiled, and unfading, kept in heaven foryou... - I Peter 1:3,4. While each should consider, more often than annually, and add our own unique "for what's" to our response, the One to whom the thanks is due is universal for all of us. The lyrics by Stephen Schwartz to the song, "All Good Gifts" written for the Broadway musical Godspell I hope ring true for you as they do for me; All Good,& around us, are sent from heaven above. Then thank the Lord. Yes, thank the Lord, for all His love. The words were inspired from the Letter of James 1:17, which penned Everygenernus act ofgiving, with every perfect gift, is from above, coming down from the Father of lights, with whom there is no variation or shadow due to change. James' words inspired the early 20`h century lyricist and hymn writer, Thomas Chisholm to compose the memorable words we love to sing, Great is Thy faithfulness, O God my Father, There is no shadow of turning with Thee; Thou changest not, Thy compassion they fail not; As Thou bast been Thou forever wilt be. So not just now, but especially at this time of year I speak what naturally flows from this pastor's heart, and it is a deep abiding gratitude to God for each and every one of you. I thank God every day for the privilege of being pastor of such a wonderfully faithful congregation! I thank my God, for you. You are truly rich in faith and valued reflections of God's faithfulness. May I invite of you these two things: First, spend time with your loved ones this Thanksgiving and while together, recall and further reflect on God's gifts of loving kindness in your life. Speak of your God bestowed blessings with those dearest to you. Don't let those words go unsaid. And especially if they are your children, encourage them to frame their own words while with you. And then, my second and sincere request is that you will responsibly and responsively, with joy for God's generosity of love, grace and multiple blessings in your life - live and give into this year's Thanksgiving Offering at the Chapel from what for you is an overflowing heart! Gray, tenant of 63 Live Oak Circle; 2) Recent incidents regarding Julie N. Gray's loud music, her yelling at me and her verbal and behavioral obscenities I have called the police on numerous occasions because of loud booming noise coming from Julie's townhouse through my living room wall, which is the wall we share. I recently called Joe Petrick about an incident where Julie yelled at me, was combative and argumentative about leaving my premises, and slammed my front door against the face of my outside building wall. When Dave Cooper was in charge of Code Enforcement, I worked with him on this issue, and I worked with the former HOA management company representative, Chet King of Capital Realty. For quite a while, the problem was resolved. The past several months, however, the loud noise problem has returned, and unfortunately, it takes sending a police officer to Julie N. Gray's home to resolve the problem. I only resort to calling the police when I cannot handle it myself and it gets too noxious to stand. I am providing information on two recent incidents with the tenant of 63 Live Oak Circle, Julie N. Gray, and an item of concern regarding the delivery and use of illegal drugs at 63 Live Oak Circle. The most recent incident occurred late afternoon/early evening on Thursday, October 22, 2009 when I saw Julie walk across my driveway from my upstairs window and waved at her to say "hello." Instead of waving a "hello" back tome, Julie responded with a vulgar gesture of 'flipping the bird'— or as we used to call it, "the shaft" — whatever the proper vernacular is, she gave me her middle finger, glared at me with a very angry look, disappeared for a few minutes, and then re -appeared with a camera and stood on my drives eland across the street on the driveway of 60 Live Oak taking pictures of me working at my upstairs desk, which faces my driveway and looks out to the front of my townhouse, driveway and street. I am puzzled by and have no idea why Julie would want to have a photograph of me working at my desk in the townhouse that I rent. In an effort to diffuse Julie's obscene, vulgar, offensive and disgusting gesture and her obvious anger toward me for my calling the police on her loud music the evening of Wednesday, October 21, 2009, (which was most likely the impetus for her anger), I tried to exchange pleasantries with her and humor her in the early evening of Thursday, October 22, 2009, and offered her to "have a nice evening" as she stood on the driveway beneath my front window. In an effort to lighten her obviously angry mood and provide some levity to lift her anger, I copied her behavior of taking my photograph and took one of her, as well, and told her that I was sorry that I did not have a photo of her flipping me the bird and that it was a very immature and childish gesture for her to make at me. As I was leaving for dinner, Julie was standing by her car on the driveway that we share, and I rolled down my window and said, "Goodbye, Julie, have a nice evening." Julie glared at me and started yelling at me and running after my car, so I drove away and surmised that having any pleasant or adult conversation with her regarding the loud music or any other topic, or exchanging any humor about her taking photographs of me, would be futile. Based on my experience with Julie N. Gray, she responds to adult requests - and anyone or anything that challenges her to turn her loud music down - by being combative, belligerently confrontational, hostile, noxious, volatile, profane, loud and vulgar. Why Julie would want to chase me in my car down the street and yell at me after I tried being nice to her — while she was giving me dirty looks and making an obscene gesture at me - is another puzzle. 