The Special Magistrate appointed by the Village Council to hear code compliance cases
for the Village of Tequesta, in accordance with Chapter 162, Florida Statutes, has reviewed the
stipulations of the parties in the above styled matter and based on said stipulations, the following
Conclusions of Law and Order are hereby entered:
STIPULATIONS
1. The original fine in this matter was assessed in the amount of two hundred fifty
dollars ($250.00) per day beginning January 6, 2008 for the violations on the property. In
addition, administrative costs in the amount of one thousand, seven hundred eighty one dollars
($1,781.00) were assessed.
2. As of October 1, 2010, the fine has accrued to the amount of $250,000.00 plus
$250.00 per day until compliance is achieved by the Respondent.
3. The subject property is under contract to be sold to a new owner who intends to
redevelop the site.

4. The parties have stipulated that in an effort to resolve the code enforcement lien so
that the sale of the subject property may proceed, Respondents shall pay the total amount of one
hundred eighty thousand dollars ($180,000.00) to the Petitioner upon receipt of this Order. The
parties further stipulate that to the extent that the property remains in violation, the Petitioner
shall, upon receipt of the aforesaid $180,000.00, assume the responsibility and expense of curing
said violations which are: the removal of the poured concrete slab with exposed rebar and the
removal of overgrown vegetation on the site and the existing building; and further shall release
the lien on the subject property as recorded in the public records of Palm Beach County at Official

CONCLUSIONS OF LAW
Upon the complete execution of the above stipulations, the Respondent(s) shall no longer
be in violation of Chapter 30 Article II Section 30 -33 of the Code of Ordinances of the Village of
Tequesta.
ORDER
It is the Order of the Code Enforcement Special Magistrate that the Respondent's fine
shall be reduced to one hundred eighty thousand dollars ($180,000.00). If this reduced fine of
$180,000.00 is not paid in full to the Village of Tequesta as set forth in this Stipulated Order, the
original fine amount of $250,000.00 (as of October 1, 2010), plus $250.00 per day until
compliance is achieved by the Respondent, shall be assessed.
DONE AND ORDERED THIS 1 2 day of October, 2010.
