SUBJECT: Village Council Chambers Usage Policy & Fee Schedule and
Reservation Application
There have recently been several requests to use the Village of Tequesta Council
Chambers by other governmental agencies and local HOA's. The attached sets forth
for your consideration a Chambers Use Policy and Fee Schedule and Reservation
Application /Agreement.
The policy would allow Village residents and Village based non-profit organizations the
opportunity to use the Chambers during normal business hours (when available) at no
charge, and at a cost of $25 per hour outside of normal business hours. The rental fees
associated would cover the electricity, janitorial and maintenance costs associated with
after hour use.

RESOLUTION NO.8-10
A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF
TEQUESTA, FLORIDA, PROVIDING FOR THE USE OF THE
VILLAGE'S COUNCIL CHAMBERS BY VILLAGE NON-PROFIT
ORGANIZATIONS AND RESIDENTS; PROVIDING AN EFFECTIVE
DATE; AND FOR OTHER PURPOSES.
WHEREAS, the Village Council desires to provide for the use of the Village
Council Chambers by Village residents and non-profit organizations; and
WHEREAS, the Village Council desires to allow such use at no charge
during the normal business hours of Village Hall, and at the cost of $25.00 per
hour outside of the normal business hours of Village Hall in order to reimburse
the Village for electricity costs, janitorial fees and other maintenance costs
associated with such afterhours use.
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS:
Section 1: The Village Council of the Village of Tequesta hereby agrees to
allow Village residents and Village based non-profit organizations (501 c3 or
similar) the opportunity to use the Village Council Chambers during normal
business hours at no cost, when available and upon proper reservation.
Section 2: The Village Council of the Village of Tequesta hereby agrees to
allow Village residents and Village based non-profit organizations (501 c3 or
similar) the opportunity to use the Village Council Chambers at a cost of $25.00
per hour outside of the normal business hours of Village Hall in order to
reimburse the Village for electricity costs, janitorial fees and other maintenance
costs associated with such afterhours use.
Section 3: The normal business hours of Village Hall are set as 8:00 a.m.
- 5:30 p.m. Monday through Thursday, and 8:30 a.m. - 5:00 p.m. on Friday.
Section 4: This Resolution shall become effective immediately upon
passage.

All reservations will be handled through the Village Clerk's Office and must be made by the
applicant or designated alternate in advance. This facility is available for Village Resident
events and Tequesta non-profit organizations only. Applicants must read the USE POLICY
and complete a COUNCIL CHAMBERS RESERVATION APPLICATION/AGREEMENT at
least thirty (30) days prior to the date of their event. Reservation Application/Agreements
submitted to the Village Clerk less than 30 days prior to the date of the applicant's event may
not receive approval in time for the event to be held.
Please note: Use of the Council Chambers by the Village Council for official business shall
take priority over any other scheduled events; however, the Village will make all reasonable
efforts to schedule official business meetings around other scheduled events.
Any Village based non-profit organization (501 c3 or similar) that provides a service to the
Village or its residents and that is governed by a board and by-laws (such as a village property
owner's association, civic group, business group or non-profit group) is eligible to use the
Council Chambers for meetings provided such meetings are within the guidelines of this USE
POLICY (no parties are permitted). All applicants must be at least 21 years of age and be a
resident of the Village of Tequesta. No fees will be waived unless approved by the Village
Council. Damage fees will be assessed based on actual repair or replacement costs
incurred by the Village as a result of damages caused during your event /function.

RESERVATION PROCESS:
A Reservation Application/Agreement (including any required fees) must be submitted to the
Village Clerk at least thirty (30) days prior to the date of the scheduled event. Once the Village
Clerk has received your completed application/agreement, you will be contacted regarding
your event's approval. Factors that determine availability include set up/break down needs (for
your event and others), attendance, time, day, holiday and staffing availability. No meeting or
event is confirmed until the Reservation Application/Agreement has been executed by both the
applicant and the Village, and the required fee and security deposit has been collected.