2 On Wednesday evening, October 21, 2009, 1 called the nonemergency number and asked for an officer to go to Julie's home and ask her to turn her music down because when I banged on the living room wall she turned it up instead of turning it down. Sgt. Turner responded to the call and was successful in getting her to turn her music down. He was under the impression that our apartments had "thin" walls, but I explained that these were DiVosta built homes with thick concrete walls and a firewall between each unit, so to hear her music through them is an indication of how loud she plays her music. I also shared with Sgt. Turner that Julie usually turns her music down when she sees an officer at her door (or through the door peephole), and that I did not like having to waste his and other officers time (or my time) with the problem, but that their presence usually corrected the problem; and that I was advised by Officer Dave Cooper to call the police and keep documentation of the problem. (I was also advised by Chet King of Capital Realty, the former Tequesta Oaks management company, to contact the police and keep written documentation of her ongoing loud music and noise problem.) Sgt. Turner was successful in getting Julie to turn the music down, and I called the nonemergency number to follow-up and let him know that his presence resolved the problem. I think Sgt. Turner agreed with me that it would have been more helpful for him to have come to my home first to hear how loud Julie's music was — and to hear first-hand what I was hearing through my wall - before he knocked on her door, since she had turned it down by the time he came into to my home. However, Sgt. Turner responded exactly to my request as it was called in on the nonemergency number and I take full responsibility for not asking that an officer come to my home first to hear what I was hearing when I called in to request assistance. I spoke w/ Joe Petrick of Code Enforcement regarding a disturbing and upsetting incident with Julie N. Gray on Tuesday afternoon September 8. 2009, when Julie came -to -My -home and Wau _not stop harLing on my front door. She also would not identify herself through the door when I asked who was knocking (I had a difficult time seeing through my outside door wreath). Finally, after she wouldn't stop banging on the door, I opened it. She said that the police had just called her and told her that I had written a report to them about her. I didn't know what she was talking about, and she kept going on about some written report that the police called her about. Because I was in the middle of preparing lunch and did not want my chicken to burn and didn't want her to wait outside in the heat, I invited her to step into my living room area and explain to me what she was talking about. While standing in my living room, Julie proceeded to tell me about some report and the more she spoke the louder her voice became and she demanded that I stop everything I was doing and go upstairs and make her a copy of "the report the police called her about." I finally realized that she was referring to a complaint that I gave to Joe Petrick about a conference call she facilitated between my landlord's son-in- law and Patricia King, owner of 56 Live Oak Circle, regarding the roach problem that I reported to code enforcement. During the conference call that Julie initiated with my landlord's son-in-law and Patricia King on Saturday, August 8, 2009, Patricia King threatened to sue my landlord's son with a law suit if he didn't get me to "back off the roaches" and she told him that she would file a suit against me if I didn't back off the roaches, and that she had already filed a report with the police because I filed a complaint about the roach infestation at her home. Julie also told my landlord's son to get me to "back off her music." Further information about this telephone call is in the complaint submitted on August 8, 2009. On the afternoon of Tuesday, September 8,1 told Julie that I would be happy to give her a copy of the report as soon as I finished cooking my chicken and having my lunch, but she continued to raise her voice and insist that I go upstairs immediately and make her a copy of the document. I told her that if she couldn't wait that she was welcome to get a copy of it from code enforcement and I walked to my front door to open it and let her out, but she would not move or leave my living room and she continued to yell at me and demanded that I stop everything I was doing and make her a copy of the complaint. J finaly 3 managed to get her to leave my home and as she walked out my front door she threw the door wide open and slammed it against the face of my outside building wall —so hard that I was afraid it had been damaged, and she shoved the door so hard against the wall that the fastener at the top opening element got stuck and I had to work to shut it back normally. As Julie left my home and walked down my sidewalk, she called me rude and obscene names and yelled at me