HomeMy WebLinkAboutOrdinance_18_01/13/1959 ORDINANCE N0, 18 AN ORDINANCE OF THE VILLAGE OF TEQUESTA ANNEXING CERTAIN LANDS TO THE TERRITORIAL LIMITS OF THE VILLAGE OF TEQUESTA AND RE- DEFINING ITS TERRITORIAL BOUNDARIES WHEREAS, all of the owners of certain lands hereinafter described, all located within three miles of the territorial boundaries of the Village of Tequesta, have petitioned the Village Council to have their lands annexed to the territorial limits of the Village of Tequesta; and WHEREAS, sub - section (29) of Section 3 of ARTICLE V of the Charter of the Village of Tequesta grants the Village Council the power to annex any lands adjoining or within three miles of the territorial boundaries of said municipality upon the petition of the owner or owners thereof, NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF THQUESTA, PALM BEACH COUNTY, FLORIDA, as follows: Section 1 . That the following parcels of land lying, being and situate in Palm Beach County, Florida, and more particularly described as follows, to -wit: PARCEL A The South 669.30 feet of that part of the East 1/2 of the Southeast 1/4 of Section 25, Township 40 South, Range 42 East, Palm Beach County, Florida, lying west of the right-of-way of the County Road, as described in County Commissioners' Minute Book 11, page 113, dated June 20, 1927, excepting there- from the South 200 feet of the East 250 feet, and The East 112 of the Southeast 1/4 of the Southeast 1/4 of Section 25, Township 40 South, Range 42 East, Palm Beach County, Florida, excepting therefrom the North 495 feet thereof; excepting also the County Road right -of -way as declared in Commissioners' Minute Book 11, page 113, dated June 20, 1927, and All of Government Lot 7 east of RIVERSIDE DRIVE, less the South 330 feet thereof, all located in Section 25, Township 40 South, Range 42 East; and The North 110 feet of the South 330 feet of Government Lot No. 7, less that portion of Block 4, RIVERSIDE ON THE LOXAHATCHEE, included in said Government Lot No. 7, all in Section 25, Township 40 South Range 42 East, and also excepting the Dahfineyer parcel, which is more particularly described as follows: A parcel of land in Section 25, Township 40 South, Range 42 East, Palm Beach County, Florida, more particu larly described as follows: Beginning at the intersection of a line parallel to, and 220 feet northerly from, measured at right angles, the south line of said Section 25, with the easterly right-of -way of Riverside Boulevard, as shown on Plat of Blocks 3 and 4, Riverside on the Loxahatchee, recorded in Plat Book 8, at page 4, � public records of Palm Beach County, Florida; thence easterly, along said parallel line, 110 feet; thence northerly at right angles to the preceding course, 110 keet; thence westerly, parallel to the south line of said Section 25, a distance of 190.6 feet, more or less, to a point in the easterly right- of-way line of said Riverside Boulevard; thence southerly, along said easterly right-of-way line, 142.7 feet, more or less, to the point of beginning, and The North 495 feet of the Southeast 1/4 of the Southeast 1/4 of Section 25 Township 40 South, Range 42 East, all of said .and lying and being in Palm Beach County, Florida, owned by A. A. Flanagan, as Trustee. PARCEL B All of that part of the Southwest 1/4 of Section 30, Township 40 South, Range 43 East, lying west_, of the Florida East Coast Railway right -of -way, situate in Palm Beach County, Florida, owned by Eastern Sales, Inc., a Florida corporation. PARCEL C A parcel of land in Government Lot No. 6, Section 25, Township 40 South, Range 42 East, more particularly described as follows: Commencing at the intersection of the center lines of E1 Portal and Seville Road, as shown on Sheet No. 3 of Jupiter Manors Section One, as filed in Plat Book 12, page 3�/, public records of Palm Beach County, Florida, said intersection being 1,185.2 feet South 87 55' East from the west line of said Section 25; thence South 87 55' East along said center line of E1 Portal 65.38 feet; thence North 0 13' East, parallel to the west line of said Section 25, 60 feet to the point of beginning and the southwest corner of the parcel of land herein described; thence continue along the same course North 0 13' East, 145.30 feet; thence East parallel to the north line of Government Lot 5 of said Section 25, 357 feet, more or less, to the waters of the North Prong of the Loxahatchee River; thence southerly along the waters of said river, 157 feet, more or less, 2 to a point in a line parallel to and 60 feet northerly (measured at right angles) from the center line of said E1 Portal; thence North 87 55' West along said parallel line, 327''feet, more or less, to the point of beginning, owned by Raynor S. Miller, a free dealer. PARCEL D Lot 20, Block 3, Riverside on the Loxahatehee, Jupiter, Palm Beach County, Florida, owned by George H. Laws and Elinor A. Laws, his wife. PARCEL E A parcel of land in Section 25, Township 40 South, Range 42 East, Palm Beach County, Florida, more particularly described as follows: Begin- ning at the intersection of a line parallel to, and 220 feet northerly from, measured at right angles, the south line of said Section 25 with the easterly right - of-way line of Riverside Boulevard, as shown on Plat of Blocks 3 and 4. Riverside on the Loxahatchee, recorded in Plat Book 9, page 4, public records of Palm Beach County, Florida; thence easterly, along said