AN ORDINANCE PROVIDING FOR THE CONDUCT OF ELECTIONS; THE
QUALIFICATION OF ELECTORS; THE TIME AND PLACE OF REGISTRATION
AND THE OATH AND IDENTIFICATION OF ELECTOR FOR REGISTRATION;
PREPARATION OF VOTING LIST; EXPIRATION OF REGISTRATION; THE
POWERS OF THE VILLAGE COUNCIL PRIOR TO ELECTIONS; AND SETTING
THE FILING FEE FOR CANDIDATES.
BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM
BEACH COUNTY, FLORIDA, as follows:
Section 1 . No person shall be allowed to vote in any general or special
election held hereafter in the Village unless he shall have the qualifications
prescribed in Section 20, Article III of the Charter of the Village, and shall
register in the manner hereinafter provided.
Section 2 . The Village Clerk shall keep the registration books of the
Village open at his office, or at such other place or places as the Council shall
from time to time designate, each office day but no person shall be allowed to
register during the ten days immediately preceding any election.
Section 3 . Every person applying for registration shall subscribe to the
following oath or affirmation:
"I do solemnly swear (or affirm) that I will protect and defend the
constitution of the United States and of the State of Florida; That I am twenty -
one years of age; That I am a citizen of the United States and of the State of
Florida; and that I have been, or at the time of holding the next election will
have been, a resident of the Village of Tequesta, Florida, for a period of six
months. That I am qualified to vote in such Village election under the Charter
of the Village of Tequesta, the Constitution of and laws of the State of Florida."
The Clerk or any deputy clerk is hereby authorized and required to
administer this oath and the electors shall also be required, under oath, or
affirmation to be administered by the Clerk, to give such description of himself
as will be sufficient to identify clearly his person with the act of registration,
and the clerk shall issue to him a registration certificate.
Section 4. The Village Clerk shall prepare a voting list to be used each
election and in case, through inadvertence or clerical error, an elector who has
registered is omitted from such list, his name may be added thereto by election

officers at the polling place upon exhibiting to them his currently effective
registration certificate; but in no case shall any elector be allowed to vote
unless his name appears upon the list or unless he exhibits a registration
certificate showing him entitled to vote therein.
Section 5 . All registration certificates shall expire on January 1st,
1965, and every five years thereafter, it being the intention of this section
to provide for a complete reregistration in the year 1965, and every five years
thereafter.
Section 6 . The Village Council may designate by resolution at least
thirty days prior to the proposed date of any election:
(a) The date upon which such election is to be held;
(b) The purpose of such election;
(c) The list of polling places.
(d) Such other data as required.
Such resolution shall be posted at the Village Hall immediately after
passage or, in the discretion of the commission, may be advertised in a newspaper
of general circulation in Palm Beach County, Florida.
Section 7 . Whenever any election is required for the approval of the
issuance of bonds or other evidences of indebtedness by the Village pursuant
to the Charter of the Village, or to any other law of the State of Florida, such
election may be called and held in accordance with the terms and conditions of
such law authorizing the issuance of such obligations, any section of this
chapter to the contrary notwithstanding.
Section 8 . Any qualified candidate seeking election as a member of the
Council shall pay a filing fee of 5 percent of the salary of a Council member
or $5.00 whichever is the greater which shall be paid at the time of notice of
candidacy.
Section 9 . That all ordinances or parts of ordinances in conflict
herewith be, and the same are hereby repealed.
Section 10 . This ordinance shall take effect immediately upon its
passage and approval as provided bylaw.
