This 1.035 acre parcel at the southwest corner of the Tequesta Drive/FEC Railway intersection consists of a 50-foot wide parcel running parallel to the railroad beginning at the southern edge of the Tequesta Drive right-of--way and extending southward 900+/- feet to the Village municipal boundary. The Village intends to install landscaping at the northwestern corner of this property at the Tequesta Drive intersection as part of the FEC landscape project. Once approved by the Village Council, the deed will be recorded and Northern will then proceed to calculate the actual costs and expenditures of the project and provide the Village with a final accounting. The Interlocal Agreement provides that "in the event the Village's allocable share of the actual costs of the Drainage improvements is less than the amounts previously paid by the Village to Northern, Northern shall refund such surplus to the Village within thirty (30) calendar days of the accounting." The Village Attorney has reviewed the attached materials. If you require additional • information or clarification prior to the meeting, please advise. r~ ~. • RESOLUTION NO. 45-04/05 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, APPROVING A BILL OF SALE FOR IMPROVEMENTS AND A QUIT-CLAIM DEED FOR PROPERTY AS PART OF THE CYPRESS DRIVE DRAINAGE IMPROVEMENTS PROJECT, RECEIVING THE IMPROVEMENTS AND REAL PROPERTY FROM THE NORTHERN PALM BEACH COUNTY IMPROVEMENT DISTRICT. WHEREAS, the Village entered into an Interlocal Agreement with the Northern Palm Breach County Improvement District to jointly undertake drainage improvements to the area in the vicinity of Cypress Drive, also known as Northern's Unit of Development No. 36; and WHEREAS, Northern installed certain improvements and acquired certain real property within the boundaries of the Village to accomplish the drainage improvements and desires to convey those improvements and properties to the Village; and WHEREAS, the Village wishes to accept the improvements as specified in the Bill of Sale attached as "Exhibit 1" and the real property as specified in the Quit-Claim • Deed attached as "Exhibit 2." NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS: Section 1: The Bill of Sale to the Village of Tequesta from the Northern Palm Beach County Improvement District of a portion of the stormwater collection and transmission system as further described in "Exhibit 1" dated February 25, 2004 and attached hereto is hereby approved and the Mayor is authorized to accept the improvements on behalf of the Village of Tequesta. Section 2: The Quit-Claim Deed to the Village of Tequesta from the Northern Palm Beach County Improvement District of a strip of land of approximately 1.04 acres, immediately adjacent to the western boundary of the Florida East Coast Railway right-of- way and further described in "Exhibit 2" dated February 25, 2004 and attached hereto is hereby approved and the Mayor is authorized to accept the parcel on behalf of the Village of Tequesta. • • THE FOREGOING RESOLUTION ,who moved its Councilmember follows: FOR ADOPTION WAS OFFERED BY Councilmember adoption.