to "move away because no one here likes me." I called Officer Petrick on the afternoon of Tuesday, September 8, and relayed the incident with Julie to him, and he advised that I not let someone [like her] into my home. I also confirmed with him that I did the right thing about reporting the roaches at 56 Live Oak Circle, and assumed that if I were in error or mistaken about the infestation, that the owner of 56 Live Oak Circle would not have received a citation. He confirmed that to be correct. He also confirmed that the police did NOT call Julie Gray about any report [complaint] that I submitted, and that anything regarding the complaint that I filed would have been followed up by him, and that he did not call her either. Julie presumably gave me the vulgar middle finger on Thursday, October 22 because I called the police on the evening of Wednesday, October 22, and because of the ongoing issues with her loud music booming through my living room wall, and my calling the police to help with having her turn her music down. Usually, when I bang on the wall we share, Julie turns her music down. However, she sometimes turns her music louder, as was the case on Wednesday, October 22, and on a few occasions Julie has come over and banged on my door and started yelling me and calling me names, and telling me that I should turn music up loud to drown her loud music out. I have tried several times to work out the music problem with Julie, and was under the impression from a friendly discussion with her earlier this summer that we had come to a pleasant resolution, when she was able to hear first-hand for herself how her loud music — especially the bass — booms through the wall we share. However, when the roach issues occurred with the unit across the street at 56 Live Oak Circle, Julie's loud music returned. Julie is friends with the owner of 56 Live Oak Circle, Patricia King, was in communication with Patricia about her roach infestation, and presumably shares Patricia's animosity and anger toward me for filing a complaint about the roaches (and loud music). Patricia King retaliated against me for reporting the roach problem, and she and Julie both have copies of my complaints. My opinion is that Patricia King and Julie Gray are in co -hoots to continue retaliations against me for reporting Ms. King's roaches and for reporting Ms. Gray's loud music. Both Julie Gray and Patricia King have taken photographs of me and my townhouse; and Ms. King took photographs of a service van parked in my driveway during a mid -afternoon visit, and reported the van being in my driveway during the mid -afternoon to the Tequesta HOA. Patricia King has also yelled at my landlord and me, and has complained to my landlord about my reporting the roach infestation. I presume that it is not against the law for Julie Gray and Patricia King to take photographs of me, the townhouse that I rent, and any cars that may occupy my driveway — so please be clear that I am not filing a complaint about either one's taking photographs. I am, however, filing a complaint regarding their retaliation behavior, their yelling at me, Julie's yelling obscenities at me and making a vulgar and obscene gesture at me, and Julie's ongoing loud music. I am also filing a complaint about the delivery and use of marijuana at 63 Live Oak Circle. While I am not offended by the use or smell of marijuana coming from the patio of 63 Live Oak Circle, I am offended by the proximity and delivery of an illegal substance next door to my home and in a neighborhood and on a street where young children live. I respectfully request that Julie N. Gray refrain from smoking marijuana outside her home and on her patio, and that she not have her marijuana delivered to her home, but rather that she pick it up from her dealer so that a drug dealer is not making illegal drug drops next door 4 to my home and in a community with young children and teenagers. I have no problem with Ms. Gray smoking marijuana in the privacy of her home. But I have a serious problem with drug dealers making deliveries in my neighborhood, on the street where I live, in close proximity to me and my home, and in close proximity to children. I am providing a copy of this complaint to: 1) Officer Joe Petrick, Tequesta Code Enforcement; 2) Tequesta Police Department, Public Safety; 3) Kenneth and Marcia Ramus, owners of the townhouse that I rent; 4) William H. and Lois C. Gray, owners of the townhouse that Julie N. Despite a slumping housing market, the median price of a home remains out of reach for many buyers due to high property taxes and tightening lending standards. • As of September 30, 2008, approximately one-third of all existing home loans in Palm Beach County were sub -prime loans and 12,000 properties were foreclosed. • Income has not kept pace with the rapid increase in home prices. Housing affordability based on the percent of households that can afford the median home price fell from 67 to 37% from 1995- 2005. • More than 86% of households cannot afford to buy a median -priced home in PBC and despite falling home prices, many first-time buyers are unable to buy homes. There is a grow mismatch between housing values and workforce demand. • Most low income workers don't have enough money to make a down payment on a home and probably wouldn't qualify for financing if they had the money. • 60% of renter households earn less that 50% of the