Applicants may visit Village Hall and receive a tour of the facility for event planning purposes
by calling the Village Clerk's Office in advance to schedule an appointment (561) 575-6244.
GENERAL RULES AND REGULATIONS:
• Applicants must be at least 21 years of age.
• Proof of Village residency is required. A copy of the Applicant's valid Florida Driver's
License or current property tax statement must be submitted with the Reservation
App I ication/Agreement.
• Completed Reservation Application/Agreement forms for use of the Council Chambers
facility must be received by the Village Clerk at least thirty 30 days prior to the event.
• If deemed necessary by the Village, the Applicant may be required to submit in writing
additional details about the proposed event. The Village reserves the right to deem an
activity inappropriate for the Council Chambers facility and to refuse or rescind
approval.
• The Village may require a certificate of insurance coverage, at the determination of the
Human Resources Director; and this may apply to services, rental companies, and other
outside contractors. Determination of the need for proof of insurance shall be made on
a case by case basis.
• Anyone may schedule an advance tour of the facility by calling the Village Clerk. You
must call in advance of your visit since Village staff is only available to give tours during
limited times.
• All approved activities must be conducted in accordance with the Reservation
Application/Agreement and Use Policy.
• Neither applicants nor event attendees will be allowed into the Council Chambers facility
earlier than the approved access time.
• The Council Chambers facility is comprised of the Council Chambers and Village Hall
lobby area only. All events are restricted to this part of the Village Hall building.
• Access to the vending machines and kitchen will not be permitted.
• The Village Hall building is anon-smoking and drug free facility. Use of drugs or
tobacco products of any kind is STRICTLY PROHIBITED.
• The Council Chambers facility can be unlocked and secured by Village representatives
only. Keys to the Council Chambers facility will not be issued.
• The Village of Tequesta, including its staff, employees and officials, is not liable
for injury or illness of any person, or for damage to or loss of any personal
property, resulting from anyone's attendance at any Council Chambers facility
event.
• The Applicant shall report any personal injury requiring medical attention to the Human
Resources Director, or the Police Department if HR is not immediately available. A
written accident report describing the circumstances will be completed and submitted to
the Human Resources Department within 24 hours of the event.
• Failure to vacate the Council Chambers facility at the conclusion of the event will result
in additional charges and loss of security deposit.
• Reservation Application/Agreements are non-transferable.

• Applicants are responsible for ensuring that event attendees do not enter landscaped
areas or damage Village property. Forfeiture of deposit and/or assessment of additional
fees may be imposed for violations or damage to Village property.
• The Village does not provide linens, tableware, silverware, place settings, center pieces,
decorations or equipment other than what is listed in the Reservation
Application/Agreement Form.
• The Village shall furnish light, heat, air-conditioning, and tables and chairs,(available on
limited basis and to be set up by APPLICANT- Village will not rent tables or chairs for
APPLICANT), incidental to ordinary Council Chambers facility use. The Applicant shall
be responsible for all decorating and other special preparations necessary for the event
as approved. All such decorations must comply with the "SET UP DECORATIONS"
section of this Use Policy. It is the responsibility of the Applicant to inform the Village of
all equipment, caterers, or other special needs or uses prior to the event i.e. deliveries,
room set-up, etc. Such requests must be made in conjunction with the Reservation
Application/Agreement in order to allow time for consideration and approval. Storage
facilities are not available.
• Absolutely no weapons are to be brought onto Village property.
• Open flame devices or pyrotechnic devices including fog machines, candles or other
special effect devices are NOT permitted to be used in the Council Chambers facility.
• Groups composed of youth ages 21 and younger must have constant adult supervision
at a ratio of 1 adult to 10 youth at alt times.
• Gambling is prohibited on Village property except as permitted by Florida State Law.
• Animals, other than service animals, are not permitted in the Council Chambers facility
unless previously approved by the Village.
