Please add the attached agenda item to the March 23, 2010 agenda of the regular meeting of the Village
Council.
This item was prepared by the Village Attorney and designates the Finance Director, or designee, as "Budget
Officer" to authorize certain budget amendments within a department providing the amendment(s) does not
change the total amount of appropriations of the department.
I have attached the resolution as well as the email from the Village Attorney in which he states his opinion that
it would be better to have one officer and designee(s) than two officers.

Please see the attached. I know that you asked about having co-officers or multiple officers. I did not prepare
this resolution in that way. After giving it some thought, it is my opinion that it would be better to have one officer, and
designee(s) that the officer could direct in her absence. I think that there is potential for confusion if both you and Mr.
Couzzo were officers at the same level on the chain of command. Let me know what you think. Thanks.

RESOLUTION N0.4-10
A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF
TEQUESTA, FLORIDA, DESIGNATING THE FINANCE DIRECTOR AS
THE "BUDGET OFFICER" PURSUANT TO SECTION 166.241(3)
FLORIDA STATtlTES; AUTHORIZING THE DESIGNATED BUDGET
OFFICER WITH THE APPROVAL OF THE VILLAGE MANAGER TO
AUTHORIZE CERTAIN BUDGET ADJUSTMENTS WITHIN A
DEPARTMENT; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER
PURPOSES.
WHEREAS, The Village of Tequesta has established its fiscal year to begin on
October 1St of each year and end on September 30th of the following year; and
WHEREAS, Section 166.241(2), Florida Statutes, requires each municipality to
adopt a budget each fiscal year by ordinance or resolution, unless otherwise specified in
the respective municipality's Charter; and
WHEREAS, the Village Council of the Village of Tequesta previously adopted its
budget for fiscal year 2009-2010; and
WHEREAS, Section 166.241(3) Florida Statutes, further authorizes each
municipality to establish procedures by which a designated "Budget Officer" may
authorize certain budget amendments; and
WHEREAS, the Village Council believes that the designation of a "Budget Officer"
in order to authorize certain budget amendments within a department providing that the
total amount of appropriations of the department is not changed will be in the best
interests, and will promote the health, safety and welfare of the Village of Tequesta and
its citizens.
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, FLORIDA, THAT:
Section 1: The foregoing recitals are true and accurate, and are hereby
incorporated into this Resolution.
Section 2: The Village Council of the Village of Tequesta, Florida,
hereby designates the Finance Director or her designee as Budget Officer in accordance
with Section 166.241(3), Florida Statutes. The Finance Director or her designee, as the
designated Budget Officer, with the written approval from the Village Manager, shall be
authorized to make certain budget adjustments within a department provided that the
total of the appropriations of the department is not changed.
Section 3: This Resolution shall take effect immediately upon its
adoption by the Village Council.