AMI (area median income). • Rental housing is the principal source of available housing for low income households yet the supply of affordable rental housing has shrunk as rental units have converted to condominiums. • The high cost of rent in PBC, often consuming up to 70% of a low income family's net income. The number of renter households with rent exceeding 50% of their monthly gross income has increased more than 42% since 2000. • An issue for the low income renter is the possibility of having to move frequently and being evicted because their landlord defaults on loan or sells the property. In some areas, low income families have experienced gentrification. • PBC's Department of Human Services, which helps households at 150% of the poverty level, is turning away families every day. • The average commuter in Palm Beach County spends 26 minutes to reach their workplace. For the low income family the time is up to 46 minutes due to the limitation of affordable housing, where they live and where they work. • The high school graduation rate is 66%. Approximately 31% of the county's population over the age of 25 has a bachelor's degree. Sixty percent (60%) of net new jobs expected to be created in Palm Beach County will require some level of post high-school education. Recent funding cuts affecting Florida's higher -education system are keeping thousands of students from preparing for IN personal income level. In many cases, these individuals and families must rely on incomes that are close to or just below the federal poverty level. More children are living in low-income families, which is particularly troublesome because these children may face multiple risk factors during early childhood that threaten healthy development and learning. On average, Palm Beach County families need an income of about twice the federal poverty level to meet their basic needs. [Note: federal guidelines measure poverty by an outdated standard developed in the 1960s.] Based on the National Center for Children in Poverty, more than 25% of Palm Beach County families live in poverty — as opposed to the 12.2% identified by federal standards - further underscoring the high number of low-income working families living just above the poverty line. Palm Beach County is a culturally and racially diverse community with 15 racial groups from 27 countries around the world. More than 80% of the county's population is not native to the area. This transient nature is important because it implies that significant numbers of residents may not possess a local support system of extended family or a network of friends. So, when economic issues arise they must rely on community resources to help them. If community resources are inadequate, they may face difficult decisions regarding what basic needs take precedence. Economic activity continues to decelerate, making 2009 one of the most economically challenging years for Palm Beach County. These economic downturns and financial issues further exacerbate social and health problems affecting poor and at -risk member of our community. To illustrate, Palm Beach County (PBC) economic indicators and demographics underscores the need for Waterline Charitable Funds, Inc.'s services: • The population of Palm Beach County is approximately 1,294,654, with 8.8% of the population at 101-150% of the poverty level. • Twelve percent (12.2%) of families with children live below the federal poverty level ($21,200 for a family of four). • Unemployment is 7.6% - .3% above the national average (at this writing). • The average wage in Southeast Florida/Palm Beach County area is $35,700, $3,000 below the national average. The poverty limit for a family of four is $31,800. • Groceries cost more in PBC than anywhere else in the state. One in three households with annual incomes of $35,000.00 or less ran out of food before they had money to buy more. The number of households with hunger in PBC is almost double the national average of households with the same income levels. • Hunger households among children is three times the national average. • Almost one in ten Floridians is on food stamps. • Health care costs in PBC are the 2"d highest in the state; transportation costs are the 4th highest in the state • A working poor single parent of two could be over $600 in debt every month after paying rent, food and child care. Gray, tenant of 63 Live Oak Circle; 2) Recent incidents regarding Julie N. Gray's loud music, her yelling at me and her verbal and behavioral obscenities I have called the police on numerous occasions because of loud booming noise coming from Julie's townhouse through my living room wall, which is the wall we share. I recently called Joe Petrick about an incident where Julie yelled at me, was combative and argumentative about leaving my premises, and slammed my front door against the face of my outside building wall. When Dave Cooper was in charge of Code Enforcement, I worked with- him on this issue, and I worked with the former HOA management company representative, Chet King of Capital Realty. For quite a while, the problem was resolved. The past several months, however, the loud noise problem has returned, and unfortunately, it takes sending a police officer to Julie N. Gray's home to resolve the problem. I only resort to calling the police when I cannot handle it myself and it gets too noxious to stand. I am providing information on two