• Village staff shall have the right to enter all areas of the Council Chambers facility at any
time during scheduled events.
• The sale of goods, services, food or beverage, or the charging of an admission fee is
not permitted unless approved by the Village Council prior to the event. Village
sponsored events are excluded from this restriction.
• Anyone violating the established Village of Tequesta Council Chambers Use Policy, or
creating a nuisance, may be requested to leave the facility. The misuse of the Council
Chambers facility will be sufficient reason for terminating the Reservation
Application/Agreement with no refund.
• Courtesy and safety are expected from all event attendees. Equipment abuse, profanity
and fighting are unacceptable behavior and will result in expulsion from the Council
Chambers facility.
PARKING/LOADING:
• Parking is permitted in designated parking spaces only. THERE IS TO BE NO
PARKING AT THE FRONT ENTRANCE OF THE VILLAGE HALL BUILDING AND
VEHICLES ARE NEVER PERMITTED ON THE GRASSED AREAS.

• UNDER NO CIRCUMSTANCES CAN DESIGNATED FIRE LANES BE BLOCKED.
• Loading and unloading is permitted on a limited basis at the entrance of the Village Hall
building but vehicles must be immediately moved upon the completion of such loading
and unloading.
• Depending on the number of attendees and/or the time and nature of the event, valet or
off-site parking may be required as deemed necessary by the Village.
FOOD/BEVERAGE SERVICE:
• All food items must be removed at the end of the event. No food items may be stored
for pick up at a later date. Any leftover food items will be discarded. Additional charges
and loss of security deposit may be assessed as appropriate.
• The Village assumes no responsibility for the preparation and service of any food items.
• It is the responsibility of the Applicant to provide their own preparation, serving and
eating dishes, paper products, utensils, and all other items.
• Alcoholic beverages are prohibited unless approved by the Village Council.
SET-UP DECORATIONS:
• Decorations must be free standing or tabletop. Tape, nails, screws, tacks, staples, or
other surface adhesives or objects that may damage the walls of the Council Chambers
facility or other Village property are not permitted, and the Applicant will be charged for
any repairs.
• Confetti, rice, glitter, etc. are not permitted.
• No outside rental equipment (e.g. chairs, tables) is permitted in the Council Chambers
facility without prior Village approval.
FEES:
The Village assesses use fees according to the Village Council approved fee schedule.
• Additional fees may be assessed for services and/or equipment required by the
Applicant or deemed necessary.
Payment (including security deposit) is required in full upon submittal of the Reservation
Application to the Village Clerk's Ofhce.
• No refunds will be given once the event has commenced.
• No fees will be waived or reduced unless approved in advance by the Village Council.
CANCELLATIONS:
• The Village reserves the right to cancel the Rental Application/Agreement in the event
of a hurricane watch or warning posted within 3 three days of the reservation date, or
when other acts of God, catastrophes or unforeseen circumstances beyond the Village's
control are present. In the event that the Village exercises its cancellation right
hereunder, it shall return in full any payments received from the Applicant, but shall not

be responsible for any costs incurred by the Applicant in connection with the cancelled
event.
DAMAGE AND DEPOSITS:
• A refundable security deposit is required with all reservations. Applicants are required to
pay the security deposit with a check, money order or cash when the Reservation
Application/Agreement is submitted. The deposit will be refunded in full unless there are
damages, policy violations, or misconduct. In the event that damage to the Council
Chambers facility or its equipment should exceed the deposit, the deposit will be
retained and the Village will assess additional charges as necessary. Damage fees are
based on replacement or repair costs as determined by the Village, and may exceed the
initial deposit amount. By signing and submitting the Reservation
Application/Agreement, the Applicant is agreeing to be responsible for any such
additional damage fees which may be assessed.
