Address: 144 Magnolia Way Tequesta, Florida 33469 Legal Description: RIVERSIDE OAKS REPL LT 43 PCN: 60-42-40-25-45-000-0430 The Special Magistrate appointed by the Village Council to hear code compliance cases for the Village of Tequesta, in accordance with Chapter 162, Florida Statutes, has heard testimony at the Code Compliance Hearing held on the 27~' Day of August, 2009, and based on the evidence and testimony presented, entered an Order Finding Repeat Violation and Assessing Fine. The following Findings of Fact, Conclusions of Law, and Order are hereby entered: FINDINGS OF FACT The Respondent was not present at the hearing; however, and there was a finding of proper notice of the repeat violation and the hearing. 2. Officer Joe Petrick testified to the existence of the violation. Additionally, Wayne Piorio, Joanne Russell and Joanne Brooks testified to observing Respondent being in violation on 14 separate occasions. 3. Based upon evidence presented the property is in violation of Chapter 10 Article II Section 10-34 of the Code of Ordinances of the Village of Tequesta. 5. The record reflects that the same respondent was in violation of the same code provision at the same property within the past five years. As such, this is a repeat violation. Page 1 of 2 CONCLUSIONS OF LAW Based on the above -stated facts, Respondent(s) is in repeat violation of Chapter 10 Article 11 Section 10-34 of the Code of Ordinances of the Village of Tequesta. It is the Order of the Special Magistrate that the Respondent shall comply with Chapter 10 Article II Section 10-34 of the Code of Ordinances of the Village of Tequesta immediately. A fine is hereby assessed for this repeat violation in the amount of three thousand, five hundred dollars, representing $250.00 for each of the fourteen separate violations established by the evidence in this case. In addition, administrative costs in the amount of four hundred twelve dollars and forty cents ($412.40) are hereby assessed for this hearing. Tequesta Code Enforcement Officer Petrick testified that the violation occurred on August 30, 2008 and September 11, 2008. 3. Neighbor, John Hayes, testified that the violations occurred on August 30, 2008 and September 11, 2008. He testified that he observed the Respondent walking his dogs with leashes on both occasions and on both occasions either one or both of the dogs wondered onto other neighbors' properties. He testified that this has been an ongoing problem for several neighbors for the last two years. Page 1 of 2 CONCLUSIONS OF LAW Respondent, WILLIAM PALAGONIA, was in violation of Chapter 10 Article II Section 10-34, of the Code of Ordinances of the Village of Tequesta on August 30, 2008 and September 11, 2008. This type of violation is irreversible as contemplated by F.S. 162.06(4) and, as such, a fine may be imposed in accordance with F.S. 162.09(1). It is the Order of the Code Enforcement Special Magistrate that Respondent, WILLIAM PALAGONIA, shall immediately comply with Section Chapter 10 Article II Section 10-34, of the Code of Ordinances of the Village of Tequesta. Respondent shall be assessed a fine of one -hundred -dollars ($100.00) for the violation that occurred on August 30, 2008 and one -hundred -dollars ($100.00) for the violation that occurred on September 11, 2008. Respondent shall be assessed two -hundred -twenty -three -dollars and seventy -four -cents ($223.74) for administrative costs to be paid in full by the 61h day of October, 2008. Future violations of the aforementioned code sections may be considered a repeat violation for which a fine of up to five -hundred -dollars ($500.00) per day may be imposed beginning on the date the violation begins. A certified copy of this Order may be recorded in the Public Records of Palm Beach County, Florida, and, once recorded, shall constitute a lien against the property of the original amount upon which the violation existed and upon any other real or personal property owned by the Respondent, pursuant to Chapter 162, Florida Statutes for the original amount.