recent incidents with the tenant of 63 Live Oak Circle, Julie N. Gray, and an item of concern regarding the delivery and use of illegal drugs at 63 Live Oak Circle. The most recent incident occurred late afternoon/early evening on Thursday, October 22, 2009 when I saw Julie walk across my driveway from my upstairs window and waved at her to say "hello." Instead of waving a "hello" back to me, Julie responded with a vulgar gesture offlipping the bird' - or as we used to call it, "the shaft" -whatever the proper vernacular is, she gave me her middle finger, glared at me with a very angry look, disappeared for a few minutes, and then re-appeared with a camera and stood on my driveway and across the street on the driveway of 60 Live Oak taking pictures of me working at my upstairs desk, which faces my driveway and looks out to the front of my townhouse, driveway and street. I am puzzled by and have no idea why Julie would want to have a photograph of me working at my desk in the townhouse that I rent. In an effort to diffuse Julie's obscene, vulgar, offensive and disgusting gesture and her obvious anger toward me for my calling the police on her loud music the evening of Wednesday, October 21, 2009, (which was most likely the impetus for her anger), I tried to exchange pleasantries with her and humor her in the early evening of Thursday, October 22, 2009, and offered her to "have a nice evening" as she stood on the driveway beneath my front window. In an effort to lighten her obviously angry mood and provide some levity to lift her anger, I copied her behavior of taking my photograph and took one of her, as well, and told her that I was sorry that I did not have a photo of her flipping me the bird and that it was a very immature and childish gesture for her to make at me. As I was leaving for dinner, Julie was standing by her car on the driveway that we share, and I rolled down my window and said, "Goodbye, Julie, have a nice evening." Julie glared at me and started yelling at me and running after my car, so I drove away and surmised that having any pleasant or adult conversation with her regarding the loud music or any other topic, or exchanging any humor about her taking photographs of me, would be futile. Based on my experience with Julie N. Gray, she responds to adult requests -and anyone or anything that challenges her to turn her loud music down - by being combative, belligerently confrontational, hostile, noxious, volatile, profane, loud and vulgar. Why Julie would want to chase me in my car down the street and yell at me after I tried being nice to her -while she was giving me dirty looks and making an obscene gesture at me - is another puzzle. 2 On Wednesday evening, October 21, 2009, I called the nonemergency number and asked for an officer to go to Julie's home and ask her to turn her music down because when I banged on the living room wall she turned it up instead of turning it down. Sgt. Turner responded to the call and was successful in getting her to turn her music down. He was under the impression that our apartments had "thin" walls, but I explained that these were DiVosta built homes with thick concrete walls and a firewall between each unit, so to hear her music through them is an indication of how loud she plays her music. I also shared with Sgt. Turner that Julie usually turns her music down when she sees an officer at her door (or through the door peephole), and that I did not like having to waste his and other officers time (or my time) with the problem, but that their presence usually corrected the problem; and that I was advised by Officer Dave Cooper to call the police and keep documentation of the problem. (I was also advised by Chet King of Capital Realty, the former Tequesta Oaks management company, to contact the police and keep written documentation of her ongoing loud music and noise problem.) Sgt. Turner was successful in getting Julie to turn the music down, and I called the nonemergency number to follow-up and let him know that his presence resolved the problem. I think Sgt. Turner agreed with me that it would have been more helpful for him to have come to my home first to hear how loud Julie's music was -and to hear first-hand what I was hearing through my wall -before he knocked on her door, since she had turned it down by the time he came into to my home. However, Sgt. Turner responded exactly to my request as it was called in on the nonemergency number and I take full responsibility for not asking that an officer come to my home first to hear what I was hearing when I called in to request assistance. I spoke w/Joe Petrick of Code Enforcement regarding a disturbing and upsetting incident with Julie N. Gray on Tuesday afternoon September 8, 2009, when Julie came to my home and would not stop banging on my front door. She also would not identify herself through the door when I asked who was knocking (I had a difficult time seeing through my outside door wreath). Finally, after she wouldn't stop banging on the door, I opened it. She said that the police had just called her and told her that I had written a report to them about her. I didn't know what she was talking about, and she kept going on about some written report that the police called her about. Because I was in the middle of preparing lunch and did not want my chicken to burn and didn't want her to wait outside in the heat, I invited her to step into