• Damage fees may be assessed for the following or as deemed necessary by the
designated Village representative:
1. Carpet or furniture stains requiring more than standard extraction techniques
2. Stains on walls
3. Broken or missing furniture and/or equipment
4. Defacement of any part of the interior or exterior of the Village Hall building
5. Damage created by improper use of equipment or non-compliance with Council
Chamber facility Use Policies
6. Clean-up must be completed as outlined in the "CLEAN-UP" section of this Use
Policy
7. Police called for emergency/disturbance
8. Unauthorized use of areas outside of the Council Chambers facility
9. Unauthorized extension of hours; this may include overtime fees as welt as
additional rental fees
10. You are limited to the number of people listed on your Reservation Agreement. If
you have more people at your event than are listed on your Reservation
ApplicationlAgreement, you may be subject to the loss of your deposit, rental
fees, and/or the cancellation of your event or prohibition from use of the Council
Chambers facility for any future events.
11. Equipment and/or items of any type left in the facility without prior approval
12. Any other circumstances which reasonably justify a damage fee
• A check for the refund of the appropriate security deposit will be issued by the Village
within 3-4 weeks after the event.
• The Village of Tequesta, including its staff, employees and officials, is not liable
for injury or illness of any person, or for damage to or loss of any personal
property, resulting from anyone's attendance at any Council Chambers facility
event.
• A pre-event and post-event walkthrough of the Council Chambers facility will be
performed. If onsite and available, the Public Works Department staff will visually

inspect the building following the function with the Applicant. If the Public Works
Department is not available, an inspection of the premises will take place the morning
following the event. If deductions are necessary, the Applicant will be contacted within
five 5 working days of the event to discuss any damage noted during the walkthrough or
additional damage found afterwards and what course of action will be taken.
DISQUALIFYING FACTORS FOR FACILITY RENTALS (this list is non-exclusive):
• Use is considered contrary to the Village's best interest (The Village reserves the right
to reject a rental request for any reason, and any circumstances, whatsoever, at its sole
discretion)
• Misrepresentation of information in the Reservation Application/Agreement
• Applicant or Applicant's group/organization has previously violated the Use Policy or
Fee Schedule
SECURITY POLICY:
• Security must be provided at the Applicant's expense if it is deemed necessary by the
designated Village representative. Security may be required due to, among other things,
the nature or size of the event.
• An off-duty Tequesta police officer may be scheduled through the Police Department
with applicable fees as set forth by Resolution.
CLEAN-UP:
• Clean-up must be completed within the time noted on the Reservation
Application/Agreement. The Applicant is responsible for making sure that the Council
Chambers facility and any other areas affected by the event, i.e. restrooms, outside
grounds of the Village Hall building, etc. are clear of debris, food and beverage spills,
personal belongings, rental equipment and decorations no later than the end of the time
noted on the Reservation Application/Agreement.
• Garbage must be collected and placed in the garbage container located inside the
Council Chambers facility.
• The Village is not responsible for any property that is left on the premises by an
individual or group using the facility.
• The Council Chambers facility, including its contents, must be left in the same condition
in which it was found.
• The Applicant must notify the Police Department upon leaving the Council Chambers
facility at the conclusion of the event 744-4010.
OUTSIDE VENDORS AND CATERERS:
• The Village may require outside caterers to provide a certificate of insurance coverage
naming the Village of Tequesta as an additional insured for the date of the event at the
Council Chambers Use Policy and Fee Schedule Page 6
determination of the Human Resources Director. Determination of the need for proof of
insurance shall be made on a case by case basis.
• Outside vendors and caterers must abide by this Use Policy.
• The Applicant is deemed the contact person for any outside vendors or caterers, and
shall be ultimately responsible for any violations of the Use Policy by their outside
caterers or vendors.
• Outside caterers and vendors must depart at the time designated on the Reservation
Application/Agreement. Charges will be assessed for any additional time past the
scheduled departure time.
RECURRING MEETINGS:
• No one organization will be granted the use of the facilities for more than two
consecutive days without prior approval of the Village Manager.
• Groups meeting on a monthly basis may be issued a reservation for one complete
calendar year.
