HomeMy WebLinkAboutOrdinance_32_05/10/1960 ORDINANCE NO. 32 AN ORDINANCE OF THE VILLAGE OF TEQUESTA, FLORIDA, RELATING TO FEDERAL OLD AGE AND SURVIVORS INSURANCE An ordinance declaring the policy and purpose of the Village of Tequesta, Florida, to extend to the employees and officials of said Village of Tequesta, Florida, not excluded by law, nor hereinafter excepted, the benefits of the system of Federal Old Age and Survivors Insurance, as authorized by the Federal Social Security Act, and amendments thereto, upon the basis of applicable State and Federal laws or regulations; authorizing and directing the Mayor to execute agreements and amendments thereto with the State Agency authorized to enter into such agreements, for coverage of said employees and officials; providing for withholdings from salaries and wages of employees and officials of said Village so covered to be made and paid over as provided by applicable State or Federal laws or regula- tions; providing that said Village shall appropriate and pay over employer's contributions and assessments as provided by applicable State or Federal laws or.regulations; providing that said Village shall keep records and make reports as required by applicable State or Federal laws or regulations; BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, AS FOLLOWS: Section 1. It is hereby declared to be the policy and purpose of the Village of Tequesta, Florida, to extend effective as of June 1, 1960, to the employees and officials thereof, not excluded by law, nor excepted herein, the benefits of the system of Old Age and Survivors,Insurance as authorized by the Federal Social Security Act and amendments thereto, and by Chapter 650, Florida Statutes, as amended; and to cover by such plan all services which constitute employment as defined in Section 650.02, Florida Statutes, performed in the employ of said Village by employees and officials thereof, except a. Service of an emergency nature; b. Service in any class or classes of elective position. c. Service in any class or classes of part - time positions. d. Service in any class or classes of possible compensation for which is on a fee basis. Section 2. There is hereby excluded from this ordinance 1 any authority to include in any agreement entered into under Section 3 hereof any service, position, employee, or official now covered by or eligible to be covered by an existing retirement system. Section 3. The Mayor is hereby authorized and directed to execute all necessary agreements and amendments thereto with the Florida Industrial Commission, as State Agency, for the purpose of extending the benefits provided by said system of Old Age and Survivors Insurance to the employees and officials of this Village as provided in Sections 1 and 2 hereof, which agree- ment shall provide for such methods of administration of the plan by said Village as are found by the State Agency to be necessary and proper, and shall be effective with respect to services in employment covered by such agreement performed on and after the 1st day of June, 1960. Section 4. Withholdings from salaries, wages, or other compensation of employees and officials for the purpose provided in Section 1 hereof are hereby authorized to be made, and shall be made, in the amounts and at such times as may be required by applicable State or Federal laws or regulations, and shall be paid over to the State Agency designated by said laws or regula- tions to receive such amounts. Section 5. There shall be appropriated from available 2 funds derived from general revenue of the Village, such amounts, at such times, as may be required to pay promptly the contribu- tions and assessments required of the Village as employer by applicable State or Federal laws or regulations, which shall be paid over to the lawfully designated State Agency at the times and in the manner provided by law and regulation. Section 6. The Village shall keep such records and make such reports as may be required by applicable State or Federal laws or regulations, and shall adhere to the regulations of the State Agency. Section 7. The Village does hereby adopt the terms, conditions, requirements, reservations, benefits, privileges, and other conditions thereunto appertaining, of Title II of the Social Security Act as amended, for and on behalf of all officers and employees of its departments and agencies to be covered under the agreement. Section 8. The Treasurer of the Village is hereby designated the custodian of all sums withheld from the compensa- tion of officers and employees and of the appropriated funds for the contribution of the Village, and the Treasurer of said Village is hereby made the withholding and reporting agent and charged with the duty of maintaining personnel records for the purposes of this ordinance.