my living room area and explain to me what she was talking about. While standing in my living room, Julie proceeded to tell me about some report and the more she spoke the louder her voice became and she demanded that I stop everything I was doing and go upstairs and make her a copy of "the report the police called her about." I finally realized that she was referring to a complaint that I gave to Joe Petrick about a conference call she facilitated between my landlord's son-in- lawand Patricia King, owner of 56 Live Oak Circle, regarding the roach problem that I reported to code enforcement. During the conference call that Julie initiated with my landlord's son-in-law and Patricia King on Saturday, August 8, 2009, Patricia King threatened to sue my landlord's son with a law suit if he didn't get me to "back off the roaches" and she told him that she would file a suit against me if I didn't back off the roaches, and that she had already filed a report with the police because I filed a complaint about the roach infestation at her home. Julie also told my landlord's son to get me to "back off her music." Further information about this telephone call is in the complaint submitted on August 8, 2009. On the afternoon of Tuesday, September 8, I told Julie that I would be happy to give her a copy of the report as soon as I finished cooking my chicken and having my lunch, but she continued to raise her voice and insist that I go upstairs immediately and make her a copy of the document. I told her that if she couldn't wait that she was welcome to get a copy of it from code enforcement and I walked to my front door to open it and let her out, but she would not move or leave my living room and she continued to yell at me and demanded that I stop everything I was doing and make her a copy of the complaint. I finally managed to get her to leave my home and as she walked out my front door she threw the door wide open and slammed it against the face of my outside building wall - so hard that I was afraid it had been damaged, and she shoved the door so hard against the wall that the fastener at the top opening element got stuck and I had to work to shut it back normally. As Julie left my home and walked down my sidewalk, she called me rude and obscene names and yelled at me to "move away because no one here likes me." I called Officer Petrick on the afternoon of Tuesday, September 8, and relayed the incident with Julie to him, and he advised that I not let someone [like her] into my home. Gray's loud music, her yelling at me and her verbal and behavioral obscenities I have called the police on numerous occasions because of loud booming noise coming from Julie's townhouse through my living room wall, which is the wall we share. I recently called Joe Petrick about an incident where Julie yelled at me, was combative and argumentative about leaving my premises, and slammed my front door against the face of my outside building wall. When Dave Cooper was in charge of Code Enforcement, I worked with him on this issue, and I worked with the former HOA management company representative, Chet King of Capital Realty. For quite a while, the problem was resolved. The past several months, however, the loud noise problem has returned, and unfortunately, it takes sending a police officer to Julie N. Gray's home to resolve the problem. I only resort to calling the police when I cannot handle it myself and it gets too noxious to stand. I am providing information on two recent incidents with the tenant of 63 Live Oak Circle, Julie N. Gray, and an item of concern regarding the delivery and use of illegal drugs at 63 Live Oak Circle. The most recent incident occurred late afternoon/early evening on Thursday, October 22, 2009 when I saw Julie walk across my driveway from my upstairs window and waved at her to say "hello." Instead of waving a "hello" back to me, Julie responded with a vulgar gesture offlipping the bird' - or as we used to call it, "the shaft" -whatever the proper vernacular is, she gave me her middle finger, glared at me with a very angry look, disappeared for a few minutes, and then re-appeared with a camera and stood on my driveway and across the street on the driveway of 60 Live Oak taking pictures of me working at my upstairs desk, which faces my driveway and looks out to the front of my townhouse, driveway and street. I am puzzled by and have no idea why Julie would want to have a photograph of me working at my desk in the townhouse that I rent. In an effort to diffuse Julie's obscene, vulgar, offensive and disgusting gesture and her obvious anger toward me for my calling the police on her loud music the evening of Wednesday, October 21, 2009, (which was most likely the impetus for her anger), I tried to exchange pleasantries with her and humor her in the early evening of Thursday, October 22, 2009, and offered her to "have a nice evening" as she stood on the driveway beneath my front window. In an effort to lighten her obviously angry mood and provide some levity to lift her anger, I copied her behavior of taking my photograph and took one of her, as well, and told her that I was sorry that I did not have a photo of her flipping me the bird and that it was a very immature and childish gesture for her to make at me. As I was leaving for dinner, Julie was standing by her car on the driveway that we share, and I rolled down my window and said, "Goodbye, Julie, have