• Monthly meeting groups must apply for renewal of their reservation two 2 months before
the end of their current approval.
• Recurring meeting groups may be moved to another room or location at the discretion
of the designated Village representative on an as needed basis.
• Storage space is not available for meeting groups.
IMPORTANT NOTICE
It is important to remember that Village Hall belongs to the Village and its residents and should
be respected. Everyone who attended events that take place in the Council Chambers facility
should enjoy the atmosphere and respect the furnishing and amenities.

THIS RESERVATION APPLICATION/AGREEMENT is made and entered into one
_._____ ______ _ ___,.___ _ ____ __ _~_ _ ___..___ by and between the Village of Tequesta, a Florida
municipal corporation, (hereinafter referred to as VOT) and
_,___r______~ (hereinafter referred to as APPLICANT).
IN CONSIDERATION of the covenants and conditions herein expressed and of the faithful
performance of all such covenants and conditions, VOT and APPLICANT do mutually agree as
follows:
EVENT DETAILS
VOT does hereby grant to the APPLICANT the use and occupancy of the Village Council
Chambers facility located at 345 Tequesta Drive, Tequesta, FL 33469.

The Council Chambers facility is to be used for the date, duration and sole purpose, and in the
manner as stated above. By execution of this Reservation Application/Agreement,
APPLICANT acknowledges the receipt of the Council Chambers Use Policy and Fee Schedule
governing the use and occupancy of the Council Chambers facility and APPLICANT agrees to
abide by all of the terms and provisions thereof.

RIGHT OF ENTRY
VOT and its officers, agents and employees reserve the right, at any time, to enter upon and
have free access to any and all parts of the Council Chambers facility. VOT reserves the right
to preclude or interrupt any act or use of equipments by APPLICANT within the reasonable
judgment of VOT, if it is so necessary in the interest of public safety to protect persons or
property from exposure to risk of injury, death, damage or loss. VOT shall have the right to
inspect any and all parts of the Council Chambers facility and/or Village Hall building and make
or cause to be made necessary repairs thereto, to enforce all necessary and proper rules for
the management and operation of same, and to enforce the obligations set forth herein and in
the Council Chambers Use Policy and Fee Schedule.
DEFAULT BY APPLICANT
Should APPLICANT default in the performance of any of the terms, obligations, restrictions
and conditions of the Council Chambers Reservation Application/Agreement (which includes
by reference the Council Chambers Use Policy and Fee Schedule), VOT shall have all legal
remedies available to it. Upon default by APPLICANT, VOT may immediately, or at any time
thereafter, refuse APPLICANT or anyone else permitted on the premises under the Council
Chambers Reservation Application/Agreement access to the Council Chambers facility, and
VOT may remove APPLICANT or anyone else permitted on the premises under this Council
Chambers Reservation Application/Agreement.
INABILITY OF VOT TO PERFORM
In the event the facility, or any part thereof, shall be destroyed or damaged by fire or weather
or any other cause, or if any other casualty or any unforeseen occurrence shall render the
fulfillment of the this agreement by VOT impossible or impractical, then and thereupon, this
Agreement shall terminate. APPLICANT hereby waives any claims for damages or
compensation should this Council Chambers Reservation Application/Agreement be so
terminated. If the Council Chambers facility, or the Village Hall building is damaged so as to
render the fulfillment of this agreement impossible before APPLICANT has taken possession,
than all advance fees are to be refunded to APPLICANT with no further obligation/liability of
VOT.