parallel line, 110 feet; thence northerly, at right angles to the preceding course, 110 feet; thence westerly, parallel to the south line of said Section 25, a distance of 190.6 feet, more or less, to a point in the easterly right- of-way line of said Riverside Boulevard; thence southerly, along said easterly right- of-way line, 142.7 feet, more or less to the point of beginning, owned by Wiard P. Dahlmeyer and Mary Ethel Dahlmeyer, his wife. PARCEL F A parcel of land in Sections 25 and 36, Township 40 South, Range 42 East, Palm Beach County, Florida, more particularly described as follows: Beginning at a point in the south line of said Section 25 at a distance of 465 feet North 89 37' 30" East from the southwest corner thereof; thence.North 9 32 30" East a distance of 731.8 feet to a point in the center line of a paved road 8 feet in width and being also the center line of E1 Portal as shown on plat of Jupiter Manors, Section 1, Sheet 4, recorded in Plat Book 12, page 38, public records of Palm Beach County, Florida; thence South 87 43' East along said center line a distance of 553.24 feet to a point in the westerly right -of -way line of Ssvilla Road as shown on said plat; thence South 11 45 30" West along said westerly right -of -way line a distance of 711.26 feet to a point in the south line of said Section 25; thence South 89 37' 30" West along said Section line a distance of 70.23. feet to the intersection of said Section line with the northeasterly extension of the north- westerly boundary of land conveyed to Girl Scouts of the Palm Beaches by deed dated September 21, 1939, and recorded in Deed Book 578, page 278, 3 public records of Palm Beach County, Florida; thence South 57 01' 30" West along said north- easterly extension and along said northwesterly boundary a distance of 687.17 feet to a three - quarter -inch pipe driven in the ground - ;, thence southwesterly along the same course to the waters of Jupiter River (Northwest Fork); thence westerly along the waters of said Jupiter River to a point in a line running South 38 09' 30" West from the point of beginning; thence North 38 09' 30" East along said last described line to a half -inch pipe driven in the ground; thence along the same course North 38 09 30" East, a distance of 462.0 feet to the point of.beginning, owned by Guy W. PARCEL G All of Government Lot 6, Section 25, Township 40 South, Range 42 East, and all of Government Lot 3, Section 36, Township 40 South, Range 42 East, lying west of that land conveyed by V. M. Johnson and Lois R. Johnson, his wife, to Guy W. Heath and Lillian M. Heath, his wife, by deed dated June 9, 1954 and recorded in Deed Book 1056, page 654, public records of Palm Beach County, Florida, owned by V. M. Johnson and Lois R. Johnson, his wife, are hereby annexed and incorporated into the Village of Tequesta, and the same shall be and become a part of the Village of Tequesta with the same force and effect as though the same had been originally incorporated into the territorial boundaries thereof. And, further, that said lands shall be subject to all of the ordinances, regulations and codes of said Village. 4 Section 2. That from and after the enactment of this ordinance the territorial limits of THE VILLAGE OF TEQUESTA, FLORIDA, are hereby defined and shall be as follows. Beginning at the northeast corner of Section 26, Township 40 South, Range 42 East, Palm Beach County, Florida, thence southern along the easterly boundary of said Section 26, to the center line of E1 Portal as shown on plat of Jupiter Manors,, Section One, Sheet 4, recorded in Plat Book 12, Page 38, Public Records of Palm Beach County, Florida; thence easterly along said center line to the center line of Sevilla Road as shown on said plat; thence continue easterly along said center line of E1 Portal a distance of 65.38 feet; thence northerly parallel to the Nest line of Section 25, Township 40 South, Range 42 East, a distance of 205.30 feet; thence easterly parallel to the North line of Government Lot 5, of said Section 25, to a point in the center line of the North F6rk of the Loxahatchee (Jupiter) River; thence meandering southerly along the center of the North Fork of the said Loxahatchee (Jupiter) River, to a point where said center line intersects the westerly extension of the North line of Lot 20, Block 3, Riverside -tin- The- Loxahatchee, as shown on plat thereof recorded in Plat Book 9,.pages 4 & 5, Public Records of Palm Beach County, Florida; thence easterly along said, westerly extension and along the North line of said Lot 20, and along its easterly extension across Riverside Boulevard to a point in the easterly right -of -way line of said Riverside Boulevard; thence northerly along said easterly right -of -way line to a point in the North line of Government Lot 7 of said Section 25; thence easterly along the North line of said Government Lot 7 to the East line of said Section 25; thence northerly along the East line of said Section 25, to the Quarter- Section corner tin the East line of said Section 25; thence easterly along the East and Nest Quarter- Section line of Section 30, Township 40 South, Range 43 East, to a point in the westerly right -of -way line of the F. EXCEPTING THEREFROM the North 145.45 feet of the South 814.75 feet of that part of the East Half of the Southeast - Quarter of said Section 25, Township 40 South, Range 42 East, lying West of the right -of -way of said County Road.