a nice evening." Julie glared at me and started yelling at me and running after my car, so I drove away and surmised that having any pleasant or adult conversation with her regarding the loud music or any other topic, or exchanging any humor about her taking photographs of me, would be futile. Based on my experience with Julie N. Gray, she responds to adult requests -and anyone or anything that challenges her to turn her loud music down - by being combative, belligerently confrontational, hostile, noxious, volatile, profane, loud and vulgar. Why Julie would want to chase me in my car down the street and yell at me after I tried being nice to her -while she was giving me dirty looks and making an obscene gesture at me - is another puzzle. • 2 On Wednesday evening, October 21, 2009, I called the nonemergency number and asked for an officer to go to Julie's home and ask her to turn her music down because when I banged on the living room wall she turned it up instead of turning it down. Sgt. Turner responded to the call and was successful in getting her to turn her music down. He was under the impression that our apartments had "thin" walls, but I explained that these were DiVosta built homes with thick concrete walls and a firewall between each unit, so to hear her music through them is an indication of how loud she plays her music. I also shared with Sgt. Turner that Julie usually turns her music down when she sees an officer at her door (or through the door peephole), and that I did not like having to waste his and other officers time (or my time) with the problem, but that their presence usually corrected the problem; and that I was advised by Officer Dave Cooper to call the police and keep documentation of the problem. (I was also advised by Chet King of Capital Realty, the former Tequesta Oaks management company, to contact the police and keep written documentation of her ongoing loud music and noise problem.) Sgt. Turner was successful in getting Julie to turn the music down, and I called the nonemergency number to follow-up and let him know that his presence resolved the problem. I think Sgt. Turner agreed with me that it would have been more helpful for him to have come to my home first to hear how loud Julie's music was -and to hear first-hand what I was hearing through my wall -before he knocked on her door, since she had turned it down by the time he came into to my home. However, Sgt. Turner responded exactly to my request as it was called in on the nonemergency number and I take full responsibility for not asking that an officer come to my home first to hear what I was hearing when I called in to request assistance. I spoke w/Joe Petrick of Code Enforcement regarding a disturbing and upsetting incident with Julie N. Gray on Tuesday afternoon September 8, 2009, when Julie came to my home and would not stop banging on my front door. She also would not identify herself through the door when I asked who was knocking (I had a difficult time seeing through my outside door wreath). Finally, after she wouldn't stop banging on the door, I opened it. She said that the police had just called her and told her that I had written a report to them about her. 1 didn't know what she was talking about, and she kept going on about some written report that the police called her about. Because I was in the middle of preparing lunch and did not want my chicken to burn and didn't want her to wait outside in the heat, I invited her to step into my living room area and explain to me what she was talking about. While standing in my living room, Julie proceeded to tell me about some report and the more she spoke the louder her voice became and she demanded that I stop everything I was doing and go upstairs and make her a copy of "the report the police called her about." I finally realized that she was referring to a complaint that I gave to toe Petrick about a conference call she facilitated between my landlord's son-in- lawand Patricia King, owner of 56 Live Oak Circle, regarding the roach problem that I reported to code enforcement. During the conference call that Julie initiated with my landlord's son-in-law and Patricia King on Saturday, August 8, 2009, Patricia King threatened to sue my landlord's son with a law suit if he didn't get me to "back off the roaches" and she told him that she would file a suit against me if I didn't back off the roaches, and that she had already filed a report with the police because I filed a complaint about the roach infestation at her home. Julie also told my landlord's son to get me to "back off her music." Further information about this telephone call is in the complaint submitted on August 8, 2009. On the afternoon of Tuesday, September 8, I told Julie that I would be happy to give her a copy of the report as soon as I finished cooking my chicken and having my lunch, but she continued to raise her voice and insist that I go upstairs immediately and make her a copy of the document. I told her that if she couldn't wait that she was welcome to get a copy of it from code enforcement and I walked to my front door to open it and let her out, but she would not move or leave my living room and she continued to yell at me and demanded that I stop everything I was doing and make her a copy of the complaint. (2) Radios, phonographs, etc. Using, operating, or permitting to be played, used or operated any radio receiving