RELEASE OF LIABILITY OF VOT
VOT assumes no responsibility whatsoever for any properly placed in/on the Council
Chambers facility, the Village Hall building or any Village properly by APPLICANT, its agents,
employees, representatives, independent contractors or invitees. VOT is hereby expressly
released and discharged from any and all liabilities for any loss, injury or damage to
such property or to persons that may be sustained by reason of the use and occupancy
of the Council Chamber facility, the Village Hall building or any Village property under
this Agreement. APPLICANT assumes full responsibility and liability for all damages, losses
and liabilities caused by patent defects or conditions on in/on the Council Chambers facility,
the Village Hall building or any Village property once it commences use and occupancy of
same. VOT shall not be responsible for any damage or injury to, or the persona! conduct,
safety and welfare of APPLICANT'S representatives, employees, exhibitors, independent
contractors, workers and invitees while in/on the Council Chambers facility, the Village Hall
building or any Village property. APPLICANT expressly releases VOT and its respective
officers, agents and employees from any and all claims, damage, losses or liability
associated therewith.
INDEMNIFIGATION
To the fullest extent permitted by laws and regulations, APPLICANT agrees to indemnify,
defend, save and hold harmless VOT and its respective officers, agents and employees,
harmless from all claims, damages, liabilities, losses, causes of action, liens or judgments of
any kind or nature whatsoever which may arise out of, in connection with, or because of the
use, maintenance, or operation of the rented facilities. APPLICANT shall pay all claims,
losses, liens, settlements or judgments of any nature whatsoever in connection therewith,
including but not limited to reasonable attorney's fees and costs to defend all claims or suits, in
the name of VOT when applicable. Such indemnification shall not be limited to the amount of
insurance available from any source. Nothing contained herein is intended nor shall be
construed as a waiver of VOT's sovereign immunity beyond that set forth in Sec. 768.28,
Florida Statutes. The provisions of the Paragraph shall survive the execution, delivery and
performance of this Council Chambers Reservation Application/Agreement.
ASSIGNMENT
APPLICANT shall not assign, transfer, or sublet this Council Chambers Reservation
Application/Agreement or its rights, title or interest therein. Initial
ATTORNEY'S FEES
In the event of breach of this Council Chambers Reservation Application/Agreement or default
in the performance of any of its terms by APPLICANT, or in the event it becomes necessary for
VOT to terminate the Council Chambers Reservation Application/Agreement, then the
prevailing party shall be entitled to recover its reasonable costs, including attorneys' fees, for
any expenses it may incur in enforcing its rights hereunder.
AUTHORITY TO $IND`APPLICANT
In the event the Council Chambers Reservation Application/Agreement is executed by
someone other than the APPLICANT, the person signing expressly warrants the authority to
execute the Council Chambers Reservation Application/Agreement on behalf of the
APPLICANT for this engagement under the terms and conditions established and agreed
herein, and acknowledges that VOT reasonably relied on such apparent authority. Should it
occur that the person signing this Council Chambers Reservation Application/Agreement did
not in fact have such authority to bind said entity, then, such person becomes personally liable,
without limiting VOT'S ability to bind APPLICANT.
ENTIRE AGREEIIAENT
This Council Chambers Reservation Application/Agreement, which includes by reference the
Council Chambers Use Policy and Fee Schedule and any Addendums thereto, comprises the
entire understanding of the parties and there are no other agreements or understandings, oral
or written, with respect to this Council Chambers Reservation Application/Agreement. This
Council Chambers Reservation Application/Agreement may not be changed, modified or
altered except in writing signed by both parties. APPLICANT specifically acknowledges that no
oral representations or promises of any kind (other than those contained in this written
Agreement) have been made by VOT, its officers, agents or employees.
I have received and read a copy of the Council Chambers Use Policy and Fee Schedule
and understand and agree to all the terms and conditions set forth therein; I am aware
that if any of those policies are violated, I will be charged accordingly. I understand and
agree that I shall be, and will remain, solely and fully responsible for compliance with all
terms and conditions of this Council Chambers Reservation Application/Agreement and
the Council Chambers Use Policy and Fee Schedule, and that I shall be solely and fully
liable for any breaches or violations thereof, regardless of the actual source of the
payment of any fees or charges required for the use of the Council Chambers facility as
provided herein.
IN WITNESS WHEREOF, VOT and APPLICANT have executed this Agreement the day and
