AN ORDINANCE OF THE VILLAGE OF TEQUESTA
PROVIDING FOR THE ACQUISITION OF CERTAIN
LANDS FOR USE AS STREETS AND ROADS WITHIN
THE VILLAGE OF TEQUESTA
WHEREAS, the greatly increased use by the public of motor vehicles
of all kinds has caused serious damage to certain unmaintained private roads
lying within the Village of Tequesta; that such private roads are necessary
for the free circulation of traffic in, through and from various areas of the
municipality in that the lack of such adequate roads and streets impedes rapid
and effective fighting of fires and the disposition of police forces and endangers
the health, safety and welfare of the general public; that the lack of such
adequate streets and roads threatens irreparable loss of valuations of property
in portions of the City which can no longer be readily reached by vehicular
traffic; that the adequate provision of properly located and maintained roads
and streets is a public responsibility.
NOW THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE
OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, as follows:
Section 1. That pursuant to the provisions of Florida Statutes 1961,
Sections 167.65 and 167.66, and the Charter of the Village of Tequesta, Florida,
Chapter 57 -1915, Laws of Florida, Article V, Section III, Sub- paragraph 11, it
is hereby determined that the Village of Tequesta shall acquire by condemnation
the following described lands for the purpose of making the same available to
the public as streets and roads.
Section 2. That the cost of said acquisition of said lands for such
purpose shall be paid out of the general funds of the Village of Tequesta, Florida.
Section 3. That said lands are more particularly described as follows:
PARCEL 1 . Cove Road (South) more particularly described
as follows:
A parcel of land in Government Lot 4, Section 30, Township
40 South, Range 43 East, Palm Beach County, Florida, bounded
as follows:
On the West by the easterly right of way line on State Road
No. 5 (U. S. Highway No. 1) as shown on State Road Depart-
ment's right of way Map recorded in State and County Road
Plat Book 2, page 105 to 118, inclusive, Public Records of
Palm Beach County, Florida, on the East by a line parallel
to and 263.65 feet Easterly from,measured at right
angles, said Easterly right of way line on the
South, by a line parallel to and 150 feet Northerly
from, measured at right angles to the South line of
said Section 30; and on the North by a line parallel
to and 60 feet Northerly from, measured at right
angles to the South line of the herein described parcel.
PARCEL 2 . Waterway Road (South) more particularly described
as follows:
A parcel of land in Government Lot 4, Section 30, Township
40 South, Range 43 East, Palm Beach County, Florida,
bounded as follows:
On the West by the easterly right of way line on State Road
No. 5 (U. S. Highway No. 1) as shown on State Road Depart-
ment's right of way Map recorded in State and County Road
Plat Book 2, pave 105 to 118, inclusive, Public Records of
Palm Beach County, Florida, on the East by a line parallel
to and 263.65 feet Easterly from, measured at right angles,
said Easterly right of way line on the South, by a line
parallel to and 150 feet Northerly from, measured at right
angles to the South line of said Section 30; on the North
by a line parallel to and 1057.52 feet Northerly from,
measured at right angles to the South line of said Section
30, on the South by a line parallel to and 30 feet Southerly
from, measured at right angles to the North line of the
herein described parcel.
Section 4. The Village Council be and is hereby authorized and
directed to institute proceedings for the purpose of acquiring said lands in
the manner provided by Law.