set, musical instrument, phonograph, or other machine or device for the producing or reproducing of sound in such manner as to disturb the peace, quiet and comfort of the neighboring inhabitants or at any time with louder volume than is necessary for convenient hearing for the persons who are in the room, vehicle or chamber in which such machine or device is operated and who are voluntary listeners thereto. The operation of any such set, instrument, phonograph, machine or device between the hours of 11:00 p.m. and 7:00 a.m. in such a manner as to be plainly audible at a distance of 50 feet from the building, structure or vehicle in which it is located shall be prima facie evidence of a violation of this section. (3) Use of loudspeakers or amplifiers for advertising. The using, operating, or permitting to be played, used, or operated of any radio receiving set, musical instrument, phonograph, loudspeaker, sound amplifier, or other machine or device for the producing or reproducing of sound which is used upon the public streets for the purposes of commercial advertising or attracting the attention of the public to any building or structure. (4) Yelling, shouting, etc. Yelling, shouting, hooting, whistling, or singing on the public streets, particularly between the hours of 11:00 p.m. and 7:00 a.m. or at any time or place so as to annoy or disturb the quiet, comfort, or repose of persons in any office, or in any dwelling, hotel or other type of residence, or of any persons in the vicinity. (5) Animals, birds, etc. The keeping of any animal or bird which by causing frequent or long continued noise shall disturb the comfort or repose of any persons in the vicinity. (6) Steam whistles. The blowing of any locomotive steam whistle or steam whistle attached to any stationary boiler except to give notice of the time to begin or stop work or as a warning of fire or danger, or upon request of proper village authorities. (7) Exhausts. The discharge into the open air of the exhaust of any steam engine, stationary internal combustion engine, motorboat, or motor vehicle except through a muffler or other device which will effectively prevent loud or explosive noises therefrom. (8) Defect in vehicle or load. The use of any automobile, motorcycle, or vehicle so out of repair, so loaded or in such manner as to create loud and unnecessary grating, grinding, rattling or other noise. (9) Loading, unloading or opening boxes. The creation of a loud and excessive noise in connection with loading or unloading any vehicle or the opening and destruction of bales, boxes, crates, and containers. (10) Construction or repair of buildings. The erection (including excavation), demolition, alteration or repair of any building other than between the hours of 7:00 a.m. and 6:00 p.m. on weekdays including Saturdays, except in case of urgent necessity in the interest of public health and safety, and then only with a permit from the building official, which permit may be granted for a period not to exceed three days or less while the emergency continues and which permit may be renewed for periods of three days or less while the emergency continues. If the building official should determine that the public health and safety will not be impaired by the erection, demolition, alteration or repair of any building or the excavation of streets and highways within the hours of 6:00 p.m. and 7:00 a.m., and if he shall further determine that loss or inconvenience would result to any party in interest, he may grant permission for such work to be done within the hours of 6:00 p.m. and 7:00 a.m., upon application being made at the time the permit for the work is awarded or during the progress of the work. (11) Creation of noise near schools, courts, churches or hospitals. The creation of any excessive noise on any street adjacent to any school, institution of learning, church or court while the same is in use, or adjacent to any hospital, which unreasonably interferes with the workings of such institution, or which disturbs or unduly annoys patients in the hospital, provided conspicuous signs are displayed in such streets indicating that the street is a school, hospital or court street. (12) Hawkers and peddlers. The shouting and crying of peddlers, hawkers and vendors which disturbs the peace and quiet of the neighborhood. (13) Drums. The use of any drum or other instrument or device for the purpose of attracting attention by creation of noise to any performance, show or sale. (14) Transportation of metal rails, pillars and columns. The transportation of rails, pillars or columns of iron, steel, or other material over and along streets and other public places upon carts, drays, cars, trucks, or in any other manner so loaded as to cause loud noises or as to disturb the peace and quiet of such streets or other public places. (15) Piledrivers, hammers, etc. The operation between the hours of 6:00 p.m. and 7:00 a.m. of any piledriver, steam shovel, pneumatic hammer, derrick, steam or electric hoist or other appliance, the use of which is attended by loud or unusual noise. (16) Blowers. The operation of any noise-creating blower or power fan or any internal combustion engine, the operation of which causes noise due to the explosion of operating gases or fluids, unless the noise from such blower or fan is muffled and such engine is equipped with a muffler device sufficient to deaden such noise.
