ORDINANCE NO. 44
AN ORDINANCE OF THE VILLAGE OF TEQUESTA
ANNEXING CERTAIN LANDS TO THE TERRITORIAL
LIMITS OF THE VILLAGE OF TEQUESTA
WHEREAS, sub- section (29) of Section 3 of ARTICLE V
of the Charter of the Village of Tequesta grants the Village Council
the power to annex any lands adjoining or within three miles of the
territorial boundaries of said municipality upon the petition of
the owner or owners thereof; and
ti3 iEREAS , COLEMAN F. CARROLL, BISHOP OF THE DIOCESE OF
MIAMI, the owner of certain land situated in Palm Beach County,
Florida, has filed a petition with the Village Council requesting
that the land described therein be annexed to the territorial limits
of the Village of Tequesta, copy of said petition being attached
hereto and made a part hereof as if fully and completely set forth
herein,
NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF
THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, as follows:
Section 1. That the parcel of land described in the
petition hereinabove mentioned and hereto attached is hereby annexed
and incorporated into the Village of Tequesta, and the same shall be
and become a part of the Village of Tequesta,with the same force and
effect as though the same had been originally incorporated into the
territorial boundaries thereof.
And, further, that said lands shall be subject to all of
the ordinances, regulations and codes of said Village.

PETITION FOR ANNEXATION
TO: THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA
The undersigned, being the owner of the following
described property, situate, lying and being in Palm Beach County,
Florida, to -wit:
A parcel of land in Section 30, Township 40 South,
Range 43 East, Palm Beach County, Florida, more
particularly described as follows:
Beginning at the intersection of the Westerl right -
of -way line of State Road No. 5 (U. S. No. 15 with
the E -W quarter section line of said Section 30;
thence Westerly along said quarter section line a
distance of 1055 feet; thence Southerly, at right
angles to the said quarter section line, a distance
of 400 feet; thence Easterly, parallel to said
quarter section line a distance of 1145 feet, more
or less, to a point in the Westerly right -of -sway
line of State Road No. 5; thence Northerly along
said right -of -way line a distance of 410 feet, more
or less, to the point of beginning.
A parcel of land in Government Lot 2 Section 30,
Township 40 South, Range 43 East, Paim Beach County,
Florida.
Beginning at a point in the South line of said
Government Lot 2, being 800 feet west of center line
of right -of -way of State Road No. 5 (U. S. No. 1)
according to Florida State Road right -of -way map
thereof on file in office of Clerk of Circuit Court
in and for Palm Beach County, Florida, recorded in
Road Plat Book 2, pp. 43 thru 56 inclusive; thence
Northerly, making an angle with preceding course,
measured from east to north, of 107 - 5 45" a
distance 223.05 feet; thence Northerly making an
angle with preceding course, measured from south
thru east to north, 162 - 26' a distance of 479.84
feet more or less to a point in a line parallel to
and 50 feet south of South line of land described
in Deed - recorded in Deed Book 1097, p. 379, Palm
Beach County records in file in office of Clerk of
Circuit Court in and for Palm Beach County, Florida;
thence Westerly at right angles to preceding course
and along said parallel line 304 feet; thence Southerly
at right angles to the preceding course a distance
695.54 feet more or less to the south line of
Government Lot 2; thence Easterly along said south
line of Government Lot 2 a distance of 371.33 feet
to the point of beginning;
hereby respectfully requests the Village Council to annex such
lands by ordinance to the territorial limits of the Village of
Tequesta, Florida, pursuant to the authority vested in said
Village under its Charter.
