Couzzo, Jr. Village Manager From: Brad Gomberg Date: 6/21/2010 Re: IT Rack Donation Message: During the renovation of our public safety server room, we removed several equipment racks to make way for a new racking, and cabling system. These racks are now surplus and I cannot see a use for them in the near future. It would be my recommendation that we donate these items to an organization that can put them to better use. Good Shepherd School could put these racks to good use. They would help by improving our computer network that the children of Good Shepherd use. We are requesting that the Village of Tequesta considers approving donating these surplus racks to our School. They would essentially take up space in storage indefinitely. For this reason I would be happy to see them go to an organization that can put them to good use. Our Charter, at Sec 3.03(8) names the Village Manager as "purchasing agent" and that in this capacity, the Manger is authorized to "conduct all sales of personal property which the council may authorize to be sold as having become unnecessary or unfit for Village use." No further specifics are set forth which would restrict the Manager's action in disposing of surplus property once the Village Council has stated that the property is no longer necessary or is unfit for Village use. The nature of the recipient of such surplus property is not restricted in any form or fashion. In this case, we have surplus computer racks which are, in the opinion of the IT department, no longer of any use to the Village, and have a value that does not exceed $500.00. We also have a request from a religious institution to acquire said racks via donation. Should the Village Council make the above determination regarding the status of the surplus property (unnecessary or unfit for Village use), it is my opinion that we can provide the racks to the church without implicating either establishment clause or free exercise clause First Amendment issues. This is especially so since the computer racks themselves are not of a religious nature, and the giving of the racks, I do not believe, would excessively entangle the Village in the church's activities. I would, however, recommend that the racks be "sold" if even for a token amount, in order to comply with the technical requirements of the above referenced Village Charter provision. Keith W.
