AN ORDINANCE OF THE VILLAGE OF TEQUESTA PALM BEACH COUNTY, FLORIDA,
LICENSING, REGULATING AND TAXING THE DISTRIBUTION AND SALE OF ALL INTOXICATING
LIQUORS, WINES AND BEVERAGES; PROVIDING FOR THE TRANSFER OF SAID LICENSES;
PROHIBITING MINORS FROM BEING EMPLOYED IN BARS; PROHIBITING THE SALE OR SERVING
OF INTOXICATING LIQUORS TO MINORS; FROVID12IG PENALTY FOR THE VIOLATION OF THIS
ORDINANCE AND FOR OTHER PURPOSES,
BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA,
PALM BEACH COUNTY, FLORIDA, as follows:
Section 1. That for the purpose of this ordinance, the terms liquors,
intoxicating liquors, beverages, intoxicating beverages, and alcoholic beverages
are used synonymously and shall mean any liquors or beverages containing more
than one per cent of alcohol bT weight.
Section 2. Any person, association of persons, or corporation which
engages in the business of selling, bartering or exchanging, or in anywise deal-
ing in liquors, wines, beers, or other beverages containing more than one per
cent of alcohol by weight, shall, before engaging in such business, file, under
oath, with the tax collector of said village a written application for license
to conduct such business, said application to be made on forms to be provided
by the tax collector of said village. Such application shall state the character
of business to be engaged in and the kind of license, as hereinafter defined,
which the applicant desires.
Section 3. Licenses shall be issued only to persons of good moral
character who are residents of the County of Palm Beach and who have not been
convicted of any offense involving moral turpitude and who are not less than
twenty -one years of age. Licenses to corporations shall be issued only to cor-
porations whose officers and directors are persons of good moral character who
are residents of the County of Palm Beach and who have not been convicted of
any offense involving moral turpitude. There shall be no exemption from the
license taxes herein provided to any person, association: of persons, or cor-
poration. No person, official or employee authorized to enforce the provisions
of this ordinance and no sheriff or other officer with state police powers shall
be permitted to engage in the sale of liquors or beverages as provided under this
ordinance, nor will they be permitted to own my stopk or interest in any firm,
partnership or corporation dealing wholly or in part in the sale or distribution
of alcoholic beverages.

Section 4.
Each vendor shall pay an annual license
tax as follows:
(a) Each vendor of beer only (the word beer being used in its ordinary
accepted form) for consumptio off the premises shall pay an annual license
tax of $3.75.
(b) Each vendor of beer only (the word beer being used in its ordinary
accepted form) for consumption upon the premises where sold shall pay an
annual license tax of $7.50. i
(c) Each vendor of beverages containing alcohol of more than one per
cent by weight anal not more than fourteen per cent by weight and wines, re—
gardless of alcoholic content, for consumption off the premises where sold
shall pay an annual license tax of $12.50.1
(d) Each vendor of beverages containing alcohol of more than one per
cent by weight and not more than fourteen per cent by weight and wines, re—
gardless of alcoholic content, for consumption upon the premises ih ere sold
shall pay an annual license tax of $2500.
(e) Each vendor permitted to sell alcoholic beverages without regard
to alcoholic content where beverages are sold only in sealed containers for
consumption off the premises where sold shall parr a license tax of $281.25.
(f) Each vendor permitted to sell alcoholic beverages without regard
to alcoholic content for consumption upon the premises where sold shall pay
a license tax of $375.00.
(g) Each club permitted to sell alcoholic beverages without regard to
alcoholic content for consumption upon the premises where sold or where beverages:
are sold in sealed containers for consumption off the premises where sold, to
members and non — resident guests only shall pay, a license tax of $125.00.-:
Section 5. No license issued under the provisions of this ordinance
shall be transferable except upon application of the transferor and transferee
to the Village Council of the 'Village of Tequesta and approval of said transfer
by the Village Council.
Section 6. No license shall be issued except annual licenses which
shall be paid for on or before the first of January of each year and shall expire
on the first of the succeeding January.
Section 7. It shall be unlawful for any person, firm or corporation
to possess, offer for sale or to sell alcoholic beverages of ary kind which have
not been manufactured and licensed pursuant to the laws of the United States and
of the State of Florida.
j Section 8. It shall be unlawful for any person, firm, or in cases of
corporations, the officers, agents or employees thereof to sell, give, serve or

permit to be served., ary alcohol or alcoholic beverage, whether wine, li-mor or
beer, to any person under the age of twenty -one years, or to any person who is
intoxicated, or to any person who is known to be an habitual drunkard, or to any
person under the supervision or control of any State hospital, whether such per -
von be on furlough or otherwise,
Section 9. It shall be unlawful for any person to misrepresent or
misstate his or her aSe or the age of any other person for the purpose of induc-
ing any licensee, his agent or employee, to sell, give, serve or deliver any alco-
holic or intoxicating beverages to a person under twenty -one ,years of age.
Section 10. It shall be unlawful for any person under the age of twenty -
one years to be employed behind ark' bar.
Section 11. No intoxicating or alcoholic beverages may be sold in sealed
containers or otherwise, for consumption on or off the premises, or served or per -
muted to be served, or consumed in aW place holding a beverage license from the
Village of Tequesta, Florida, or in any public place within the territorial limits
of said Village by any person, persons firm or corporation, vendor or distributor,
between the hours of 3 otclock A. M. and 7 o'clock A, M. of the same day on weekdays,
and between the hours of 3 o'clock A. M. and 8 o t clock A. Tel. of the same day on
Sundays; provided further that no sales or serv of alcoholic or i ntoxicatin
beverages shall be permitted on any day of a general, special or rimary election
during the hours when the polls are open. Nothing herein shall be deemed to pro-

hibit the sale of intoxicating beverages during the lawful hours of sale on Sundays.
Section 12. Whenever any person not eligible to have a license under
the terms of this ordinance procures the issuance of a license to him or whenever
any person being; eligible procures a license and thereafter becomes ineligible,
in all such cases his license may be revoked by said Village Council and cancelled
without any refund.
Section 13. Whenever any person shall have been convicted in the Munici-
pal_ Court of violating this ordinance or any other ordinance of the Village of
Tea,uesta, his License or licenses issued pursuant to the terms of this ordinance
shall be suspended. or revoked by the Village Council in its sound discretion, but
in such cases said Village shall refund unto said licensee the unearned or unused
portion of his license.

Section 1�t. Any person violating any of the terms and provisions
of this ordinance shall, upon trial and conviction thereof, be fined not more
than $500.00 or imprisoned in the Villacre jail for a period not to exceed
ninety (90) days, or by both such fine and imprisonment.
Section 15. This ordinance shall tape effect immediately upon its
passage and approval as provided by law.
